The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesde.y~ July 3, 1957 at 1:00 o'clock F. M. Present were Mayor Swanson, Commissioner
Erwin, Commissioner Lowe, City Manager Henderson, Administrative Assistant Sales, City Attorney
Lovelace and the Clerk. The followinE proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Lowe, seconded by
COlmnissioner Erwin, that the minutes be approved as read and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Conunissioner Lowe;
those voting No, none.
Applications for Beer & Liquor License
Applications were presented from Lee Brookshire for a retail beer license at 712 W. Main and from
the Elk's Country Club for a cl ub beer and liquor license.
It wes moved by Conunissioner Erwin, seconded by Commissioner Lowe, that the aF'plications be
approved and the licenses issued and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Advertisement for Bids -- Misc. W & C 1957
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, tre. t the Clerk of the
Commission be authorized to advertise for bids on construction and/or reFair of sidewalks in accordance
wi th the list prepared by the City Engineer for the year 1957 and the motion carried by the following;
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe;
those voting No, none.

Special Improvement Paving District on North Willson
The City Manager recommends that a special improvement district be creAted to pave North Willson
Avenue from Villard to Short Street. A similar district was established two years aEo but no work was
done in it due to lack of acceptable bids for the work. Paving in this district could now be bid witb
other districts recently established.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Attorney be
instructed to prepare a resolution of intention to create a special improvement district to pave North
Willson from Villard to Short, and the motion carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Resolution No. 847 - Intention to Create S. I. D. No. 394
The City Attorney as instructed has prepared a resolution of intention to create Special Improvement
District No. 394, paving on Fourth Avenue from Garfield to Grant. Resolution No. 847 was presented,

and adopted and July 3l, 1957 be set as the date for hearing protests, and the motion was carried by

Resolution No. 848 - Intention to Create S. I. D. No. 395
The City Attorney as instructed has prepared a resolution of intention to create Special
Improvement District No. 395, paving on Grant Street from Willson Avenue to Sixth Avenue. Resolution
No. 848 was presented. entitled:

Delegate to F'iremen's Convention
The Sta.te F'iremen' s Convention will be held in Conrad, Montana July 18th to 20th, 1957. It was
moved by Conurlissioner Erwin, seconded by Commissioner Lowe, that two members of the Bozeman Fire
Department be authorized to attend this convention, the expense of one such delegate to be paid from
the General Fund, and the motion was carried by the following Aye and No vote; those voting Aye being
Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Water Improvement Project - Bond & Contract - Statewide Plbg & Heating Co.
Bonds and contracts of the Statewide Plumbing & Hea.ting Co., Inc. for construction of Phase I,
Schedule 2 and Phase II end Schedules 2, 4 and 5 (Alternate No.1) of the Water Works Expansion and
Improvement Project, in accordance with bids of said company accepted by the City Commission on June
17, 1957, were presented
The bonds and contracts were approved as to form by the City Attorney~ whereupon it was moved by
Commissioner Lowe, seconded by Commissioner Erwin~ that the Mayor and the C1erk of the Commission be
authorized to sign the contract for the City of Bozeman, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those
voting No, none.
Wa ter Improvement Project - Bond & Contract - Haggerty-Messmer Co.
Bonds and contracts of the Haggerty-Messmer Co. for construction of Phase I, Schedules 1, 3 and
4 and Phase II, Schedule 3 of the Water Works Expansion and Improvement Project, in accordance with
bids of said company accepted by the City Commission on June l7, 1957, were presented.
The bonds and contracts were approved as to form by the City Attorney, whereupon. it was moved
by Commissioner Lowe, seconded by Commissioner Erwin, that the Mayor and the Clerk of the Commission
be authorized to sign the contract for the City of Bozema.n~ and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe;
those voting No~ none.
Right-of-way Easements & Damages Discussed
B. L. Clark, Jack Nash, Mrs. Melva Morris, Miss Marguerite Kirk, Walter Kraft and other owners

of properties which will be crossed by water lines in the water works expension and improvement
project appeared before the Commission to further discuss the matter of l-'ayment for easements and
damages resulting from the installation of such water lines. These owners had presented a proposal
to the City Commission at their meeting on June 26th. The City had presented a counter proposal to
them offering payment for damages on the following basis:

For Irrigated Land - $4.35 per rod,
For Non-irrigated Land - $3.30 per rod,
For tracts where the length of the pipe line crossing is less than 300 feet - $50.00;
Flus: For each aFpurtenance to the line that causes a surface obstruction in a
field - $25.00 ~
For every other surface obstruction - $10.00.
These owners informed the Commission that they woul d not accept the City's counter proposal and
that they considered their offer of June 17th as the minimum settlement acceptable to them. Action
in this matter was deferred pending further study and investigation of it.

In addition to the claims listed above a claim of E. D. Ferguson in the amount of 46i which he
claimed as overpayment for water furnished for his residence at ll05 South Grant Avenue was presented.
The Manager stated He. t he has audited these claims and, with the exception of the claim of E. D.
:Fer€;uson, finds them to be true and lawful claims against the City of Bozeman. He recommends that the
claim of E. D. Ferguson should not be allowed and that warrants be drawn for the payment of all of the
claims presented in accordance with the above list.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the claims, with the
exception of the E. D. Ferguson claim of 46i, be apfroved and warrants issued for their payment, and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Lowe; those voting No, none.

It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the reports be accepted
and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being

Five-Day Week
The Manager presented work schedules of the Police and Fire Departments showing the assignment of
men effective July 1, 1957 when these departments were fut on a Five-Day per week schedule.
Since operating departments of the City have been on a Five-Day week for several years and placing
Policemen and Firemen on a Five-Day week would leave only City Offices on a ~-day per week schedule,
the City Manager recommended that these offices also be placed on a Five-Day fier week schedule. It was
moved by Commissione r Erwin, seconded by Commissioner Lowe, that offices of the Ci ty of Bozeman hereafter

be opened for five days, beginning Monday of each week, legal holidays excepted, and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner

City-County Planning Board
Communication from the Board of County Commissioners was read, stating they have elected to
form a City-County Planning Board.
There being no further business to come before the Commission at this time, it was moved by
