The Commission of the City of Bozeman met in regular session in the Commiasion Room~ City Hall
Building~ Wednesday~ January 9~ 1967 at 1:00 o'clock P. M. Present were Mayor Swanson. Commissioner
Lowe~ City Manager Henderson, Administrative Assistant Sales. City Attorney Lovelace and the Clerk.
The following proceedings were had:

Minutes of the last regular session were read and it was moved by Commissioner Lowe, seconded by
Mayor Swanson, that the minutes be approved as read and the motion was carried by the following Aye
and No vote: those voting ~e being Mayor Swanson and Commissioner Lowe; those voting No~ none.
Water Works Project --- Rights-of-Way for Water Line
John Morrison of Morrison-Maierle, Consulting Engineers for the City's water expansion program,
appeared before the Commission to discuss questions on right-of-way acquisition for supply and distribu-
tion lines. Mr. Morrison recommended that the City obtain a 30-foot right-of~way at the following
prices, any damages to be in addition:
$100.00 a mile on grazing land
150.00 a mile on non-irrigated land
200.00 a mile on irrigated land
Special agreement on tracts of less
than one-quarter mile.
Supplementary Agreement on Engineering for water Works Project
Mr. Durkee of H. H. F. A. has informed the City Manager that partial payment cannot be made by
his agency since nothing in the original agreement provides for partial payment. However, he states
partial payment may be made if a supplementary agreement to the original is made providing for
partial payment to the engineers and an authorized statement by the Mayor that 50% of the planning

work has been completed is presented. Mr. Morrison was instructed to prepare the supplementary
agreement and since the City Engineer reports that~ to the best of his knowledge. the plans are 50%
complete. it was moved by Commissioner Lowe~ seconded by Mayor Swanson, that the Mayor and the Clerk
of Commission be authorized to sign for the City of Bozeman both the supplementary agreement and the
statement of 50% completion, and the motion was carried by the following .Aye and No votel those voting
~e being Mayor Swanson and Commissioner Lowe; those voting No, none.
Extension of Time for Completion of Water Improvement Plans
The agreement date set for completion of the water improvement plans is December 26, 1956. It was
moved by Commissioner Lowe, seconded by Mayor Swanson, that the Mayor be authorized to act for an ex ten-
don of six months for completion of the water improvement plans, and the motion carried by the follow-
in@; Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Lowe; those voting No, none.

The Manager stated he has audited these claims and finds them to be true and lawful claims against
The City of Bozeman and recommends that warrants be drawn for their payment. After examination of the
claims in detail by the Commission and checking them wi th the claim register, it was moved by Commissioner
Lowe, seconded by Mayor Swanson, that the claims be approved and warrants issued for their payment~ and
the motion was carried by the following Aye and No vote. those voting Aye being Mayor Swanson and
and Commissioner Lowe; those voting No, none.

Application for Beer & Liquor Licenses
The following applications for licenses to sell beer and/or liquor were presenteda

It was moved by Commissioner Lowe, seconded by Mayor Swanson, that these applications be approved
and the licenses ordered granted and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson and Commissioner Lowe; those voting No~ none.
Resolution No. 829 -... Cancelling Liability for Improvement Bonds
Pursuant to instructions from the Office of the State Examiner of the State of Montana~ Resolution
No. 829, cancelling liability for certain improvement bonds, was presented. entitled:
ABSOLUTION OF THE COMMISSION OF THE CITY OF' BOZEMAN CANCELLING OF RECORD CERTAIN SPECIAL
IMPROVEMENT DISTRICT AND MISCELLANEOUS WALK AND CURB LIABILITY ACCOUNTS IN THE AMOUNTS AND
IN THE SPECIAL IMPROVEMENT DISTRICTS AND MISCELLANEOUS WALK AND CURB BONDS HEREIN SPECIFIED,
THE LIABILITY OF' WHICH HAS BEEN EXTINGUISHED BY THE APPLICATION OF TEE STATUTE OF LIMITA-
TIONS OR OTHER LAWS OF THE STATE OF MONTANA.
It was moved by Commissioner Lowe, seconded by Mayor Swanson, that the resolution be passed and
adopted and the motion carried by the following Aye and No votea those voting Aye being Mayor Swanson
and Commissioner Lowe; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seoonded by l4ayor Swanson, that the meeting adjourn, and the motion was carried by
the following Aye and No vote: those voting ~e being Mayor Swanson and Commissioner Lowe; those
voting No, none.
