HomeMy WebLinkAbout1957-03-27 Bozeman, Montana March 27, 1957 219 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, March 27, 1957 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner Erwin, Commissioner Lowe, City Manager Henderson, Administrative Assistant Sales, City Attorney Lovelace and the C~rk. The following proceedings were had: 1 Minutes of the last regular session were read and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the minutes be approved as read and the motion was carried by the follow- .ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No~ none. Fire Department - Policy on Use of Fire Equipment John McCrosson, Fire Chief, has raised the question as to what should be done in case his Department is called for assistance, through use of fire fighting equipment, in controlling crowds, quelling a riot, dispersing a mob, or similar situation involving the use of such equipment to maintain law and order. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that equipment of the Bozeman Fire Department will be used only in answering fire alarms and fighting fires, in fire prevention work, or in such other ways which are normal operations of a fire department and no special or irregu- lar use of such equipment will be made except with approval and specific authority, in each individual case, from the City Commiss ion, and the motion carried by the following Aye and No vote: those vot ing Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Zoning -- Grocery Store in Business District Part II I Question has been raised as to whether or not a grocery and drug store proposed to be built by Mecklenburg & Gower in Business District Part II would be allowable under the zoning ordinance which permits in this area small retail businesses. After some discussion, the City Manager proposed that, unless there was objection, the Building Inspector would issue a permit for the store. Electrical Contractor's Bond Cancelled -- C. P. Electric Co. Request has been made for cancellation of bond for C. P. Electric Company of Livingston as they are no longer working in Bozeman. It was moved by Commissioner Lowe, seconded by Commissioner Erwin. that the bond of the C. P. Electric Company as an electrical contractor be cancelled as of this date, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Zoning -- l5-foot Set-back in Business District Discussed The possibility of amending the zoning ordinance in respect to that part of Business District, Part I, where a IS-foot set-back is required was discussed by the Commission. It was felt that no change should be made in the zoning ordinance at this time and, if requests to build wi th less than the specified IS-ft. set-back in this area are made they should be handled separately and any excep- tions requested should go to the Board of Adjustment. 1 Fire Protection for High School Bozeman High School District has requested that they be allowed to enter into an agreement with the City of Bozeman for fire protection. Since the majority of the High School's financial support is derived from Bozeman taxpayers and such an agreement will mean a large savings in fire insurance premium. it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City.Attorney and County Attorney prepare an agreement whereby fire protection will be furnished the Bozeman High School outside the City Limits for the sum of $1.00 per year and other valuable conSideration. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson. Commissioner Erwin and Commissioner Lowe; those voting No, none. 250 Driveway at 22 South Black -- First National Bank Wri tten request was presented from the 1st National Bank for authori ty to remove one parking meter, remove necessary curb and install a drive-way into the "Customer Parking Lot" at 22 South Black Avenue. Sketch by the City Engineer of his approved location and design for this driveway was also presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that permission to install this driveway be granted and the motion carried by the following Aye and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Poppy Sale -- VFW Club The Veterans of Foreign Wars request to have May 18, 1957 as their annual Poppy Day. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the request be granted and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowej those voting No, none. Water Expansion Project -- 1% Reserve for Backfill It is recommended by Morrison-Maierle, Inc., Consulting Engineers for the City Water Expansion Project, that specifications for the project include a 1% reserve to be held for one year for any back- filling of trenches. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the 1% reserve clause be included in the specifications, and the motion carried by the following Aye and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowej those voting No, none. Water Works Project -- Easements with Gallatin County Easements with Gallatin County for that part of the water supply lines crossing county property were presented. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the Mayor and the Clerk of Commission be authorized to sign the easement for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowej those voting No, none. Adjournment There be ing no further to siness to come before the Commission at this time, it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjourn, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowej those voting No, none.
