The Commission of the City of Bozeman met in regular session in the Commission Room. City Hall
Building, Wednesday, April 24, 1957 at 1:00 o'clock P. M. Present were Mayor Swanson. Commissioner
Erwin. Commissioner Lowe. City Manager Henderson. Administrative Assistant Sales, City Attorney
Lovelace and the Clerk. The following proceedings were had:
Minutes of the lest regular session were read and it was moved by Commissioner Lowe, seconded
by Commissioner Erwin, that the minutes be approved as reed and the motion was carried by the follow-
ing Aye and No vote: those votirlg Aye beinr; Mayor Swanson, Commissioner Erwin and Commissioner Lowe;
those voting No, none.
Hearing - Resolution !'Jo. 832 - Vacating I'ortion of West Curtiss Street
This was the time and place set for hearing protests to Resolution No. 832 which declared inten-
tion to vacate a portion of West Curtiss Street. The Affidavit of Publication of Notice and Acknowledge-
ment of Service of the Notice on abutting property owners were presented. There being no protests filed
and no one present to protest, the City Attorney was instructed to prepare an ordinance vacating said
portion of West Curtiss Street.
Ordinance No. 797 - Vacating Portion of West Curtiss Street
1he City Attorney, as instructed, presented Ordinance No. 797, entitled:
AN ORDINANCE OF THE CITY OF' BOZEMAN. MONTANA. VACATING PORTIONS OF WEST CURTISS STREET IN
SAID CITY OF BOZEMAN. MONTANA.
It was moved by Commissioner Lowe. seconded by Commissioner Erwin. that the Ordinance be passed
and adopted and the motion carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Block Main Street -- Jeycee Teenage Road-E-O
Letter was read from South Bickley. President of the Bozeman Jr. Chamber of Commerce, in which
the Jaycees request permission to block Main Street from Tracy Avenue to Willson Avenue and a half
block of Willson AVenue on each side of Main Street on the morning of May 18th, 1957, to conduct their
annual Teenage Road-E-O. Attached was a peti tion signed by 31 businesses in the block inviting the
Jaycees to use this location for the project and also presented was a letter of approval from the
Retail Trades Committee of the Chamber of Commerce.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that permission be granted
subject to the consent and approval of the State Highway Department, and the motion carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Swanson. Commissioner Erwin and Commissioner Lowe;
those voting No, none.
Purchase of Meters and 1-i ttings
Wm. Border, Water Superintendent, recommended the purchase of 24 water meters. It was moved
by Commissioner Lowe, seconded by Commissioner Erwin, that the City Manager be authorized to purchase
24 water meters and fittings to cost approximately $700.00 and the motion carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe;
those voting No. none.
Water Rate Increase
Order of Public Service Corrmdssion
Order No. 2647 of the Public Service Comrr,ission of the State of Montana, dated April 1, 1957,
which reviewed the public bearing held in Bozeman on February 14, 1957, on the petition of this City,
dated September 14, li756, for autnori ty to increase water rates, was received on April 22. 1957 and
presented at this time. The order granted the petition of the City, subject to certain revis ions,
effective with the next billing date following receipt of the order.
It was recommended by the City Manager that the increased rates as alloweci be put in effect

the bonds. Commissioner Erwin voiced objection to the increased rates beine; rut in effect before the
date of sale of bonds the retirement of which is to be made possible by the inereased rates. He stated
that, in his opinion, the value of having reserves built up at the time the bonds are sold, as to its
effect on favorable sale of the bonds, cannot be determined and is questionable. The matter was discussed
at length and it was moved ~ Commissioner Lowe, seconded by Mayor Swanson, that the rate increase, as

approved by the Public Service Commission, be made effective on May 1st, 1957, and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Swanson, Commissioner Lowe;
those voting No being Commissioner Erwin.
Flags -- V. F. W. Loyalty Day
Vernon Holmquist, Commander of V. F. W. in Bozeman, appeared before the Commission to request
that flags be displayed on National V.F. W. Loyalty Day, May 1st, 1957. It was moved by Commissioner
Erwin, seconded by Commissioner Lowe, that the request be granted and the motion carried by the follow-
ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe;
those voting No, none.
Petition -- S. I. D. South Grand - Garfield to Third Avenue
Peti tion signed by approximately 60% of owners of affected properties requesting the establish-
ment of an S. I. D. to install paving on South Grand Avenue from Garfield to Third Avenue was presented.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Engineer be instructed
to prepare necessary data and, based on these data, the City Attorney be instructed to prepare a
resolution of intention to create the requested district and the motion carried by the following Aye
and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those

Petition -- Abandoning Parking Maintenance District No. 52
~
A peti tion signed by a large representation of owners of property in Parking Maintenance District
No. 52 (West Babcock Street between 5th Avenue and 8th Avenue) was presented in which it was requested
that this Parking Maintenance District be abandoned. It was moved by Commissioner Erwin, seconded
by Commissioner Lowe, that the City Attorney be instructed to prepare the resolution of intention to
abandon the district and the motion carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
