Montana May 22, 1957 The Commission of the City of Bozeman met in regular session in the Commission Room, Ci~ Hall Building, Wednesday~ May 22~ 1957 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner Erwin, Commissioner Lowe~ City Manager Henderson~ Administrative Assistant Sales, City Attorney Lovelace and the Clerk. The following proceedings were had: 1 Minutes of the last regular session were read and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the minutes be approved as read and the motion was carried by the follow- ing ~e and No vote: those voting ~e being Mayor Swanson. Commissioner Erwin and Commissioner Lowe; those voting No, none. Public Hearing -- S. I. D. No. 389 This was the time and place set for public hearing on the creation of Special Improvement Distriot No. 389, paving on Grand Avenue from Garfield Street to Third Avenue. Affidavit of Publication of the Notice was presented together with the Clerk's Mailing Certificate that all property owners have been notified. Protests amounting to~2 percent of the property affected have been filed and no one was present to protest. It was moved by Commissioner Lowe~ seconded by Commissioner Erwin~ that the protests be overruled as insuffioient, and the City Attorney be instructed to prepare a resolution creating the district, and the motion carried by the following Aye and No vote: those voting A.ye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Resolution No. 841 -- Creating S. I. D. 389 I The City Attorney as instructed has prepared the resolution creating Special Improvement District No. 389, which was presented. entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 389 OF TEE CITY OF' BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT OK SOUTE GRAND AVmUE F'ROM GARF'IELD STREET TO ITS POINT OF' INTERSECTION WITH SOUTH THIRD AVENUE, IN SAID CITY. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the resolution be passed and adopted, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Resolution No. 837 -- Intention to Create S. I. D. No. 391 The Ci~ Attorney as instructed has prepared a resolution of intention to create Special Improvement District No. 39l~ paving on Hayes Street between Willson and Sixth Avenues. Resolution No. 837 was presented, entitled: A RESOLUTION OF TEE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL ThIPROVEMENT DISTRICT NO. 391 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON WEST HAYES STREET FROM SOUTH WILLSON AVENUE TO SOUTH SIXTH AVENUE, SA.ID PAVEMENT PROJECT TO INCLUDE COMBINATION CONCRETE CURBS AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, AND BITUMINOUS SURFACE COURSE AND OrnER WORK INCIDENtAL THERETO. No. 392 The City Attorney as instructed has prepared a resolution of intention to create Special Improvement District No. 392, drainage from Eighth Avenue to .ourteenth Avenue and from College Street to Main Street. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the resolution be passed and adopted and June 19, 1957 be set as the date for hearing protests~ and the motion carried by the follow- ing Aye and No vote, those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; tilose voting No, none. Report The report of the Police Judge for the month of April~ 1957 was presented. It was moved by Commissioner Lowe, seconded by Commissioner Erwin. that the report be accepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No~ none. Sidewalk at New High School on Eleventh Street Side Inquiry has been made by officials of' Bozeman High School regarding proper location fbr sidewalk along the Eleventh Street side of their property. It was moved by Commissioner Lowe. seoonded by Commissioner Erwin~ that the City Engineer be instructed to check with high school officials regarding location and width of sidewalk and that they proceed in accordance with the Engineer's recommendations, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Police Chief to Attend Law Enforcement Conference The Attorney General's Law Enforcement Conference is to be held in Helena~ May 23rd through 25th, 1957, and city law enforcement officers have been invited to attend. It was moved by Commissioner Lowe~ seconded by Commissioner Erwin, that the Chief of Police be authorized to attend and his expenses be paid from the General Fund, and the motion carried by the following Aye and No vote, those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. ,Permission to Connect to Sewer Line for College Housing Letter from Martin Whalen, Superintendent of' Physical Plant for M. S. C., requesting pe~ission to connect sewers from 35 new houses onto the sewer system west of Eleventh Avenue was read. It was moved by Commissioner Erwin, secended by Conunissior.er Lowe~ that pennission be gr..r.ted provided that any increase in lines in the present system made necessary by the extra load will be installed at the expense of the College~ and the motion carried by the following Aye and No vote' 1 I I. 1 1 1 those voting Aye being Mayor Swanson~ Commissioner Erwin and Commissioner Lowe; those voting No. none. 271 Public Hearing by Highway Commission -- Re: Paving North Rouse It was announced that public hearing will be held before the Highway Commission at the City Hall on the evening of May 28, 1957 to discuss the paving of North Rouse Avenue. Meeting of Municipal League The Montana Municipal League will meet in Sidney June 20th through 22nd, 1957. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Commission~ City Manager, City Attorney and Clerk of Commission or alternates be authorized to attend this meeting and their expenses be paid from the General Fund, am the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson~ Commissioner Erwin and Commissioner Lowe; those voting No~ none. Purchase of Copper Pipe Wm. Border, WaterSuperintendent~ has informed the City Manager that copper pipe will 800n be needed for his department to make water connections. It was moved by Commissioner Erwin, seconded by Commissioner Lowe~ that the Ci~ Manager be authorized to purchase 2040 feet of copper pipe. and the motion carried by the following Aye and No votea those voting ~e being Mayor Swanson~ Commissioner Erwin and Commissioner Lowe; those voting No. none. Resolution No. 840 -- Abandoning Parking Maintenance District No. 52 This was the time and plaoe set for hearing protests to the abandoning of Parking Maintenance Distriot No. 52 on West Baboook Street. Affidavit of publication of notice was presented. There being no protests filed and no one present to protest, Resolution No. 840 abandoning District No. 52 was presented~ entitleda A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ABANDONING CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 52 AND ABANDONING THE MAINTENANCE OF STREET PARK- rnGS THEREUNDER, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED~ AND PURSUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 835 AS PASSED AND ADOPl'ED BY SAID CITY COMMISSION ON THE 1st DAY OF MAY, A. D. 1957. It was moved by Commissioner Lowe, seconded by Commissioner Erwin~ that the resolution be passed and adopted~ and the motion carried by the following Aye and No votea those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No~ none. Platting West of City by Marguerite Kirk Hal Bolinger appeared before the Commission to present a sketch of proposed platting for property of Marguerite Kirk lying south of Highway 191 and one-half mile west of the city limits. The Commission instruoted that the sketch be referred to the Municipal Plan Board for their consideration and recom- mendations. Adjournment There being no further business to oome before the Commission at this time, it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjourn~ and the motion was carried by the following Aye and No votea those voting Aye being Mayor Swanson~ Commissioner Erwin and Commissioner Lowe; those voting No, none.
