HomeMy WebLinkAbout1957-05-29 272 Bozeman, Montana May 29, 1957 The Commission of the City of Bozeman met in regular session in the Commission Room~ City Hall Building, Wednesday~ May 29, 1957 at llOO o'clock P. M. Present were Mayor Swanson, Commissioner Erwin. Commissioner Lowe, City Manager Henderson~ Administrative Assistant Sales, City Attorney Lovelace and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the minutes be approved as read and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Swanson~ Commissioner Erwin and Commissioner Lowe} those voting No~ none. Bearing -- Intention to Create S. I. D. 390 1his was the time and place set for hearing protests on the creation of Special Improvement District No. 390, paving in Marwyn Addition. Affidavit of Publication of the Notice was presented together with the Clerk's Mailing Certificate that all property owners have been notified. There being no protests filed and no one present to protest~ the district was ordered to be created Resolution No. 842 -- Creating S. I. D. No. 390 The resolution creating Special Improvement District No. 390 was presented, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DIS- TRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 390 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON SOUTH CYPRESS AVENUE FROM EAST MAIN STREET TO EAST BABCOCK STREET, ON EAST BABCOCK STREET FOOM SOUTH CYPRESS AVENUE TO SOUTH AYLSWORTH AVENUE, ON SOUTH AYLSWORTH AVENUE FROM EAST BABCOCK STREET TO EAST CURTISS STREET, AND ON EAST CURTISS STREET FROM THE SOUmEAST CORNER OF BLOCK "D" OF MARWYN REARRANGEMENT TO THE NORTH-SOUTH CENTER LINE OF' BLOCKS "B" AND "C" OF MARWYN REARRANGEMENT, IN SAID CITY. It was moved by Commissioner Lowe~ seconded by Commissioner Erwin~ that the resolution be passed and adopted and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No~ none. Petition of Clyde Latta for Transfer to Police Reserve The following letter was presented and read; May 28, 1957 The Honourable City Commission Ci ty of Bozeman Bozeman~ Montana ReI Clyde M. Latta Gen tl emen I This will advise you that the undersigned Board of Police Commissioners of the City of Bozeman has denied the petition of the subject officer for retirement to the reserve list of the Police Department of the City of Bozeman. The undersigned Commission believes that the subjeot officer is presently capa- ble of performing most of the duties of a general offioer and we earnestly reco~ mend that the City Commission and Police Department make every endeavour to find some employment in the Police Department for the subject officer~ and that his employment, as a general police officer, be continued within the limits of his physical condition. Stephenson City Manager Henderson stated that, at the present time, there is no position in the Bozeman Police Department which can be properly filled by a person who is known to be physically unfit to carry out all normal duties of a regular police officer and that~ in his opinion, to create such a position would establish a precedent which could cause much difficulty and which would,be impossible to follow if two or more members of the police department or if one. or more members of the fire 1 I 1 ')~J'J 1-... / , department should beoome disabled and seek a position limited in its requirements to fit the applicants physical dlsabili ty. The case was reviewed at length. Officer Latta is now in the status of being on Leave of Absence without pay. It was the expressed desire of the Commission that Officer Latta's rights and interest be protected to the fullest possible extent and that he be given every consideration that the law will permit. 1 It was moved by Commissioner Lowe~ seconded by Commissioner Erwin~ that Officer Clyde Latta be continued on a status of Leave of Absenoe without pay from his position as a regular Member of the Bozeman Police Department for an indefinite period so that, at any time when his physical condition will permit, he can be re-instated to actiTe duty in such position without loss of retirement benefits, seniority or any other rights or benefits which accrued to him in his employment as a regular member of the Bozeman Police Department up to January 26, 1957 which was the effective date when he entered on his present status of being on Leave of .Absence without pay but that no such retirement benefits, seniority, or other rights or benefits shall aocrue to him as long as he remains on Leave of Absence and the motion oarried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Recreation Direotor White to Alpine, Idaho Recreation Director A. Glen White has been invited to partioipate in 4.H Camp Clinic at Alpine~ Idaho from June 6th to 8th~ 1957, his expenses occuring from attending to be paid by the Clinic. It was moved by Commissioner Erwin~ seconded by Commissioner Lowe~ that A. Glen White be authorized to attend this camp clinic at no expense to the City and the motion carried by the following ~e and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting I No, none. Agreement -- Rental of Esgar Lot Agreement was presented to rent the east 62 feet of the Esgar property at Mendenhall and Tracy to the City for use as parking lot for term of 5-years beginning June 1, 1957, at $50.00 per month. It was moved by Commissioner Lowe. seconded by Commissioner Erwin~ that the Mayor and Clerk of Commission be authorized to sign the agreement for the City of Bozeman, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No~ none. Purchase of Parking Meters for Lots Possibility of metering a parking lot at Traoy and Babcock, known as the Masonic Lot~ and one on Mendenhall just east from Tracy Avenue, known as the Esgar Lot, has been discussed at a previous Commission meeting. It was moved by Commissioner Erwin, seconded by Commissioner Lowe~ that the report be accepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor SWanson~ Commissioner Erwin and Commissioner Lowe; those voting No~ none.
