M. Present were Mayor Swanson~ Commissioner Erwin, Commissioner Lowe, City Manager Henderson, Administrative Assistant Sales, City Attorney Lovelace and the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissio~er Lowe; those voting No, none. Minutes of the special session of the City Commission held on Monday. June 17, 1957, were read and it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Purchase of Fire Hose Fire Chief McCrosson recommends the purchase of 500 feet of fire hose for his department at a cost of $1.71 per foot. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Manager be authorized to purchase 500 feet of fire hose to cost approximately $855.00, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Public Hearing -- S. I. D. No. 391 This was the time and place set for public hearing on the creation of Special Improvement District No. 391, paving on Hayes Street between Willson and Sixth Avenue. Protests representing 3.69% of the property in the district were presented together with the affidavit of publication of the Notice and the Clerk's Mailing Certificate that all property owners have been notified. It was moved by Commissioner Erwin, seconded by Commissioner Lowe~ that the protests be overruled as insufficient, and the City Attorney be instructed to prepare the resolution to create the district, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Public Hearing S. I. D. No. 392 This was the time and place set for public hearing on the creation of Special Improvement District No. 392, storm sewer installation to serve the property west of Eighth Avenue and Main Street. The affidavit of publication of the Notice and the Clerk's Mailing Certificate were presented. Protests representing 22.26% of the property in the district were presented. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the protests be overruled as insufficient and the City Attorney be instructed to prepare the resolution to create the district, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson~ Commissioner E~in and Commissioner Lowe; those voting No, none. Public Hearing -- S. I. D. No. 393 This was the time and place set for public hearing on the creation of Special Improvement District No. 393, installation of pavine; west of' Eighth Avenue and south of Koch Street. The affidavit of publication of the Notice to property owners and the Clerk's Mailing Certificate that all property owners have been notified were presented. Protests ref'resenting 32.51% of the f'roperty in the district were presented. It was moved by Com.'llissioner Erwin, seconded by Commissioner Lowe~ that the protests be overruled as insufficient, and the City Attorney be instruoted to prepare the resolution creatine; the district and the motion was carried by the following Aye and No vote. - those voting Aye being Mayor Swenson, Commissioner Erwin and Commissioner Lowe; thooe voting No~ none. 1 1 1 ')() C) I../Jd Petition -- Request for Paving Fourth Avenue - Garfield to Grant A petition of property owners requesting the paving of Fourth Avenue from Garfield to Grant Street was presented. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Engineer be instructed to prepare the necessary data for the City Attorney to prepare the resolution of intention to create the district, and the motion was carried by the following Aye and 1 No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Petition -- Request for Paving Grant Street from Willson to Sixth Avenue A petition of property owners requesting the paving of Grant Street from Willson Avenue to Sixth Avenue was presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Engineer prepare the necessary data for the City Attorney to prepare the resolution of intention to create the district, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Proposed Right-of-way Easements between City & Murray Nash It was reported that Mr. Murray Nash has requested a sixty-foot right-of-way easement along the north side and the east side of the present south reservoir site in exchange for right-or-way across his proper~ for the new water line and no payment for crop damage if the water line is installed after harvest time this fall. It was moved by Commissioner Lowe~ seconded by Commissioner Erwin, that the proposal be approved, and the Mayor be authorized to sign a letter to Murray Nash stating such approval, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and 1 Commissioner Lowe; those voting No, none. Agreement -- Plan Preparation for Street Improvement kn agreement from the Housing &: Home F'inance Agency for furnishing an advance of $9,000.00 for preliminary plans for street improvements and storm sewer facilities was presented. It was moved by It was pointed out that with the establishment of the special improvement districts for street Commissioner Erwin, seconded by Commissioner Lowe, that the Mayor and the Clerk of the Commission be authorized to sign the agreement for the City of Bozeman~ and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No~ none. Mayor to Apply for Additional Funds for Street Improvement Planning improvement that are now contemplated together with those that are proposed that additional funds for planning the improvements are needed. It was moved by Commissioner Lowe~ seconded by Commissioner Erwin. that the Mayor be authorized to submit an application to the Federal Housing and Home Finance Agency for $56,000.00 to prepare detailed plans and specifications for street improvements, and the motion carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No~ none. 1 Water Improvement -- Rental of Car for Engineer's Crew Proposal from the Northern Auto Company to rent a station wagon at the rate of $l50.00 per month which rental can be applied on the purchase price at any time was considered. The station wagon is to be used by the engineering crew in connection with the water system improvement project. It was moved by Commissioner Lowe~ seconded by Commissioner Erwin, that the City Manager be authorized to rent a Chevrolet from the Northern Auto Company on this basis and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Claim for Water Department for Gas & Oil 2' Q1 ...()L=l Claim No. 8483 in the amount of $370.97 against the various oity departments for gas and oil used and paid for by the City Water Department was presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the claim be approved and warrant drawn for its payment and the motion wes carried by the following Aye and No vote: those voting Aye being Mayor S~nson. Commissioner E~in and Commissioner Lowe; those voting No, none. ~ater System Improvement -- Morrison-Maierle, Inc. to Supervise Construction The matter of the engineering supervision of the oonstruction of the water system improvement 1 project was considered. It was moved by Commissioner Lowe~ seconded by Commissioner Erwin, that Morrison-Maierle~ Inc. continue as Supervising Engineers in the construction phase of the water improvement project, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swensonl Commissioner Erwin and Commissioner Lowe; those voting No, none.
