The Commission of the City of Bozeman met in regular session in the Commission Room~ City Hall
Building, Wednesday, June 26, 1957 at 1;00 o'clock P. M. Present were Mayor Swanson, Commissioner
Erwin, Commissioner Lowe, Administrative Assistant Sales, City Attorney Lovelace and the Clerk. The
following proceedings were had;

Minutes of the last regular session were read and it was moved by Commissioner Erwin, seconded by
Commissioner Lowe~ that the minutes be approved as read and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those
voting No, none.
Water Improvement Project -- Payment for Easement and Damages
Wal ter Kraft, E. L. Clark and Jack Nash representing a grout: of property owners south of' the City
over whose ground the new water line will pass appeared before the Commission to discuss payments for
easement and damages to crops and/or property. They contended that an amount should be set for damages
before the easements were signed, and stated the following payments for damages have been proposed by
owners whom they represent;
$6.00 per rod for damages ~lus $100.00 fer aore for grain, $lOO.OO fer acre for irrigated
pasture, and $50.00 per acre for field of hay, if entered before September 15th, these
payments to be made in addition to the payment for easement.
The proposal was taken under advisement and it was deoided to set up a schedule for prepayment of
damages for grazing land, oultivated non-irrigated land and cultivated irrigated land, and submit
this sohedule to the above-named committee for their consideration.
Hearing - Abandoning Parking Maintenance District No. 256

lbis was the time and place set for the hearing of protests to the abandoning of parking
maintenance Distriot No. 256. The affidavit of publication of the Notioe was presented. It was
stated there were no protests filed and no one was present to protest. The parking maintenance district
was ordered abandoned.
Resolution No. 849 -- Abandoning Parking Maintenance District No. 256
Resolution No. 849, abandoning parking maintenance Distriot No. 256. care of the parking on Sixth
Avenue from Cleveland Street to 28 feet south of Garfield Street, was presented, entitled;

AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 843 AS PASSED AND ADOPI'ED BY SAID CITY
COMMISSION ON THE 12th DAY OF JUNE, A. D. 1957.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the resolution be passed
and adopted and the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
License for Carnival -- Sponsored by V. F. W.
It was reported that a carnival is to show at the Fairgrounds~ June 26th through 29th, under the
sponsorship of the looal V. F. W. Post No. 903. It was moved by Commissioner Erwin, seconded by

Commissioner Lowe, that a license in the amount of $100.00 per day be set as the lioense fee for this
carnival, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.

The report of the Director of Finance for the month of May~ 1957 was presented. It was moved by
Commissioner Erwin, seconded by Commissioner Lowe, that the report be accepted and ordered filed, and
the motion was carried by the following Aye and No vote; those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Lowe; those voting No, none.

Street Light -- Black & Aspen
Request has been made for a street light at the intersection of Black and Aspen Street. It was
moved by Commissioner Lowe~ seconded by Commissioner Erwin~ that the City Manager be authorized to have
the Montana Power Company install a ligh t at th is intersection, and the motion was ca rried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Corrunissioner Erwin and Commissioner
Lowe; those voting No, none.
The Commission proceeded to check Custodian's Receipts for Depository Bonds held by the Director

Examination of Depository Bonds
of Finance as security for city funds deposited in the various city banks. It was moved by Commissioner
Erwin~ seconded by Commissioner Lowe, that the depository bonds being sufficient to cover the deposits
and that they be accepted and approved, and the list set forth in full in the minutes, and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin
and Commissioner Lowe; those voting No, none.

Petition for Paving Arthur Street
A petition signed by owners of 52% of the property, requesting that Arthur Street be paved from

Willson Avenue to Grand Avenue, was presented. It waS moved by Commissioner Lowe, seconded by
Commissioner Erwin, that the City Engineer prepare the necessary data for the City Attorney to prepare
a resolution of jntention to create the district and the motion was carried by the following Aye and

Grant for Planning Funds AI--proved
It was reported the t the City's request for a Federal Grant for Planning funds has been approved in
the amount of $7,350.00.
Proceeds from Water Improvement Bonds to Pay Registered Warrants First
D. R. Green, of the First National Bank, has requested that a resolution be approved by the Ci~
Commission stating that any city warrants issued for payment of construction on the water improvement
project that have to be registered, will be paid first from the proceeds of the sale of the Water
Improvement Bonds.

It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Attorney be
instructed to prepare such a resolution, and the motion was carried by the following Aye and No votel
those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those votin~ No, none.
Proposal for Engineering Work on Street Improvements
Proposals to handle the engineering work for the various street improvement projects now being
established in the City by the firms of Morrison-Maierle, Inc., Helena, and Harold Hoskins and
Associated Engineers~ Lincoln, Nebraska, were discussed. No action was taken pending further study
of the proposals.
Water Improvement Project -- Tyton Joint to be Used in Cast Iron Pipe
A communication from the Statewide Plumbing & Heating Co., Inc., contractors on the Water
Improvement Project, to Morrison-Maierle, Inc. was read stating that a discount of $2~l06.50 will be
allowed the City of Bozeman if they are permitted to use "Tyton Joints" in the cast iron pipe for the
distribution system instead of mechanical joints as specified. John Morrison recommended this type of
joint as being satisfactory. It was moved by Commissioner Lowe~ seconded by Commissioner Erwin, that,
upon the recommendations of John Morrison of Morrison-Maierle, Inc., a work order be issued to change
the specifications from mechanical joint to ItTytonlt joint on cast iron pipe used in the distribution

system, and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Resolution No. 844 -- Creating S. I. D. No. 39l
The City Attorney, as instructed~ has prepared the resolution creating Special Improvement
District No. 39l, paving of Hayes Street from Willson Avenue to Sixth Avenue. Resolution No. 844 was
presented entitled:

The City Attorney~ as instructed, has prepared the resolution creating Special Improvement
District No. 392, storm sewer installation in the west part of the City. Resolution No. 845 was
