Present were Mayor Swanson, Commissioner Erwin, Commissioner Lowe, City Manager Henderson. Administrative Assistant Walter Salesl City Attorney Lovela.ce, and the Clerk, when the following proceedings were had: I Minutes of the last regular se8sion were read, and it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that these minutes be a.pproved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swansonl Commissioner Erwin, Commissioner Lowe; those voting No, none. License Fee for Carnival A written req~est from the Bozeman Junior Chamber of Commerce, who are sponsoring a carnival, the "Norton Rides" to show in Bozeman the week of July 16-21, 1956, was read in which they asked that a license for this carnival be granted at a fee of $100.00 per day. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, thatl upon filing of proper application and upon payment in advance of the fee at $100.00 per daYI this request be granted and the license issued and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting NOI none. Resolution No. 813 n Intention to Create S. 1. L. D. 387 The City Attorney has prepared the resolution of intention to create Special Improvement Lighting District No. 387, ornamental lights on Mendenhall Street from Church to Third Avenue. Resolution No. 813, was presented, entitled: I A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF' SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT, TO BE KNOWN AS SFECIAL IMPROVEMENT LIGHTING DISTRICT NO. 387 FOR THE PURPOSE OF OPERATING AND MAINTArn- ING A LIGHTING SYSTEM TO LIGHT MENDENHALL ST'REETFROM THE EAST LINE OF NORTH THIRD AVENUE ro THE WEST LINE OF NORTH CHURCH AVENUE, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CONFDRMITY WITH SECTIONS 11-2246 TO 11-2257 INCLUSIVE. OF THE REVISED CODES OF MONTANA, 1947. It was moved by Commiss ioner Erwin, seconded by Commiss ioner Lowe, the t the resolution be passed Sanitary Inspector Cashier Cemetery Board Director of Finance and adopted and August Istl 1956 be set as the date for hearing protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Reports The following reports for the month of June, 1956 were presented; It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the reports be accepted and ordered filed, and the motion was carried ~ the following Aye and No vote; those voting Aye being Mayor SWansonl Commissioner Erwin, Commissioner Lowe; those voting No, none. City Manager Henderson reported on information he received during his trip to Missoula to investigate ci ty affa irs. I Build ings 206- 214 North Seventh and 124 West Babcock Inquiry has been made about securing a permit to build an office or commercial type building at 206-214 No. Seventh Avenue and the plan of the proposed building shows a roof overhang of 10 feet at the front and 5 ft. at the rear of the building which would bring the roof line to the east and west property lines. The front or west roof overhang would serve as a marquee for the one-story building. It was moved by Commissioner Erwin, seconded by Commissioner Lowel that, conditioned on the roof overhang at the front of the building being of cantilever type of construction so that it would be entirely sup- ported by the building and on the roof at the rear of the building beinb so constructed that all roof IJi{i drainage would be discharged onto the owner's own property, granting a building permit for this proposed building be and is hereby authorized and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwinl Commissioner Lowe; those voting No, none. Request has been received for 8 permit to construct an outside stairway as entrance to an upstairs apartment at 124 West Babcock. This frame dwelUng is in Fire Zone No. 1 but the proposed stairway would not extend beyond the present east line of the existing building and would in no way add to exposure or hazards of other buildings. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the Building Inspector be and is hereby authorized to issue a permit for this proposed construction and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swenson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Recommendations of City Engineer Re Proposed Platting West of City Written reoommendations of City Engineer Waldorf on the proposed plan for development of the area west of the city, as presented on a map prepared by the Municipal Plan Board, were read and explained by Mr. Waldorf. It was directed that the tentative plan presented by the Municipal Plan Board to the City Commission on June 13, 1956 be returned to that Board with a request that they have City Engineer Waldorf meet with them at the earliest practicable date to discuss his recommendations and that his recommendations, together with those of officials of School District No.7 relative to possible future school locations, be given consideration in revising the tentative plan. Proposal of Standard Construction Co. to Sell Yards A written proposal 0 l' the Standard Construction Company to sell to the City all of Block 29 except Lots 11 and 12, and all of Block 30 of the Imes Addition, together with all buildings on cement founda- tion for a total of $35,000.00 was read. The matter was taken under advisement.
