M. Present were Mayor Swanson, Commissioner Erwin, Commissioner Lowe. City Manager Henderson, Administrative Assistant Walter Sales, City Attorney Lovelace, and the Clerk. when the following proceedings were had: I Minutes of the last regular session were read, and it wes moved by Commissioner Lowe, seconded by Commissioner Erwinl that these minutes be approved as readl and the motion was carried by the following ~e and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Public Hearing - S. I. L. D. No. 387 This was the time and place set for hearing protests to creating Special Improvement Lighting District No. 387 (ornamental lights on Mendenhall Street from Third Avenue to Church Avenue). The affidavit of publication of the Notice and the Clerk's Mailing Certificate that all property owners have been notified were presented. The written protests of thirty property owners or agents of property owners were presented, stating they were protesting because of the wooden poles to be used and they would favor creating a district using steel poles. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the protests be sustained, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swansonl Commissioner Erwin, Commissioner Lowe; those voting No, none. Request for Full-time Plumbing Inspector Representatives of four local plumbing shops were present to discuss inspection problems. They I contend thatl because of lack of adequate inspection, numerous evasions or violations of the City's plumbing code occur and they recommended that a trained and qualified plumber be employed as a plumbing inspector. It was explained to these men that the amount of inspection work to be done in a city of this size makes it impractical to hire a trained person as inspector in each field, such as plumbing, electric wiring, and so forth, and the City therefore hires one man to do all such inspec- tions. It was further eXplained that. under any and all conditions, the only way that proper installa- tions and proper inspection can be secured is by adequate cooperation between all parties concerned. The plumbing representatives present pledged their cooperation in reporting work to be inspected and any unsatisfactory installations which may come to their attention. Appl ication for Encroachment Permit An application from the Gallatin Co-operative Creamery for an encroachment permit to cut a 40-foot driveway on North Seventh Avenue between Juniper and Birch Street wes presented. It was moved by Commissioner Erwinl seconded by Commissioner Lowe, that the permit be approved and the Mayor and the Clerk of the Commission be authorized to sign the permit for the City of Bozeman, and the motion was carried by the following Aye and No vote. those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. I Reques t to Sign "Working Agreement" with Unions Ray Marks and Robert Rampy, representing the Laborers and Teamsters Unions, appeared b~fore the Commission to request that the City enter into a "Working Agreement" with their Unions as representing the employees of the City in its operating departments. They again proposed an increase of 251 per hour in the wage rate of employees working on an hourly basis. City Attorney Lovelace advised the Commission that. since Montana statutes make no provision for municipalities to enter into such agreements, it must, in his opinion. be inferred that they cannot legally enter them. The Commission explained that. because adequate reserves must be maintained in all funds to permit this City to continue on a cash basis and because the General and Street Fund levies must be set at the legal 17;] 17f\ maximum to meet the budget which has been tentatively adopted, it appears that the only way in which the requested increases in wages could be granted would be to curtail services now rendered by the City or reduce the number of employees. It was further explained that these problems apply not only to those employees of the City in its operating departments who are members of Unions but to all employees of the City. Marks and Rampy requested that the City Manager be authorized to discuss the matter in further detail with them to see if some wage increase can be worked out. No further action was taken in the matter by the Commission. Bonds - Moore, Morrison, and Henderson The following surety bonds for city officials were presented: M. E. Hendersonl City Manager, amount of Bond $20,000.00 H. Dean Moore, Cashier, amount of bond $15,000.00 Helen Morrison, Ass't CaShier, amount of Bond $10,000.00. The bonds were approved as to form by the City Attorney. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the bonds be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwinl Commissioner Lowe; those voting No, none. Proposed Plat - "Hillcrest" - Acreage Tracts on Sour Dough Road A proposed plat of 20.9 acres of land, owned by James Schweitering, situated along "Sour Dough" road approximately two miles south of the City, was presented. The plat shows that the area will be named, Hillcrest, and it will be divided into 18 tracts. Since the land is more than one-half mile from the City and the plat complies with all legal requirements, it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the Director of Public Service be authorized to approve the plat, subject to concurrent approval by the County Commissions of Gallatin County, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwinl Commissioner Lowe; those voting No, none. Purchase of Copper Fipe The Water Department is in need of 3/4" copper pipe for normal installations of new and renewal water services. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Manager be authorized to purchase approximately 2000 feet of this copper pipe and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwinl Commissioner Lowe; those voting No, none. Reports The following reports for the month of July, 1956 were presented: Water Collector Folice Judge Sewage Plant Operator Building, Plumbing & Electrical Inspector It was moved by Commissioner Lowel seconded by Commissioner Erwin, that the reports be accepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowej those voting No, none. Adjustment on New Water Service at Fair Grounds A new water service, recently installed at Gallatin County Fair Grounds by the City, was estimated to cost $340.00. Actual cost of the service, including $65.82 for overhead, was $410.78. Request has been received for an adjustment on this bill in accordance with original estimate. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the bill to Gallatin County for this installation be reduced $60.78 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lo~ej those voting No, none. I I I Payment for Musical Recreation Program The matter of the City of Bozeman participating in the cost of operation of the Bozeman Summer Music School was discussed. On the basis that this activity is actually and rightf~lly a part of the City's recreation programl request has been received from the Summer Music School for such support. It was moved by Commissioner Erwin, seconded by Commissioner Lowe. that the City Manager be I authorized to pay an amount, not to exceed $600.00, toward operational cost of the Bozeman Summer Music School and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin. Commissioner Lowe; those voting No. none. Use of Band Stand for Summer Music Program A request from the Summer Music School to use the Band Stand on Tuesday, August 7th, 1956, a regular night for band concerts, for their "Grand Finale" was read. The schedule of weekly band concerts would be extended one week into September to compensate for the concert which would normally be held on August 7th, It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Proposed New Water Rates Proposed schedules of new water rates to provide income required to carry out the water works expansion and improvement program authorized by the voters on May 29. 1956, were presented and explained by Oscar Cutting, employee of the City. and who had prepared the schedules. 1he Manager I was instructed to contact Mr. Stanton Aby. Fiscal Agent, regarding these proposed rates preparatory to having a hearing before the Public Service Commission. Zoning Ordinance Amendment 1he City Attorney as instructed has prepared an ordinance amending the Zoning Ordinance. Ordinance No. 792 was presented, entitled: AN ORDINANCE AMENDING SECTION IV OF ORDINANCE NUMBER 776 OF' THE CITY OF' BOZEMAN, THE SHORT TITLE OF WHICH IS "THE ZONING ORDINANCE," SO AS TO INCLUDE THEREIN A DEFINITION OF "GASOLINE AND OIL STATIONS"; AMENDING SECTION VIII OF SAID ORDINANCE NUMBER 776 SO AS TO CREATE .AND DEFINE THE BOUNDARIES OF PART III OF THE "A" RESIDENCE DISTRICT; AMENDING SECTION IX OF SAID ORDINANCE NUMBER 776 SO AS TO ALTER THE BOUNDARIES OF PART IV AND SO AS TO CREATE AND DEFINE THE BOUNDARIES OF PART V OF THE "B" RESIDENCE DISTRICT; AMENDING SECTION X OF SAID ORDINANCE NUMBER 776 SO AS TO ALTER THE BOUNDARIES OF PART I OF THE "C. RESIDENCE DISTRICT; AMENDING SECTION XII OF SAID ORDINANCE NUMBER 776 SO AS TO CREATE AND DEFINE THE BOUNDARIES OF PART IV OF THE BUSINESS DISTRICT, AMENDING SECTION XIV OF SAID ORDINANCE NUMBER 776 SO AS TO ALTER THE BOUNDARIES OF' PART I AND SO AS TO CREATE AND DEFINE THE BOUNDARIES OF PART II OF THE INDUSTRIAL DISTRICT, SAID PART I TO BE KNOWN AND DESIGNATED AS "HEAVY INDUSTRIAL" AND SAID PART II TO BE KNOWN AND DESIGNATED AS "LIGHT INDUSTRIAL"; AMENDING SECTION XV, SUBSECTION G., OF SAID ORDINANCE NUMBER 776 SO AS TO MORE "FULLY SPECIFY THE USES PERMITTED IN THE INDUSTRIAL DISTRICT: AND AMENDING SECTION V OF SAID ORDINANCE NUMBER 776 SO AS TO CORRECTLY LIST THE USE DISTRICTS AND THE PARTS THEREOF. It was moved by Commissioner Erwin. seconded by Commissioner Lowe, that the ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwinl Commissioner Lowe; those voting NOI none. I .Agreement for Orening Alley in Block C Origina.l Townsite A proposed agreement was presented whereby owners of property in Block C, Original Townsite, will deed certain ground in this block for use as an alley and will pay specified sums for acquiring an old building which now stands as an obstacle which must be removed in order to open the proposed alley and the City would remove the building in question, and build a bridge crossing Bozeman Creek as required to open the alley. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Manager be authorized to solicit the owners of property in this block for their contribution for this improvement 175 176 with assurance that the City will carry out its part of the proposed agreement and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
