HomeMy WebLinkAbout1956-10-22 18/\ Bozeman, Montana August 22, 1956 The Commission of the City of Bozeman met in regular session Wednesday, August 22, 1956 at 1:00 o'clock P. M. in the Commission Room, City Hall Building. Present were Mayor Swanson, Commissioner Erwin, Commissioner Lowe, City Manager Henderson, Administrative .Assistant Sales, City Attorney Lovelace, and the Clerk of the Commission. Minutes of the last regular session, and minutes of the special meeting of August 16, 1956, were I read, and it was moved by Commissioner Erwin, seccmded by Commissioner Lowe, that they be approved as readl and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Request to LeB_se Water-Shed Ground for Pasture - Wm. l\j. Huffine Wm. N. Huffine appeared before the Commission proposing to lease ground in the Lyman Creek water- shed from the City for use as cattle pasture. It being the opinion of the Commission tha.t similar requests will henceforth be made seeking entrance and use of both the Lyman Creek and Bozeman Creek water-sheds and, believing a definite policy should be established, it was moved by Commissioner Lowe, sec::mded by Commissioner Erwin, that the City Manager be instructed to propose a plan or method for opening the north and south water-sheds, and to contact the State Board of Health to see what additional requirements or restrictions, if any, would be imposed on the City by said Board if the water-sheds were opened, and the motion was carried by the following .Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Corrunissioner Lowe; those voting No, none. Mr. Huffine was told that if future established policy would allow water-shed acreage to be used as pasture, he would be so infonned. Proposed Street Numbering and Street Names on MSC Camrus I Martin Whalen, Superintendent of Physical Plant, Montana State College, appeared before the COlTh'TIission, with a map showing proposed street numbering and street names for the newly constructed College housing on Montana State College Campus areas outside of but adjoining the city limits, asking for suggestions or approval of the Commission. The City Commission requested that these details be worked out wi th the City Manager. Resolution No. 815 - Intention to Create S. 1. L. D. 368 The City Attorney, as requested, has prepared the resolution of intention to create Spectal Improvement Lighting District No. 388, ornamental lights on Mendenhall Street from Church to Third Ave. Resolution No. 815 was presented, entitled: A RESOL1JTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTEN- TION OF SAID COMMISSION TO CREATE A SPECIAL I!V,fROVEMENT DISTRICT, TO EE KNOWN AS SPECIAL IMPROVEl\ilENT LIGHTING DISTRICT NO. 388 FOR THE PURPOSE OF OPERATING AND y,AINTAINING A LIGHTING SYSTEM TO LIGHT MENDENHALL STREET FROM THE EAST LINE OF NORTE THIRD AVENUE TO THE WEST LINE OF NORTH CHURCH AVENUE, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER TEE AUTHORITY OF AND IN CONFORMITY WITH SECTIONS 11-2245 TO 11-2257 INCLUSIVE, OF THE REVISED CODES OF' MONTANA, 1947. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the resolution be passed and adopted, and September 12th, 1956 be set as the date for hearing f,rotests and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner I Lowe; those voting No, none. Bond & Contract - Misc. W & C 1956 111e uontract and copy of the bond of \'I. D. Howells for the construction of Misc. W & C for 1956 jr accordance with his bid accerted on August 15, 1956, WRS presented. The bond end contract were app'oved as +,(; form bit, the City Attorney and it was moved by Commissioner Lowe, seconded by Commissioner Erwin, the. t the bond and contract be apI,roved and accepted, subject to the bond having the required signature of the surety, and the Mayor and the Clerk of the COllrrnission be authorized to sign the con- tract for the City of Bozeman, and the motiore was carried l,y the following AJ'e and No vote: those votinG Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting; No, none. Resolution No. 816 - Calling Special Election for General and Street }~nd Levies Pursuant to the agreement made at the special meeting of the City Commission held on August 16, 1956, between the City Commission and representatives of City Emrloyees involved in recent wage disputes, the City Attorney has prepared a resolution calling a special election to be held on October 2, 1956 to vote on whether or r:ot to increase General and Street Fund levies in excess of the legal I 11mi t for the purpose of granting wage and salary increases to emrloyees. Resolution No. 816 was presented, entitled: A RESOLU'rION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CALLING A SPECIAL ELECTION TO VOTE UFON ADDITIONAL TAX LEVIES IN THE GENERAL 'FUND AND STREET FUND OF SAID CITY OF BOZEMAN IN EXCESS OF THE LEVIES IN SAID FUNDS NOW ALLOWED BY LAW FOR THE PURPOSE OF' PAYING ADDITIONAL WAGES OR SALARIES TO THOSE REGULAR EMFLOYEES OF THE SAID CITY OF BOZEMAN WHOSE WAGES OR SALARIES ARE PAID FROM THE GENERAL FllND AND STREET FUND. Rer-orts The rerort of the Director of Fjnance for July, 1956 was presented. It waS moved by Commissioner Erwin, seconded by Commissioner Lowe, that the report be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swansorl, Commissioner Erwin, Commissioner Lowe; those voting No, none. Blanket Insurance Policy for City Employees 1956-57 The second annual premium being due August 30, 1956 on the blanket liability 5nsurance policy carried by the City in the General Casualty & Insurance Company, it was moved by Commissioner Erwin, I seconded by Commissioner Lowe, that the policy be continued and the motioll was carried by the followh;e; A-jTe and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Bids for Three-Wheeled Cycle Police Chief, Al Haas, has reconunended that the Police Department's three-wheeled motorcycle be replllilced with a new one. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the Clerk of the Commission be authorized to advertise for bids on a vehicle to meet that recommendation and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Rental - Barber-Green Di tcher Naranche & Konda, contractors who are building U. S. Highway #191 extending west from 11th Avenue in Main Street in Bozeman, have reques ted that they be permitted to rent the Barber-Green Ditch ing Machine owned by the City of Bozeman. Since the work they propose to do with this mRchine is on public property ~md the rental of the machine will in no way interfere with private enterprise, the City Manager was authorized to rent this machine to them on a temporary basis. I Offer to Sell to City of Bozeman Property at Grand Avenue and Tamarack Street City Manager Henderson reported that Edwin Stephenson, Chairman of the Gr.llatin County High School Board, has made inquiry as to whether or not the City of Bozeman will be interested in purchasing the Gallatin County High School F'oot-Ball Practice Field situated between Grand Avenue and Tracy Avenue and abutting Tamarack Street. No selling price has been suggested. It was not considered that this location would be suitable to provide a proper distribution of park areas in the city. The City Maneger was instructed to inform Mr. Stephenson that the City does not have interest in the property at this time but wished to be infonned of a proposed selling price if and when a price may be set on the prorer-Ly. Profosal to Sell to City of Bozeman Property a t Corner of Mendenblll and Rouse Avenue 185 186 Mrs. Venus Seel, owner of property at the corner of Mendenhall Street and Rouse Avenue, has requested that the City of Bozeman make her an offer for the purchase of this property. The property in question was, for many years, the location of the Gallatin County scales and was pur- chssed from Gallatin County by Mrs. Seel during the past year. The Manager was instructed to inform Mrs. See 1 th&t the City does not desire to make an offer on this property at the present time but that, if she offers it for sale at a reasonable figure, the City might be interested.
