The Commission of the City of Bozeman met in regular session Wednesday, August 29, 1956 at 1:00
o'clock P. M. in the Commission Room, City Hall Building. Present were Mayor Swanson, Commissioner
Erwin, Commissioner Lowe, City Manager Henderson, Administrative Assistant Sales and the Clerk of the
Commission.

Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded by
Commissioner Erwin, that they be approved as readl and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting
NOI none.
Inquiry - C. M. St. F. & P. R. R. - Moving Tracks Rouse to Church Avenue
A letter was read fromR. W. Middleton, Division Engineer, C. M. St. P. & P. R. R., in which
inquiry is made as to the City's reaction toward his company moving their tracks from 'l'amarack Street
and Rouse Avenue onto that portion of Church Avenue extending north from Tamarack Street thence
diagonally across Block 114 of Northern Pacific Addition as a new location for their tracks serving
the Bozeman Canning Company and Montana Flour Milling Company Cereal MilL The letter having been
addressed to City Engineer Waldorf, it was moved by Commissioner Erwin, seconded by Commissioner Lowe,
that the City Engineer reply to it and state the City's approval of such a relocation of tracks and
assure the full cooperation of the City of Bozeman in affecting such a relocation, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin,
Commissioner Lowe; those voting No, none.
Resolution Assuming Maintenance of North Rouse Avenue

.A resolution in fErvor of the State of Montana and Bureau of Public Roads was presented as follows:
RESOLDT ION
WHEREAS, the State Highway Commission of Montana has designated as secondary or feeder highway
the Federal Aid Secondary Road in Gallatin County within the City of Bozeman, approximately 0.8 mile,
more or less, in length, and known as Federal Aid Secondary Route 293 and further designated as
Federal Aid Secondary Project S 370(8), Rouse Avenue.
WHEREAS, the State Highway Commission, in conjunction with the Bureau of Public Roads, has
programmed and will in the future program for construction certain section of the above-designated
highway wi th State and/or Federal funds.
NOW. THEREFORE, BE IT RESOLVED BY the City of Bozeman, Montana, acting through its duly quali-
fied City Commission:
1. That the City of Bozeman, under the provisions of Section 1788, Revised Codes of Montana,
1935, hereby concurs in the designation of the above-designated highway as a secondary or feeder
highway and
2. That the City of Bozeman, in consideration of the construction of Sections of the above-
designated highway by the State Highway Commission and/or the Bureau of Public Roads, hereby agrees
to maintain said-constructed sections in an adequate manner and to the satisfaction of the State
Highway Commission and the Bureau of Public Roads upon official notification by the State Highway
Commission of the effective date that the city's responsibility begins, and
3. If during the construction of any sections of the above-designated Federal-aid highway
should the State Highway Commission and/or the Bureau of Public Roads, on account of unfavorable
weather or other conditions not the fault of the contractor, authorize a suspens:l.on of construction
operations thereafter and until the State Highway Commission and/or the Bureau of Public Roads
issue an order for the resumption of construction operations, the maintenance of the sections under
construction shall be 'by and at the expense of the city.

4. That the City of Bozeman further agrees that if for any reason it is unable to maintain said-
constructed sections of the above-designated highway to 8. standard satisfactory to the BUreau of
Public Roads and to the State Highway Commission, the said State Highway Commission is thereupon
authorized to perform the necessary work to p~ce the highway in a satisfactory condition by such
means as may be at the disposal of the said State Highway Commission, and the State will be reimbursed
by the city for any expense it may inour in the perfonnance thereof on the basis of cost plus ten
per cent.
The above resolution was duly considered and adopted at a lawful meeting of the City Commission
held this 29th day of August, 1956.

It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the Resolution be
adopted and the Mayor and Clerk of Commission be authorized to sign the same and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin,
Commissioner Lowe; those voting No, none.
Road to Mystic Lake
J. C. Urquhart, Forest Service Supervisor, H. F. Johnson, Forest Service Engineer, and H. D.
Halpin, District Ranger, were present to discuss problems pertaining to the City of Bozeman building
a road to the Mystic Lake Dam site. Mr. Urquhart stated that the road should be located on a
permanent basis and, to insure its proper placement, Forest Service engineers would stake out the
road site. It was estimated that this survey would require not less than two weeks work of a survey
crew and the estimated cost of such a crew would not exceed $225.00 per week. Mr. Urquhart proposed
thatl if the City of Bozeman would pay for the actual cost of the survey crew for up to two weeks work,
the U. S. Forest Service would pay for any and all cost of the survey over and above that. This
proposal was acceptable to all parties present. A portion of the land to be crossed is privately
owned and it was moved by Commissioner Erwin. seconded by Commissioner Lowel that the City Manager be
authorized to negotiate for right-of-way for this road where it crosses privately owned landsl and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Erwin, Commissioner Lowe; those voting No, none.
Survey work is to begin immediately and the City Manager will confer with interested lumber
companies on an agreement as to the actual construction of the roed in return for City owned timber.
Vacation Policy Amended
Present vacation policy, set March 30th, 1949. to define what constitutes a "regular employee".
allows City Employees to take accrued vacation at the end of six months service. Chapter 152, Session
Laws of 1951, State of Montana, provides that "an employee who has been in continuous employment for
one year is entitled to and shall be granted annual vacation leave with full pay. ." To make the
policy of this City conform to Montana statutes, it was moved by Commissioner Lowe, seconded by
Commissioner Erwin, that the City's vacation policy be amended, effective 1 November 1956, so that
employees of the City shall not be entitled to vacation benefits until the completion of one year of
service and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Erwin. Commissioner Lowe; those voting No. none.
Agreement - Bozeman Municipal Band
A proposed annual agreement between the City of Bozeman and the Bozeman Municipal Band was
presented. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the Mayor and
Clerk of the Commission be authorized to sign the agreement for the City of Bozeman subject to chang-
ing the phrasing in the agreement to show that all monies to be paid by the City to the Band for
concerts shall be paid in full by the Band, through its duly authorized officers, to the members of the
Band in accordance with the roster of Band members showing participation in each concert. and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin,
Commissioner Lowe; those voting No, none.
Rental - Concrete Saw to Bozeman Community Television.
Bozeman Community Television, Inc. by Norman Penwelll has informed the Commission that right-of-
way easement has been obtained for burial of their TV cable and requests that the City rent their
concrete saw to them for cutting pavement and that they be allowed to proceed with the burying of the
cable. It was moved by Commissioner Erwin, seconded by Commissioner Lowel that Bozeman Community
Television, Inc. be permitted to proceed with the burying of the TV cable, according to City Engineer's
specifications, and that the City rent their concrete saw to them for making pavement cuts and the motion

was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Erwin I Commissioner Lowe; those voting No, none.
Proposed Meeting - City Commission and Plan Board with Property Owners West of City
A proposed letter from the Municipal Plan Board to all owners of property between Huffine Lane
and Durston Road within one-half mile of the west City Limits, inviting them to attend a special
meeting of the Plan Board on Monday eveningl September 17, 1956 to discuss with the City Commission

and the Municipal Plan Board future planning for that area, was presented and approved.
Application to Public Service Commission - Increase in Water Rates
A proposed application, in draft form, from the City of Bozeman to the Public Service Commission
of the State of Montana, for authority to increase water rates in amounts required to finance the
water works expansion and improvement project authorized by the voters of this City on May 291 1956,
was presented and discussed.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe, thatl subject to its approval
as to form by the City Attorney, the Mayor and the Cle rk be and are hereby authorized to sign the
application for the City of Bozeman and that it be presented to the Public Service Commission with the
least practicable delay and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swansonl Commissioner Erwin, Commissioner Lowe; those voting No, none.
City Manager to Helena on City Business
The City Manager informed the Commission that it would be necessary for him to go to Helena to
see the Highway Engineer, State Board of Health and others on City business.
It was moved by Commissioner towel seconded by Commissioner Erwin, that the City Manager be

authorized to go to Helena on City business, and his expenses be paid from the General fundI and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Erwin, Commissioner Lowe; those voting No, none.
Proposal for Operation AnalYSis
H. C. Anderson, representing Geo. S. May Co., Business Engineering Firm, appeared before the
Commission to explain the operation of his company and proposed that the City of Bozeman hire them
to make a survey of operations and administration in the City of Bozeman. He was informed the City
Commission would take the proposal under advisement.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Commissioner Erwinl that the meeting adjourn and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin,
Commissioner Lowe; those voting No, none.
