M. in the Commis,sion Rooml City Hall Building. Present were Mayor Swanson, Commissioner Erwin, Commissioner Lowe, City Manager Henderson, Administrative Assistant Sales, City Attorney Lovelace and the Clerk of the Commission. Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that they be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor SWansonl Commissioner Erwin. Commissioner Lowe; those voting No, none. Claims Claims Nos. 6355 to 6377 inclusive were presented on the various funds as follows: General Street Water S. D. S. Revenue Library Park Cemetery Garbage Parking Meter $ 337.61 530.69 779.04 27.39 194.27 28.47 248.56 151.23 11.90 Total -- $2,309.16 The Manager stated he has audited these claims and finds them to be true and lawful claims against The City of Bozeman and recommends that warrants be issued for their payment. After examination of the claims in detail and checking with the Claim Register. it was moved by Commissioner Lowel seconded by Commissioner Erwin, that the claims be approved and warrants drawn for their payment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin. Commissioner Lowe; those voting NOI none. Appointment -- Dunahoo Assistant Water Superintendent The City Manager announced the appointment of Ralph E. Dunahoo, as Assistant Water Superintendent. Water Improvement Project -- Morrison-Maierle to Complete Second Phase A communication from Morrison-Maierle, Inc. was read stating that the second phase of the engineer- ing work (i.e., additional field investigation and surveys, right-of-way descriptions, final engineering designl preparation of construction drawings, specifications and other contract documents) for the construction of the proposed improvements to the Bozeman water system should be completed as the next step in this program. The communication requested their organization be authorized to do this workl and as provided in the original contract dated October 13, 1956. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the firm of Morrison-Maierle, Inc. be engaged to complete the second phase of the engineering work for the water system improvement programl and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Delegates to Traffic Safety Conference A state wide Traffic Safety Conference will be held in Helena, September 17, 1956. It was decided that the Mayor, members of the City Commission and the Chief of Police be authorized to attend this conference. Agreement -- u. S. Forest Service for Construction of Road to Mys tic Lake A proposed agreement between the U. S. Forest Service and the City of Bozeman for the construction of a "pioneer road" to Mystic Lake was presented and read. It was moved by Commissioner Lowel seconded by Commissioner Erwin, that the Mayor and the Clerk of the City Commission be authorized to sign the Agreement for the City of Bozeman, and the motion was carried by the following Aye and No I I ~ I vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, In:l none. A Special Use Permit from the U. S. Forest Service granting permission to the City of Bozeman to cross certain sections of land for the proposed right-of-way for the "pioneer road" was presented. Request for Water Meter to Serve Houses on East Main -- Mrs. Ray Cass A request from Mrs. Ray Cass, 1100 block East Main Street, to have a one-inch meter installed in I one house and have city water to serve five other houses owned by her and on the same property, was reported. After consideration by the City Commission, it was decided that each house should have a separate water meter. Engineering Assistance for Planning Funds for Street Improvements Mr. Wm. F. Wendland and W.F. Parker, of Harold Hoskins & Associates, Consulting Engineers, were present to offer their services to the City of Bozeman in the preparation of an application to the Federal Housing & Home Finance Agency for planning funds for street improvements. They stated they would assist the City Engineer in getting necessary data for the application without any obligation on the part of the City. This was agreeable to the Commission and the offer was accepted. Reports The following reports for the month of August, 1956 were presented: Cashier Cemetery Board It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the reports be accepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Resolution No. 817 -- Sprinkling Assessment I A, resolution levying the assessment for street sprinkling for the year 1956 in the amount of $1,350.00 was presented, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS- MENT OF TAXES UPON ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTR.ICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1956. It was moved by Commissioner Erwinl seconded by Commissioner Lowe, that the resolution be pro- visionally adopted, and September 19th, 1956 be set as the date for hearing protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Resolution No. 818 -- Lighting Assessment The resolution levying the assessment for the special lighting districts for the year 1956 in the amount of $1,820.48 was presented, entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR SPECIAL IMPROVEMENT LIGHT- ING DISTRICTS NUMBERS 361, 362, 284, 288, 290, 296 AND 300 OF THE CITY OF BOZEMAN, PURSUANT TO THE PROVISIONS OF SECTIONS 11-2252'R. C. M. 1947. It was moved by Commissioner Lowe, seconded by Commissioner E~in, that the resolution be pro- visionally adopted I and September 19th, 1956 be set as the date for the hearing of protests, and the I motion was carried by the following Aye and No votea those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Resolution No. 819 -- Parking Maintenance The Resolution levying the assessment for parking maintenance for the year 1956, in the amount of $6,121.02 was presentedl entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, LEVYING AND ASSESS ING A SPECIAL ASSESS- MENT OF TAXES UPON ALL THE PROPER-TY IN SPECIAL IMPROVEMENT DISTRICTS OF THE CITY OF BOZ~AN, COUNTY OF GALLATIN. STATE OF MONTANA, FOR THE MAINTENANCE OF PARKINGS TO DEFRAY THE COST OF MAINTAINING THEPARKINGS WITHIN SAID SPECIAL IMPROVEMENT DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1956. l~ll It was moved by Commissioner Erwin, seconded by Commisssioner Lowe, that the resolution be provisionally adopted, and September 19th, 1956 be set as the date for the hearing of protestsl and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Public Hearing -- S. I. L. D. 388 This was the time and place set for the hearing of protests to the creation of Special Improvement I Lighting District No. 388, (ornamental lights on Mendenhall Street from Church to Third Avenue). The affidavit of publication of the Notice and the Clerk's Mailing Certificate that all property owners have been notified were presented. There was no one present to protest and no protests having been filed, it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Attorney be instructed to prepare the resolution creating the district, and the motion waS carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting NOI none. Request to Defer Order to Construct Sidewalk 1956 -- Ed. Chauner A request from Ed Chauner, 422 South Twelfth, was read, asking that the order to construct sidewalk at his property on the corner of Twelfth and Story Street be deferred pending the construction, by early next spring, of another dwelling on the property. He stated there would be a sixteen-foot drive- way which would cross the sidewalkl to be constructed with reinforced concrete and the exact location of the driveway has not been determined at this time. It was moved by Commissioner Erwin, seconded by Commissioner Lowel that the request be referred to the City Engineer and his recommendations be accepted, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson I Commissioner Erwin, Commissioner Lowe; those voting No, none. I Confirmation of Robert K. Johnson -- Regular Policeman Robert K. Johnson has been employed as a policeman in the Police Department for six months. It was moved by Commissioner Lowel seconded by Commissioner Erwinl that he be confirmed as a regular policeman effective September 1, 1956, subject to the following conditions: 1. That legality of a waiver of the residential requirements for employment as a Police Officer, as required by Montana Law, must be established. 2. That, if a waiver of such residential requirements is determined to be illegal, he will be continued as a special Police Officer until the required residential requirements have been fulfilled, in which case, confirmation as a regular Police Officer will begin on that date. and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin. Commissioner Lowe; those voting No, none. City Manager to Negotiate with Idaho Pole Company for Mystic Lake Road The matter of the actual construction of a road to Mystic Lake was discussed, and the City Manager was authorized to negotiate with the Idaho Pole Company for the construction of this road, the final terms to be presented and approved by the City Commission. Adjournment There being no further business to come before the Commission at this time, it was moved by I Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
