The Commission of The City of Bozeman met in regular session in the Commission Room, City Hall Build-
ing, Wednesday, October 3rd, 1956, at ll00 o'clock P.M. Present were Mayor Swanson, Commissioner Erwin,
Commissioner Lowe, City Manager Henderson, Administrative Assistant Sales, City Attorney Lovelace, and
the Clerk. The ibllowing proceedings were had:
Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded by

Commissioner Lowe that the minutes be approved as read, and the motion was carried by the following Aye
and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those
voting No, none.
Recommendations of Morrison-Maierle -- Location of Water Main
John Morrison of Morrison-Maierle, Inc., appeared before the Commission to report his firms finding~
on possible locations for the transmission line of the new water system. Three possible locations had
been given consideration; (1) parallel to and approximately forty feet from the present, (2) in the
dght-of-way down Sourdough Road, and (3) farther east along the crest of the hill. Since there was
1 i ttle to be gained in pressure or distribution by the locations to the East, Mr. Morrison recommended
that the main be located parallel to the present line.
Objections to One-Way Streets
George Hoadley, owner of Haodley's Standard Service Station at 5 East Mendenhalll appeared before
the Commission to protest the proposal that Mendenhall and Babcock be made one-way streets. Claire Long,
Jr. was present to hear discussion on this proposal but expressed neither approval or disapproval. The
Commission informed them that the one-way streets would be put in on an experimental basis to see if it
would aid traffic and the streets would revert to two-way if the experiment proved unsuccessful. An
cost of $600.00 to convert Garfield and Cleveland Streets and about $1300.00 to convert Babcock and

estimate of cost to convert to one-way streets was presented by the City Manager showing an approximate
Mendenhall Streets. The Commission requested that a more exact cost break-down be presented.
ALL OF Main Street Designated as Arterial Street
Since the new entrance of Highway #191 onto Main Street has been completed, i.t was moved by Commis-
sioner Erwin, seconded by Commissioner Lowe, that all of Main Street, including that portion from Ninth
to Eleventh Avenues, be designated as an arterial street by order of the City Manager through publication
and placing of proper signs making it a part of Schedule VI, Section 167 of Ordinance No. 768, the Traffic
Ordinance of the City of Bozeman, and the motion was carried by the following Aye and No vote; those voting
Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Furchase of 3-Wheel Cycle for Folice Department
The City Manager informed the Conunission that Stan's Cycle Shop of Livingston has offered a Harley
Davidson Servi-car, 3-wheel cycle for use in the Police Department for $1,168.00 plus the trade-in of
the Department's old cycle. Since no bids were received when the City advertised for bids on a. machine
of this type and sinc~ this machine aFpears to best meet the requirements for the job, it was moved by
Commissioner Lowe, seconded by Commissioner Erwin that the City purchase the cycle at the quoted price,

and the motion was carried by' the following Aye and No vote; those voting Aye being Mayor Swanson, Com-
missioner Erwin and Conunissioner Lowe; those voting No, none.
Request to Defer Sidewalk Instal1s'tion Granted -- Editl; Oliver Estate
Request has been made that installation of sidewalk ordered in by the City Conunission on Lots 1 and
2, Block 21, Butte Addition be deferred pending settlement of the Edith Oliver estate. It was moved by
Commissioner Erwin, seconded by Conunissioner Lowe that the deferment be granted, and the mot ion was car-
ried by the following Aye and No vote; those voting Aye bejng Mayor Swenson, Conunissioner Erwin and Com-
missioner Lowe; those voting No, none.

The Manager stated he has audited these olaims and finds them to be true and lawful claims against the
City of Bozeman and recommends that warrants be drawn for their payment. After examination of the claims in
detail 1 and checking against the Claim Register, it was moved by Commissioner Lowe, seconded by Com. Erwin
that the claims be aFproved and warrants issued for their payemnt, and the motion was carried by the follow-
ing Aye and No votej those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowej those
voting No, none.

Resolution No. 822, Creating S.I.D. No. 385
The City AttorneYI as instructed, has prepared the resolution creating Special Improvement District
No. 3851 paving on South Black Avenue from Story to College. Resolution No. 822 was presenT-ed, entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATlNG A SPECIAL IMPROVEMENT
DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 385 OF THE CITY OF BOZEMAN FOR
THE PURPOSE OF' CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON SOUTH BLACK AVENUE FROM STORY
STREET TO COLLEGE STREET, IN SAID CITY
It was moved by Commissioner Lowe, seconded by Commissioner Erwin that the resolution be passed and
adoptedl and the motion was carried by the following Aye and No votej those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Lowej those voting No, none.
Resolution No. 823, Creating S. J.D. No. 386
The City Attorney, as instructed, has prepared the resolution creating Special Improvement District No.
386 (paving on South Willson Avenue from. Garfield to Grant Street. Resolution No. 823 was presented, entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT
DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 386 OF THE CITY OF BOZEMAN
FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON SOUTH WILLSON AVENUE
FROM GARFIELD STREET TO GRANT STREET IN SAID CITY.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe that the resolution be passed and
adopted and the motion was carried by the following Aye and No votej those voting Aye being Mayor Swanson,
Commissioner Lowe and Commissioner Erwinj those voting No, none.
A,n:;ointments -- Band Board
Recent agreement with the Municipal Band called for a Band Board to be created composed of two members
appointed by the City Commission, two appointed by the members of the Band, and a fifth chosen by these four.
Mayor Swanson announced the appointment of Frank A. Brown and William V. Ogle to this Band Board. It was
moved by Commissioner Erwin, seconded by Commissioner Lowe that the appointments be approved for a three-
year term, and the motion was carried by the following Aye and No votej those voting Aye being Mayor Swanson,
Commissioner Erwin, and Commissioner Lowej those voting No, none.

Canvass of Election Returns -- Special Mill Levy Election
The Clerk of theCity Commission presented affidavit of publications of Notice of Election ahd his
Certificate of posting of notices of the special election which was held October 2, 1956 pursuant to Com-
mission Resolution No. 816 which called this election for the purpose of voting on whether or not to in-
crease General and Street Fund levies in excess of the legal limit for the purpose of granting wage and
salary increases to city employees. He also presented the sealed returns of the Judges in each of the
voting precincts of the City which were then and there opened and canvassed by the City Commission.

Poll books showing the number and names of voters who voted in each precinct and the Tally books
showing the votes for and against were checked and found to be correct and to show the vote by precincts

Agreement for FublicWorks Plan Preparation for ~iater Improvements
Copies of agreement between the City of Bozeman and the Housing and Home Finance Agency for aid in

financing the cost of complete plan preparation for the City's Water System Improvement Project were
presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe that the agreement be
accepted and signed by the Mayor for the City of Bozeman and the Clerk of CommissLm as official custo-
dian of the records and proceedings of the City Commission, and the motion was carried by the following
Aye end No vote; those voting A.ye being Mayor Swanson, Commissioner Lowe and Commissioner Erwin; those
voting No, none.
Sale of Blacktop Material to Bozeman Community TV
Request has been made by the Bozeman CO~P.~UT":.ty TV to purchase balcktop material from the City to
fill pavement cuts recently made to lay cable undergr::)Und in certain street and alley crossings. It
WAS moved by Commissioner Lowe, seconded byCommissioner Erwin, that the request be granted, and the
motion was carried by the following Aye and No vote; those votjng Aye being Mayor Swanson, Commissioner
Ernin and Commissioner Lowe; those voting No, none.
Corrununic('\tion -- Commending Fire Department
A letter was read from R. Earl Dawes, agent for the Story Block, commending the men of the Fire
Department for quick and able handling of the recent fire at the Hub Store and expressed the gratitude
of the owners.

Opening of Eleventh Aver,ue -- Manager to Request Offer of Sale
The need for opening Eleventh Avenue from Main Street to Babcock Street is apparent and it was
moved by Commissioner Erwin, seconded by Commissioner Lowe that the City Manager make a written request
to the owners of the land involved for an offer of sale of' it, and the motion was carried by the
following Aye and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner
Lowe; those voting NOI none.
