October 171 1956,at 1;00 o'clock P. M. Present were Mayor Swanson, Commissioner Erwin, Commissioner Lowe, City Manager Henderson, Administrative Assistant Sales, City Attorney Lovelace, end the Clerk. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Erwin, seconded I by Commissioner Lowe, that the minutes be approved as read and the motion was carried by the follow- in€; Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowej those voting No, none. Resolution No. 824 -- W & C 1956 Assessment -- Final Passage This was the time and ple ce set for hearing protests to levying assessments for the construction of W & C 1956. The affidavit of publication of the Notice was presented. There being no protests filed and no one present to protest, Resolution No. 824 was presented, entitled: A RESOLUTION OF' THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND INSTALLING AND/OR REPAIRING MISCELLANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1956. It was moved by Commissioner Lowe. seconded by Commissioner Erwin, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowej those voting No. none. Hesolution No. 825 -- Weed Assessment Final Passage This was the time and place set for hearing protests to levying assessments for the cutting of weeds on private properties in 1956. The affidavit of publication of the Notice was presented. There being no protests filed and no one present to protest, Resolution No. 825 was presented, entitled: I A RESOLUTION OF THE COMJlllISSION OF THE CIT'r OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES It THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF EXTERMINATION AND REMOVAl OF NOXIOUS WEEDS FOR THE YEAR 1956 PURSUANT TO THE PROVISIONS OF ORDINANCE NO. 428 ENTITLED: "AN ORDlliIANCE DEFINING AND PROVIDING FOR THE PUNISHMENT .AND ABATEMENT OF CERTAIN NUISANCES." It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowej those voting No. none. Resolution No. 826 -- Garbage Assessment -- Final Passage This was the time and place set for hearing protests to levying assessments for the collecting of garbage in 1956. The affidavit of publication of the Notice was presented. There being no protests '.",.; 8 filed and no one present to protest, Resolution No. 826 was presented, enti tled: A RESOLUTION OF THE COMMISSION OF THE CITY OF' BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REALPROPERTI IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REl.10VED DURING THE YEAR 1956, TO DEFRAY THE COST AND EXPENSE OF COLLECTING .AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN. It was moved by COIT@issioner Lowe, seconded by Commissioner Erwin, that the resolution be finally passed and adopted end the motion was carried by the following Aye and No vote: those voting Aye being I Mayor Swanson, Commissioner Erwin and Commissioner Lowej those voting No, none. Appointment of Committee for U. N. Day Acti vi ties -- Expense Authorized Mayor Swanson announced that Mrs. Hugh Herbert, Mrs. R. R. Renne and Walter R. Sales are appointed as a committee to promote U. N. Day activities in Bozeman. It was moved by Corrunissioner Erwir.., seconded by Commissioner Lowe, that the Committee be authorized to incur expense against the City in the aprroximete amount of $25.00 in the operations 0 f this corruni ttee and the moti on wa.s carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. 207 Tag Days - D. A. V. and Ladies of the Moose Requests have been received from the D. A. V. and the Ladies of the Moose to sell tags on Bozeman streets. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the D. A. V. be permitted to sell Forget-me-not tags on October 20, 1956 and the Ladies of the Moose be allowed their Red Heart tag sale on October 27, 1956 and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. I Proxy for Annual Meeting of Middle Creek Water Users' Association The annual meeting of the Middle Creek Water Users' Association will be held October 24, 1956. It. was moved by Commissioner Lowe, seconded by Commissioner Erwin, that S. D. Waldorf, City Engineer, attend to represent the City of Bozeman and that he be authorized to vote the shares of the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Purchase of Fipe for Signs The City Manager informed the Commission that the City can purchase used boiler flue for use as posts for traffic signs for $0.40 a foot. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Manager be authorized to purchase 2000 ft. at this price and the motion wes carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Reports The following reports for the month of September, 1956 were presented: Building Inspector Electrical Inspector Plumbing Inspector Sani ta rien I It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Resolution No. 827 -- Intention to Vacate Portion of Alley in Block 3, Durston':o: Second Addition At the instruction of the Commission the City Attorney has prepared the resolution of intention to vacate the alley in Block 3 of Durston's Second Addition. Resolution No. 827 was presented, entitled: A RESOLUTION OF' THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE A PORTION OF AN ALLEY IN BLOCK THREE (3) OF DURSTON'S SECOND ADDIT ION TO THE CITY 01<' BOZEMAN, MONTANA. It was moved by Commissioner Erwinl seconded by Commissioner Lowe, the t the resolution be passed and adopted and October 31, 1956 be set as the date for hearing protests and the motion was tarried ~.,.~ by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none. Request for Water to Serve Southeast Part of City Members of the Deaconess Hospital Board appea.red before the Commission to inquire as to having city water mains extended and one or more streets opened in the area south and east of Sunset Hills Cemetery. The Commission requested that a flat of ground proposed to be developed and a schedule of I the proposed developement be presented in order to determine to what extend, if any, the t the City should participate. ProFosal of Morrison-Meierle, Ine. for Street Improvements John Morrison of Morrison-Meierle, Inc. appeared before the Commission to present his Company's proposal for the setting-up and engineering of a city-wide street improvement district. Copies of the proposal were given the Commissioners for their study and 9onsideration. (Commissioner Lowe excused from the meeting) Manager Authorized to go to Columbia Falls 208 The City Manager announced that he has been invi,ted to Columbia Falls to speak on the merits of the Commission-Manager fonn of government. Columbia Falls is proposing to adopt the system. It was moved by Commissioner Erwin, seconded by Mayor Swanson, that the City Manager be authorized to go to Columbia. Falls without any expense to the City and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Corrnnissioner Erwin; those voting No, none.
