The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, November 21, 1956 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner
Erwin, Commissioner Lowe, City Manager Henderson, Administrative Assistant Sales, City Attorney Lovelace
and the Clerk. the following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Lowe, seconded by

Commissioner Erwin, tho. t the minutes be approved as read end the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe;
those voting No, none.
Sewer Rental.. Kessler Dairy - 803 North Wallace
The Kessler Dairy plant at 803 No. Wallace has a well and uses mostly well water in its operation.
A sewer rental at $4.00 a month is now being chargedl the use of the well water ~ot being considered
in the present sewer rate. Based on water use by Kessler Dairy in past locations where all water was
metered, the average monthly sewer rental charge would be $48.00. It was moved by Commissioner Erwin,
seconded by Commissioner Lowel that the Kessler Dairy at 803 No. Wallace be charged a monthly sewer
rental of $48.00 and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.
Report.. Meeting of Faot Hnding Committee
s. D. Waldorf, City Engineer, reported on the Faot I<1nding Committee meeting held in Helena,
November 15, 19561 brief~y outlining engineering aspects and proposed methods of financing the new
highway program and pointing out the relationship of the program to the City of Bozeman.
City Manager to Legislative Committee Meeting

The Legislative Committee of Montana Municipal League meets in Helena December 8, 1956. City
Manager Henderson is a member of the Committee and has been asked to attend. It was moved by
Commissioner Lowe, seconded by Commissioner Erwin, the. t the City Manager be authorized to attend
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swansonl
Commissioner Erwin and Commissioner Lowe; those voting No, none.
Kenneth Simpson Confirmed as Regular Fireman
Kenneth Simpson has been employed on a probationary basis since May 1, 1956 as a member of the
Bozeman Fire Department andl his probationary employment having been entirely satisfaotory in all
respects, Fire Chief McCrosson recommends that he be oonfirmed as a regular member of the Bozeman
Fire Department effective on and from November 1, 1956.
It was moved by Commissioner Erwinl seoonded by Commissioner Lowe, that Kenneth Simpson be con-
firmed as a regular fireman in accordance with Chief McCrosson' s recommendation and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin
and Commissioner Lowe; those voting NOI none.
William Johnson's "Leave of Absenoe" Terminated
William Johnson has accepted permanent employment through his election as County Auditor. He is,

at present, on extended leave of absenoe from the F'ire Department. due to injuries reoeived in September,
1955 while he was employed outside his regular duty as a member of the Bozeman F'ire Department whioh
outside employment was not under the jurisdiction or responsibility of the City of Bozeman.
It was moved by Commissioner Lowe, seconded by Co~18sioner Erwin, that, sinoe William Johnson has
accepted permanent employment elsewhere, his "Leave of Absence" be terminated and that the City Manager
be instructed to so notify him and the motion was carried by the following Aye and No votel those vot-
ing Aye being Mayor Swanson, Commissioner Erwin and Commissioner Lowe; those voting No, none.

The report of Director of Finance for the month of October, 1956 was presented.
It was moved by
Commissioner Erwin, seconded by Commissioner Lowe, that the report be accepted and ordered filed and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Erwin and Commissioner Lowe; those voting No, none.

Request of School District #7 Regarding Planning West of City
A letter from John Shively, Supt. of City Schools, states School District #7 contemplates purchase
of land from James Placek on West Babcock, within 1/2 mile of the city limits, to hold for a future
school site. Request is made for information as to the City's position on extending sewer and water
service to this site and as to streets which will be located on or adjacent to the property. The
Commission referred the request to the Municipal Plan Board for their recommendation before a reply is
made to it.
Letter to Board of Adjustment Re: Rehearing of Gallatin Farmers Co.
The City Attorney, as instructed by the Commission, had prepared a letter in reply to inquiry from
the Board of Adjustment for clarification on certain points on zoning which would affect the application
of the Gallatin Farmers Company for a re-hearing on their appeal heard before said Board on October 11.
1956. The Commission approved the letter and recommended that it be signed by the Mayor and sent to
the Board of Adjustment for their information.
Adjournment
There being no further business to come before the Commission at this timel it was moved by
Commissioner Lowe, seconded by Commissioner Erwinl that the meeting adjourn, and the motion was carried
