The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Buildingl Wednesday, November 28, 1956 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner
Erwin, Commissioner Lowe, City Manager Henderson, Administrative Assistant Sales, City Attorney
Lovelace and the Clerk. The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Erwin, seconded ~
Corrnnissioner Lowe, that the minutes be approved as read and the motion was carried by the following
Aye and No vote: those voting Aye beine Mayor Swanson, Commissioner Erwin and Commissioner Lowe;
those voting NOI none.
Policy of Local Painters' Union
Walter R. Patten, business agent in Bozeman for the Painters' Union, appeared before the Commission
to present complaint of his union regarding painting and glazing; work which has been done by City
employees. He outlined types of work vbich is claimed by his union as their right and stated that,
if City maintenance employees are permitted to do such work, his union would request a work stoppage
by City employees who are members of any or all unions. Mr. Patten was informed by the Commission that
the problem would be taken under advisement to work out a policy which woule be acceptable to both the
City of Bozeman and the Painters' Union.
City Planning Program - Discussion by S. R. DeBoer
S. R. DeBoer, President of S. R. DeBoer and Company, Denver, Colorado, wes present at the invita-
tion of this City. Members of the Bozeman Municipal Plan Board were present to hear Mr. DeBoer outlin~
for the City Commission and themJ the scope and type of work which his firm, as planning consultants, can
and would render if they were engaged to develop a master plan for the growth of the City. Mr. DeBoer
stated that, upon his return to Denver, he will send a written proposal to the City, detailing what his
firm will do and at what compensation.
Garbage Complaint - Clyde Rushing
Clyde Rushing, owner of two apartment properties, appeared before the Commission to request that
his properties be excluded from the Oity's garbage collection system and that he be permitted to have
garbage hauled from them by a private contractor. Mr. Rushing complained about the service rendered
by the City's garbage collection system. He was informed that, since garbage collection from all
residence properties by the City's garbage collection system is compulsory, it would be impossible to
exclude individual properties. He was requested to immediately inform the City Office at any time
collection service to his premises is not properly rendered so that correotion can be made.
Inquiry - Water Service for School Outside City Limits
A letter from School District #7, by John Shively, Superintendent of Schools, was presented in
which it was stated that School District No. 7 is contemplating; the purchase of ground for a future
school site approximately one-half mile west from and outside the City Limits. The letter requested
information as to future street location in this area which might affect the proposed school s1 te
and as to whether or not the City would furnish water and sewer utilities for the school. The City
Manager was instructed to inform School District No.7 that only tentative plens have been made for
location of streets in this area, the t no guarantee can be made at this time on exact location of
such streets but that normal development would undoubtedly work out a street plan for the mutual
benefit of a school site and surrounding property. The Manager was also instructed to inform the
School that it would be permitted to connect to City utilities even though the school was outside the
City Limits but that extension of utilities to such a site would be the responsibility of the school
and would be made only at their expense.

Request for Water Service
Service Station a.t 11th and Main, Outside City Limits
A letter was presented from H. A. Bolinger, Jr. requesting the City to permit a service station,
which is being constructed for his clients just outside the City limits at 11th Avenue and Main Street,
to be connected to the City water system. The request was taken under advisement.
Claim. -- Co-op Lead & Chemical Company

Claim No. 6886 for $887.40, from the Co-op Lead and Chemical Company, St. Paul, Minnesota, was
presented. The Manager explained that this claim was for copper pipe purchased for the Water
Department. The claim was in proper order and a just and lawful claim against the City and it was
subject to a 1% cash discount if paid at once.
It was moved by Commissioner Lowe, seconded by Conunissioner Erwin, that this claim be approved
and a warrant issued for its payment, and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Erwin and Conunissioner Lowe; those voting No, none.
Transfer of Beer and Liquor License -- VFW Club
Written request was presented from Veterans of Foreign Wars, Post No. 903, for transfer of their
for retail sale of beer and liquor
club license/from their present location at 20 South Black Avenue to 125 West Mendenhall Street. It
was moved by Conunissioner Erwin, seconded by Commissioner Lowe, that the request be granted, and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Swansonl
Conunissioner Erwin and Conunissioner Lowe; those voting No, none.
Proposed Location - Storage Tanks - Gallatin F;armers Company
The Gallatin Farmers Company proposes to install five or more above-ground tanks for storage of
motor fuels at their bulk plant at the corner of Broadway andF'ridley Street. A proposed location

of these tanks is closer to the property line than is specified by the Building Code. In view of the
fact that the property lines in question are street lines and decreasing the required distance from
such I.roperty line will create no undue hazardl it was moved by Commissioner Lowe, seconded by
Commissioner Erwin, that exception in the required distance from property line for these tanks be
permitted subject to the approval of the Building Inspector and the Fire Chief, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin
and Commissioner Lowe; those voting No, none.
State Planning Board Meeting in Helena
A meeting has been called by the Executive Secretary of the Montana State Planning Board to be
held in Helena on December'S, 1956 to consider proposed legislation relative to planning end zoning
of areas adjacent to and outside of City Limits. It was moved by Commissioner Erwin, seconded by
Commissioner Lowe, that, it being in the public interest, attendance of City Manager Henderson and
Administrative Assistant Sales at this meeting be authorized and that expense for such attendance be
paid from the General FUnd, and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Erwin end Commissioner Lowe; those voting No, none.

Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjournl and the motion was carried
by the following Aye and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin and
