M. Present were Mayor Swanson, Commissioner Erwin, Commissioner Lowe. City Manager Henderson, Administrative Assistant Walter Sales, City Attorney Lovelace, and the Clerk, when the following proceedings were hadl I Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded by Mayor Swanson, that these minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting NOI none. Public Hearing -- S. 1. D. No. 384 This was the time and place set for the hearing of protests to the creation of Special Improvement Distriot No. 384, paving on South Grand Avenue from Garfield Street to Lincoln Street. Affidavit of publication of the Notice and the Clerk's Mailing Certificate that all property owners have been notified were presented. Written protests reI-resenting 54.85% of the property in the district were presented. It was moved by Commissioner Lowe, seoonded by Commissioner Erwinl that the protests be sustained, and the motion was carried by the follewing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwinl Commissioner Lowe; those voting No, none. Several owners of property in this distriotl both proponents and opponents of the proposed paving, were present and required procedure in the formation of improvement dis tricts was explained in detail to them. Petition to Pave South Willson -- Garfield to Grant Street I A petition from owners of property on South Willson Avenue, requesting that a special improvement district be created to pave south Willson Avenue from Garfield Street to Grant Street, was presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Engineer be instructed to prepare estimates of cost and boundaries of the district and, based on this information, the Ci~ Attorney be instructed to prepare a reSOlution of intention to create the district and the motion was carried by the following Aye and No votel those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Permission to Cut Curb -- California Company, Main & 7th; Main & Broadway Mr. Fisher, Sales Manager of the California Company, was present to discuss proposed re-construction of driveways at two servioe stations awned by his company. At Main Street and Seventh Avenue, where Main Street is being widened, the proposed plan is to leave or re-construct driveway along Main Street extending approximately 45 feet from the east line of their property and to build new curb along the balance of their frontage on Main Street~ At Main Street and Broadway, where a new station is to be built, the plan proposed two driveways from Main Streetl one to be 45 feet and the other 65 feet in width. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the proposed driveway from Main Street at the 7th Avenue station be approved and that the two driveways from Main Street at I the Broadway station be approved, conditioned on each of these driveways being reduced to not more than 35 feet in width, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Reports The following reports were presentedl Director of Finance for the month of May, 1956 State Board of Health's Inspection of Water Facilities. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the reports be acceI-ted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being 158 Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting NOI none. Planning Funds Water Works Project A letter, dated June 18, 1956, has been received from L.R. Durkee, Area Representative, Housing & Home I<lnance Agency, Seattle, Washington, stating, "Supf-lementing my letter of June 15, we are proceeding to process our original application for a complete planning of water facilities. If there have been any significant changes in the proposed work to be included in this planning, or if you desire to make any changes in the application as originally filed, we should be advised promptly." Since the proposed water works improvement project was, on May 29, 1956 approved by the voters of this City and securing planning funds with the least possible delay has beoome of increasing importanoe and to make record of the position of the City of Bozeman in this matter, it was moved by Commissioner Lowe, seconded by Commissioner Erwin. that the Mayor inform the Housing and Home Finance Agency that it is the desire of this City that its applicationl dated NQvember 14. 1955, for planning funds in the amount of $57,000.00, to complete planning of a proposed water works projectl shall be processed without change except as to change in such minor detail as may be required by the Housing and Home Finance Agency and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No. none. Meeting of State Volunteer Firemen's Association The annual meeting of the State Volunteer Firemen's Association will be held in Butte, June 20th to 23rd, 1956. ~ter consideration. it was decided not to send a representative to this meeting. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lowe, seconded by Mayor Swanson, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson.
