The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, March 14, 1956 at 1.00 o'clock P. M. Present were Mayor Swanson,
Commissioner Erwin, Commissioner Lowe, Administrative Assistant Walter Sales, City Attorney Lovelace,
and the Clerk, when the following proceedings were had.

Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded
by Commissioner Erwin, that these minutes be approved as read, and the motion was carried by the
following Aye and No votes those voting ~e being Mayor Swanson, Commissioner Erwin, Commissioner
Lowe; those voting No, none.
Claim for Insurance - Police Cars
Claim No. 4847 in the amount of $95.00 from the Truck Insurance Exchange for collision insurance
on the police cars was presented. After examination of the cl aim by the Commission, it was moved by
Commissioner Erwin, seconded by Commissioner Lowe, that the claim be approved and a warrant issued for
its payment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Erwin, Commissioner Lowej those voting No, none.
Contre.cts for Purchase of 1450 Acre Feet of Ryall te Water
Contracts from the State Water Conservation Board for the purchase of 1450 acre feet of water from
the Middle Creek Water Users Association, stored in the Hyalite Reservoir, were presented. The contracts
were referred to the City Attorney for examination. The City Attorney stated the contract does not make
any provision for prepayment of the contract in full and does not state the rate of interest on the
unpaid balance.

Development of Fishing Pond in Lindley Park
It was reported the Junior Chamber of Commerce would like to develop a fishing pond in Lindley Park
for children 13 years of age and younger. The pond will be stocked by the Fish and Game Comrrlission.
Resolutions - Improvements on Main Street by Highway Commission
Resolution with reference to permitting encroachments and the erection of signs, signals and
semaphores and the restricting of speed limit on Main Street pursuant to the requirements of the State
Highway Commission were presented and read as follows I

WHEREAS, the State Highway Commission is desirous of constructing the Bozeman East Road in
Gallatin County within the City of Bozeman, Montana, beginning at Survey Station 414.28.4
at the intersections of Seventh Avenue South and Seventh Avenue North on West Main Street
and extending easterly along west Main Street to Survey Station 420.56.0 at a point near
Fifth Avenue for a total distance of 0.119 mile, more or less, and further designated as
Federal Aid Project No. F 222(12).
That it hereby agrees with the State Highway Commission and the Bureau of Public Roads to
the following stipulationsl
WHEREAS, the State Highway Commission is desirous of receiving F'ederal funds for improve-
ment of said highway; and
WHEREAS, the Bureau of Public Roads of the U. S. Department of Commerce will not partici-
pate in the construction of said street until and unless the City of Bozeman will agree to
certain conditions, hereinafter set forth.

THEREFORE, be it resolved by the Council of the City of Bozeman that for, and in consider-
ation of, the State Highway Commission of Montana and the Bureau of Public Roads of the
U. S. Department of Commerce, constructing said highway and routing traffic on the same
within the City of Bozeman, over the above-mentioned street.
1. That it will not in the future permit encroachments on the right of way of' said above-
mentioned street.
2. That it will not pass any ordinances or laws fixing a speed limit on the above-mentioned
street of under 25 miles per hour.
3. That it will not allow the erection of signs, semafhores, or signals that will give
preference to local routes which intersect with said above-mentioned street with the excep-
tion of necessary traffic lights.

4. That it will require stopI-ing of traffic at all intersecting streets and alleys before
entering the above-mentioned street with the exception of those int~rsecting streets where
traffic is regulated by traffic lights and when traffic lights are in operation.
5. That it will modify its city ordinance to require parallel parking on the above-mentioned
street.
6. That it will require that all opening of the pavement be done under direct supervlslon of
the State Highway Conunission to their complete satisfaction and that no opening of the favement
is to be done wi 1h out prior authorization from the State Highway Commissi on and upon posting
an approved bond in an amount of one thousand dollars ($1 ,000.00), it being understood that
the bond provision does not apply to any work done by the forces of the municipali~.

7. That it will service and maintain all traffic lights, storm sewers, water lines, manholes,
storm-water inlets, and all other publio utilities of a like nature that are within the
boundaries of or are related to the above-mentioned street or streets and which mayor may not
have been constructed wi th Federal aid and/or State funds.
Adopted by the Council and approved by the Mayor this 14th day of March, 1956.

FEDERAL AID PROJECT NO. F 203 (5)
WHEREAS, the State Highway Commission is desirous of constructing the Gallatin Gateway -
Bozeman Road in Gallatin County, within the City of Bozeman, Montana, beginning at the west
city limits of Bozeman at Survey Station 400+42.4 near Eleventh Avenue and extending easterly
along INest Main Street to Survey Station 414+28.4 between the intersections of Seventh Avenue
South and Seventh Avenue North on West Main Street, for a total distance of 0.263 mile, more
or less, and fUrther designated as Federal Aid Project No. F 203(5).
WHEREAS, the State Highway Commission is desirous of receiving Federal funds for improve-
ment of said highway; and
l/iliEREAS, the Bureau of Publ ic Roads of the U. S. Department of Commerce will not participate
in the construction of said street until and unless the City of Bozeman will agree to certain
conditions, hereinafter set fortI,"
THEREFORE, be it resolved by the Council of the City of Bozeman that for, and in considera-
tion of, the State Highway Commission of Montana ani the Bureau of Public Hoads of the U. S.
Department of Commerce, constructinb said highway and routing traffic on the same within the
City of Bozeman, over the above-mentioned street.

Request of Highway Department for City to Move Light Poles on West Main Street

It was reported that the State Highway Department has requested the City of Bozeman to move the
ornamental light poles on West Main Street from Fifth Avenue west in connection with the widening of
Main Street. The Commission stated that the moving of the poles should be part of the improvement
costs and this entire expense should not be borne by the City of Bozeman, and it was decided to contact
the Highway Department to see if they will share in this cost.

Appointment of Roy Cattrell - Board of Adjustment
as a member of the Board of Adjustment
Mayor Swanson announced the appointment of Roy Cattrell/to fill the unexpired term of Elmer
Bartholomew. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the appointment
be approved and confirmed ~nd the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
Electrical Bond -- F. L. Dye Compa~
The bond of the F. L. Dye Company as an Electrical Contractor was presented. The bond was approved
as to form by the City Attorney. It was moved by Commissioner Erwin, see ended by Commissioner Lowe,
that the bond be approved and accepted, and the motion was carried by the following Aye and No vote;
those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
VFW Request for Street Dance and Parade
A request from the Veterans of Foreign Wars to hold a street dance on South Black Avenue in front
of the V. F. W. Club on the night of June 7th, 1956, and to hold a parade on June 9th in connection
with their state meeting, was read. It was moved by Commissioner Lowe, seconded by Commissioner Erwin,
that the request be granted and the motion was carried by-the followinE Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.

Agreement -- Social Security Coverage
An agreement between the Board of Administration of the Public Employees Retirement System and the
City of Bozeman for Social Security coverage for city employees was presented. It was moved by
Commissioner Lowe, seconded by Commissioner Erwin, that the agreement be approved and the Mayor and
the Clerk of the Commission be authorized to sign the agreement for the City of Bozeman, and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin,
Commissioner Lowe; those voting No, none.
Preliminary Report forWe.ter System Improvement
The preliminary Studies and Report for the water supply and distribution system improvements
prepared by Morrison-Maierle, Inc. was presented to the Commission.
Reports
The following reports for the month of February, 1956 were presented:
Water Collector
Cashier
Police Judge
and the report of the Cashier for the month of January, 1956.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the reports be accepted

and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
Cost of Improvement of Basement Floor at Llbra~
It was reported that the estimated cost to replace the wooden floor in the basement at the Library
with a concrete floor has been estimated at $580.00.
Storm Sewer on West Main Increased from 12" to 15"
City Encineer Waldorf reported the State Highway Department has now requested that the storm sewer
to be installed on Main Street from Ninth to Tenth Avenues for the proposed improvements of Highway 191
west be increased in size from a 12-inch line to a 15-inch line. It was stated that the city's share of

the cost of a 15-inch sewer line will be approximately $1,033.00, which is some ;200.00 more than a
12-inch line. After consideration, it was moved by Conunissioner Erwin, seconded by Commissioner Lowe,
that installation of a 15-inch sewer line be approved, and the motion was carried by the following
Aye and No vote; those votinE Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those
voting; No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
