The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, March 21, 1956 at 1:00 o'clock P. M. Present were Mayor Swe,nson,
Commissioner Erwin, Commissioner Lowe, City Manager Henderson, Administrative Assistant Walter Sales,
City Attorney Lovelace, end the Clerk, when the following proceedings were had:

Minutes of the last regulAr session were read, and it was moved by Commissioner Erwin, seconded
by Commiss ioner Lowe, tha t these minutes be approved as read, and the motion was carried by the
following Aye and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner
Lowe; those voting No, none.
Report
The report of the Director of Finance for the month of February. 1956 was presented. It was
moved by Commissioner Erwin, seconded by Commissioner Lowe, that the report be accepted and ordered
filed, and the motion was carried by the following Aye end No vote: those voting Aye being Mayor
Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
I. M. Johnson's Proposal to Cover Bozeman Creek
The written proposal of I. M. Johnson to cover Bozeman Creek through Lot 24, Block C, Original
Townsite, which was read at the meeting of March 7th, 1956, was considered further. The City Attorney
was instructed to prepare an agreement along the lines of the written proposal.
Discussion &. Explanation of Preliminary Report - Morrison-Maierle, Inc.
John Morrison, President of Morrison-Maierle, Inc., was present and discussed in detail the
completed preliminary report and study prepared by his organization for the improvement and expansion

of the city's water system. City Engineer Waldorf and Water Superintendent Border were present during
this discussion.
Purchase of 6" Water Main for S. I. D. #383
Plans fbr Spec ial Improvement District No. 383 call for a 10" water main on 11th Avenue between
Main and Mendenhall Streets. This was to be a part of a trunk line loop proposed in an earlier plan
for expansion of the water distribution system. The Morrison-Maierle, Inc. plan now presented puts
this trunk line in a different location and therefore a 6" line on 11th Avenue in place of this 10"
line is all that is required. It will be necessary to purchase 436' of 6" cast iron pipe plus
some pipe fittings for this installation and the 10" pipe previously purchased can be used in the
future expansion of water supply system trunk lines.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Manager be
authorized to purchase 436 feet of six-inch cast iron pipe and necessary fittings, to cost aI;proximately
$900.00, and the motion was carried by the following Aye and No votel those voting Aye being Mayor
Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
Water Purchase & Subscription Agreement for Hyalite Water
The Water Furchese Contract and Subscription Agreement for the purchase of 1450 acre feet of

water in Hyalite Reservoir for $49,143.94 cash was presented. A communication from the State Water
Conservation Board stated the. t the policy of that Board permits prepayment of contracts on any
installment payment date. It was moved by Conunissioner Lowe, seconded by Commissioner Erwin, that the
contract and subscription agreement be approved and the Mayor and the Clerk of the Commission be author-
ized to sign them for the City of Bozeman, and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
Eleotion for Water Improvement Bonds
The City Attorney reviewed the election laws for conducting elections on revenue bond issues and

stated that he would prepare a written opinion on this matter for the Commission.
City to Move Ornamental Li&ht Wires on West Main
'Ihe matter of relocating underground wires for ornamental lights between Fifth and Eighth Avenues as
lDB.y be required in connection with the widening of West Main Street was considered. It was decided that
it would be to the City's advantage to move the wires at city expense.
City to Pay Storm Sewer Improvement on Main Street
A letter dated March 16, 1956 from Fred QuinnelL Administrative Engineer, Montana Highway Department,
states that the estimated cost to the City of Bozeman for installing a storm sewer on West Main Street
between 9th and lOth Avenues is $1,100.00. It is proposed that this storm sewer be installed as a part
of the project for relocating U. S. Highway No. 191 to have it extend straight west on Main .,Street from
8th Avenue. Mr. Quinnell's letter requested that a letter be furnished to the Montana Highway
Department from the City of Bozeman stating that the City will assume responsibility for this payment
and givin~ infbrmation as to when such payment will be made. It was moved by Commissioner Lowe, seconded
by Commissioner Erwin, that the Gi ty Manager be instructed to write a letter to the Mont.ana Highway
Department assuming responsibility for the ~l, 100.00 payment in accordance wi th the above estimate and
informing them payment will be made after July 1, 1956 so that it may properly be set up in the 1956-57
Budget and the motion was carried by the following Aye and No vote; those voting Aye being Mayor
Swanson, Commissioner Erwin, Commissioner Lowe; tLose voting No, none.
Manager &: EnEineer to Helena ReI Main Street Widening
There are several details in connection wi th the widening of pavement on West Main Street between
5th and 8th Avenues which should be discussed with State Highway 1hgineers. It was moved by Commissioner
Erwin, seconded by Corrunissioner Lowe, that the City N'.e.nager and the City Engineer be authorized to go
to Helena on March 26, 1956 to discuss these matters and the motion was carried by the following Aye
and No vote; those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting
No, none.
Conference on Street Financing
The Mayors of Missoula and Helena have called a meeting of city officials in Helena on March 28th,
1956 for the purpose of discussing street firJ.ancing. It was moved by Commissioner Lowe, seconded by
Commissioner Erwin, that a delegation of officials, not exceeding five in number, to be selected by
the Mayor, be authorized to attend this meeting, and the motion was carried by the following Aye and
No vote: those voting Aye being Mayor Swanson, COlmnissioner Erwin, Commissioner Lowe. those voting
No, none.
FBI Conference fbr Policemen
There will be a conference in Billings April 3rd, 1956 to be conducted by the FBI and the Chief
of' Police has requested that Captain C. V. Saunders be authorized to attend this meeting.' It was moved
by Commissioner Erwin, seconded by Commissioner Lowe, that this authority be granted and the motion
was carried by the i~llowing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin,
Commissioner Lowe; those voting No, none.
Adjournment
There being no further business to come before the Corr~ission at this time, it was moved by
Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjourn and the motion was carried
by the following Aye and No vote; those voting Aye being Mayor Swanson, Cornmi~sioner Erwin, Commissioner
Lowe; those voting No, none.
