The Commission of the City of Bozeman met in regular session in the Commission Room. Ci ty Hall
Building, Wednesday, May 9,1956 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner Erwin,
Commissioner Lowe, City Manager Henderson, Administrative Assistant Walter Sales, City Attorney Lovelaee,
and the Clerk, when the following proceedings were had:

Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded by
Commissioner Erwin, that these minutes be approved as read, and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those
voting No, none.
Propos,91 of Bozeman Community Television to Bury TV Cable
Mr. Norman Penwell. of Bozeman Community Television, Inc., was present and presented a written
proposal to remove certain sections of their cable now carried on telephone company poles that are to
be taken down, and to install those sections of TV cable underground. The proposal included request
to cross streets and alleys with th is underground cable and to lay the cable in street parkings. After
consideration, it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the request be
referred to the City Engineer to prepare specifications for the cutting and replacement of pavement
and backfilling, and that the City Attorney prepare an agreement between the City of Bozeman and Bozeman
Community Television, Inc., for the placing of this cable under-ground on city property, and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin,
Commissioner Lowe; those voting No, none.

The Manager stated that he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrsnts be drawn for their payment. After examination
of the claims in detail and checking against the Claim Register, it was moved by Commissioner Erwin,
seconded by Commissioner Lowe, that the claims be approved and warrants issued for their payment, and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swenson,
Commissioner Erwin, Commissioner Lowe) those voting No, none.

It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the reports be accepted and
ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor

Chief to Attend Fire Prevention Conference in Helena
Governor Aronson has called 8. Fire Prevention Conference to be held in Helena on May 16th, 1956.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that Fire Chief McCrosson be
authorized to attend this conference and his expenses be paid from the General FUnd, end the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Con:unissioner Erwin,

Gas Tax Refund Claim
A claim to the State Boa rd of Equalizati on in the amount of $1, 179.50 for refund of Montana State
Gasoline Tax paid by the City of Bozeman was presented. It was moved by Commissioner Erwin, seconded by
Commissioner Lowe, that the City Manager be authorized to file said claim against the State Board of
Equalization and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
Paving; of Eighth .Avenue between Harrison and Cleveland
An inquiry has been received from Montana State College regarding recommended width of proposed
paving on Eighth Avenue between Harrison and Cleveland Streets. It was the opinion of the City
Commission that the street should be paved to 60-foot width between curbs.
Bid for Fluorine Accepted
Bids for fluorine, received at the meeting of April 25th, 1956, were further considered. Past
discussions on fluoridations were reviewed, new developments were discussed and it was agreed tilat,
since this City has been fluoridating its water for nearly three years, the operation should be con-
tinued to give at least five years exrerience on which to base and check results obtained from it.
It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the bid of Van-Waters,
Rocers, Inc., for a 40,000 pound carload of sodium silicofluoride at $9.51 per cwt., F'. O. B.. Bozeman,
be acceptedl and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none.
Attendance to Legislative Committee Meeting Authorized
The Legislative Committee of the Montana Municipal League will meet in Helena on May 28thl 1956.
It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that attendance at this meeting by
the City Manager and the City Attorney be authorized and their expenses be paid from the General Fund,
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Erwin, Commissioner Lowe; those voting No, none.
Resolution No. 808 -- Abandoning of Parking Maintenance District No. 17
The City Attorney, as instructed, has prepared a resolution abandoning the Parking Maintenance
District No. 17 (Grand Avenue from Babcock to College Street). Resolution No. 808 was presentedl
entitled:
A RESOLUTION OF' THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ABANDONING CITY OF' BOZEMAN
SPECIAL IMPROVEMENT DISTRICT NO. 17 AND ABANDONING THE MAINTENANCE OF STREET FARKINGS THERE-
UNDER, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED. AND PURSUANT TO AND IN CONFORMITY
WITH C01llJISSION RESOLUTION NO. 807 AS FASSED AND ADOPTED BY SAID CITY COMMISSION ON THE 18TH DAY
OF APRIL, A. D. 1966.

Supreme Cou rt Dec is ion Re Drunken Driving
The City Attorney reported to the City Commission on the decision of the Supreme Court whereby
cities do not have the authority to Frosecute drunken driving charges. These charges now have to be
tried in a justice court in the name of the State of Montana
Request 01 Montana State College to Make Sewer & Water Connections for Faculty Housing
A letter. dated April 24, 1956, from Montana State College by M. F. Whalen, Superintendent of
Physical Plant, to M. E. Henderson, City Manager, was discussed. This letter was, in effect, a request
for authori ty to connect twenty-four units of "Faculty Housing" in the area south of Lincoln Street
along the general line of Fifth Avenue extended and twenty-five units of "Student Housing" in the area
south of College Street and between the lines of Twelfth and Fifteenth Avenues, extended, to the sewer

and water systems of' the City of Bozeman. A proposed letter from the City Manag;er in reply to the
request o~ Montana State College was presented. Certain conditions were set forth In it with which
Montana Sta te College should comply if they are permitted to make the reques ted sewer and wa ter c,onnec-
tions. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, thai:; Montana State Collebc
