improvement of streets was considered. The district would cover part of North EiLhtlJ Avenue, per't

of Juniper and part of Birch Streets.
City Engineer Waldorf explained that the most fair and equitable way to make the assessments, if
the proposed district is established, would be to divide the district into sections and assess the
property in each section on an area basis in accordance with the cost of the improvement installed in
such section. Mr. Waldorf further explained that, whEe such method of assessment has been used in
I
Bozeman previously, there is no Montana statute permHting that to be done and the legali ty of
assessing for improvements under such a method is questionable. City Attorney Lovelace concurred in
this statement. Considering the fact that districts have previously been established in Bozeman in
which the districts have been divided into sections for assessing the cost of the improvements, that
this method of assessment has never been questioned or challenged, and that it is the most fair and
equitable way in which to make such assessments, it was moved by Commissioner Erwin, seconded by
Commissioner Lowe, that, if the profosed improvement district is established in Royal Vista Additio!J,
it shall be divided into sections and the cost of the improvements shall be assessed by sections in
accordance with their actual cost in each section and the motion was carried by the following Aye
and No vote: those voting Aye beinij Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those votinG
