M. Present were Mayor Swanson, Commissioner Erwin, Commiss ioner Lowe, City Manager Henderson, Adminis tra ti ve Ass istant Wal ter Sales, City Attorney lovelace, end the Clerk, when the following proceedings were had: Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded by Commissioner Lowe, the t these minutes be alproved as read, end the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwinl Commissioner Lowe; those voting No, none. Claims Claims Nos. 5312 to 5315 were presented on the various funds as follows; General Street Water $885.00 605.42 556.28 The Manager stated that the claims were true and lawful claims against the City of Bozeman and recommended that warrants be issued for their :rayment. After examination of the ch\ims in detail by the City Commission, it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the claims be approved end warrants drawn for their payment and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; t.hose voting No, none. Resolution in Re: Improvements on North Rouse Avenue A proposed resolution by the City Commission whereby the City of Bozeman agrees with the State HiGhway Commission and the Bureau of Publ ic Roads to make North Rouse Avenue an arterial street, was presented as fbllows: FEDERAL AID FROJ~CT NO. US 370(8) WHEREAS, the State Highway Commission is desirous of constructing the North Rouse Avenue - Bozeman on the Boz emen - Wilsall Road in Gallatin County wi thin the city 1 imi ts of Bozeman, Montana, beginning at Survey Station 8.02.5 near the north curb line of Lamme Street at its intersection with Rouse Avenue and extending northerly along Rouse Avenue to the north city limits of Bozeman, B distance of 0.782 mile, more or less, and further designated a.s Federal Aid Project No. US 270(8). WHEREAS, the State Highway Commission is desirous of receiving Federal funds for improve- ment of said highway; and WHEREAS, the Bureau af Public Roads of the U. S. Department of Commerce will not participate in the construction of said street until and unless the City of Bozeman will agree to certain conditions, hereinafter set forth. THEREFORE, be it resolved by the Commission of the City of Bozeman that for, and in con- sideration of, the State Highway Commission 0 l' Montane and the Bureau of Public Roads of the U. S. Department of Commerce, constructing said highway and routing traffic on the same within the City of Bozeman over the above-mentioned street. That it hereby agrees with the State Highway Commission and the Bureau of Public Roads to the following stipulations: 1. That it will not in the future permit encroachments on the right of way of said above- mentioned street. 2. That it will not pass any ordinances or laws fixing a speed limit on the above-mentioned street of under 25 miles per hour. 3. That it will not allow the erection of signs, semaphoresl or signals that will give preference to local routes which :intersect with said above-mentioned street with the exception of necessary traffic ligh ts. 4. That it will require stopping of traffic at all intersecting streets and alleys before entering the above-mentioned street with the exception of those intersecting streets where traffic is regulated by traffic lights and when traffic lights are in operation. 5. That it will modify its ci ty ordinance to require parallel parking on the above-men- tioned street. 6. That it will require that all opening of the pavement be done under direct sUfervlslon of the State Hie;hway Commission to their com:rlete satisfaction and that no opening of the pave- I I I ment is to be done wi ttout prior authorization from the State Highway Commission and upon posting an approved bond in an amount of one thousand dollars ($1.000.00), it being under- stood that the bond provision does not apply to any work done by the forces of the municipality. 7. That it will service and maintain all traffic lights, storm sewers, water lines, manholes, storm-water inlets, and all other public utilities of a like nature that are within the boundaries of or are related to the above-mentioned street or streets and which mayor may not have been cons tructed wi th Federal aid and/or State funds. FlattinG Outside City Limits Discussed I Mr. Hal Bolinger we.s present to inquire about proposed platting of ground, west of the City limitsl owned by Marguerite Kirk, one of his clients. Mr. Bolinger was informed that no definite information could be given to him until review is made with the Municipal Plan Board relative to proposed over-all plans for this area. Walter Sales, Secrete.ry of the Flen Board, was :instructed to extend an invitation to that Board to meet with the City Commission at their next regular meeting, or at the earliest practicable date thereafter, to present a progress report and discuss the status of planning with particular emphasis on the area adjoining the city on the west. Opening of Eleventh A;venue The City Commission discussed with Mr. Hal Bolinger the proposed opening of Eleventh Avenue between Main Street and Babcock Street. The ground needed for right of way for this section of street is owned by Martha Bolles Palfty and Laura M. Brunton who are clients of Mr. Bolinger. The City Manager was instructed to submit a proposal to these owners, through Mr. Bolinger, that, as a part of platting additional adjacent ground which they own, they dedicate ground for this particular street in accordance with a sketch of the proposed street which has previously been delivered to Mr. Bolinger. t Petitions for :raving; North 5th, North 4th and North 3rd Peti tions were presented requesting Improving Districts to be created to provide for paving the following streets: North Fi fth from Lamme to Durston Road and Durston Road from Fifth to Seventh Avenue North Fourth from Ville.rd to Durston Road and Durston Road from Fourth to Fifth Avenue North Third Avenue from Lamme Street to Durston Road and Durston Road from Third to Fourth Avenue Short Street from Fourth to Fifth Avenue. Because the percentage of property represented by signers on the petitions ranged from 48% on 11:3 1,t,t Third Avenue to a low of 19% on Fifth Avenue, action was deferred until more detailed information on estimated costs is secured Bnd furnished to circulators of the petitions and owners of properties in the proposed districts and until more signatures can be secured on the petitions. Plat of Ed Vogel's Subdivision A plat of a proposed subdivision of an a.rea situated approximately 3/4 mile northeest from the ci ty limits, to be known as the Ed. Vogel Sub-division, was presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the Director of Public Service be authorized to approve the plat and the motion was carried by the following Aye and No vote: those voting Aye being Mayor SW8nson, Commissioner Erwin, Commissioner Lowej those voting No, none. E:xterlsion oi Water Nisin into fair Grounds A request has been received from Gallatin County Fair Board, by Homer Fisher, Secretary, for the City to install a 2-inch water service into the Fair Grounds near the intersection of Grand Avenue and Tamarack Street. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that. the City make this ipstallaLion, the cost thereof, including cost of' a 2-inch meter, less credit for the normal co st of a 3/4" hous e servi ce of equal length, to be peid by Galla tin County Fair Board and the motion wes carried by the following Aye and No vote: those voting Aye behJ€ Mayor Swanson, Commissioner Erwin, Comrnissioner Lowe; those voting };o, none. Requests for Street ~:'nd Alley Lights Requests for street lights and alley lights /:It the following locations have been received: On Church Avenue between Fridley and Peach Streets On Wallace Avenue between Fridley and Peach Streets In the first alley north of Main Street between Grand & Third and In the rear of the Court House between Third and Fifth. It wa.s moved by Commissioner Erwin, seconded by Commissioner Lowe, thet the City Manager be authorized to have the Man tana P~wer Company install 1 igh ts at these locations and the motion was carried by the following Aye and No vote: those votin~~ Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. Method of Assessment for Improvement District in Royal Vista Addition The method of making assessments in a proposed improvement district in Royal Vista AddH,ion for I I I improvement of streets was considered. The district would cover part of North EiLhtlJ Avenue, per't 145 of Juniper and part of Birch Streets. City Engineer Waldorf explained that the most fair and equitable way to make the assessments, if the proposed district is established, would be to divide the district into sections and assess the property in each section on an area basis in accordance with the cost of the improvement installed in such section. Mr. Waldorf further explained that, whEe such method of assessment has been used in I Bozeman previously, there is no Montana statute permHting that to be done and the legali ty of assessing for improvements under such a method is questionable. City Attorney Lovelace concurred in this statement. Considering the fact that districts have previously been established in Bozeman in which the districts have been divided into sections for assessing the cost of the improvements, that this method of assessment has never been questioned or challenged, and that it is the most fair and equitable way in which to make such assessments, it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that, if the profosed improvement district is established in Royal Vista Additio!J, it shall be divided into sections and the cost of the improvements shall be assessed by sections in accordance with their actual cost in each section and the motion was carried by the following Aye and No vote: those voting Aye beinij Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those votinG No, none. Release for Use Pictures of Steam Cleaner Machine for Advertising Rod Boyer, Manager of Hines Motor Supply Co., has taken pictures of city-owned equipment to show a Malsbary Steam Cleaner in use for thawing storm sewer inlets. Request has been received from the Malsbary ManufacturinG Co. for release and authority for them to use those pictures in advertising in trade journals and other publications. I It was moved by Commissioner Lowe, seconded by Commissioner Erwinl that this release and authori ty be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson I Commissioner Erwin, Commissioner Lowe; those voting No, none.
