The Commission of the City of Bozeman met in regular session in the Corrooission Room, City Hall
Building, Wednesday, May 23, 1956 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner
Erwin, Commis s ioner Lowe, City Manager Henderson, Admini strative Assistant Wal ter Sal es , City Attorney
Lovelace, end the Clerkl when the following proceedings were had:
Minutes of the last regular session were read, and it was moved by Commissioner Lowe, seconded
by Commissioner Erwin, that these minutes be approved as read, and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner
Lowe; those voting No, none.
Agreement -- Laying of UndergronnG Cable by Bozeman Community TV
A proposed agreement, prepared by the City Attorney, between the City of Bozeman and Bozeman
Community Television, Inc., whereby the City grants permission to said Company to install an under-
ground TV cable in certain street and alley areas subject to conditions provided in the aGreement,
was presented. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the agreement
be approved and accepted, subject to the Bozeman CO!lL.'Tluni ty Television, Inc., furnishing the City a
properly executed easement from affected owners of property permitting burial of TV cable in the
vacated alley in Block Two of Park Addition and that the Mayor and Clerk of the Commission be authorized
to sign the Ar;reement for The City of Bozeman, and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Swenson, Commissioner Erwin, Commissioner Lowe; those voting No,
none.
Communication -- He: Availability of Water for 'NeIls in this Area
A letter from Mr. Frank A. Swenson, of the Billings office of the U. S. Geological Survey, was
read relative to the study completed by that agency in 1954 of the water resources of the Gallatin
Velley. The letter was to further confirm that this study shows it to be impractical and economically
unsound to, look for additional water supply from wells for the City's water system when it is so
f'ort:unfl te as to be able to get water from Hyalite which can be brOUGht into the City by gravity flow.
Report
The report of the Director of Finance for the month of April, 1956 was presented. It was moved
by Commissioner Erwin, seconded by Commissioner Lowe, that the report be accepted and ordered filed and
the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Erwin~ Commissi oner Lowe; those voting No, none.
Report from Flan Board
Frank Messmerl Chairman of the Municipal Plan Board, was present and reported on progress of that
Board. He stated that a drawing of a proposed plan for lend use of area adjoining and within one-half
mile from the west boundary of the City is expected to be ready for presentation to the Gi ty Commission
for their consideration following the next meeting of' the Plan Board which will be on June 4, 1956.
Definitions of Retail and Wholesale Gasoline Distributors
The question of whether or not dealers in gasoline are operating as wholesalers (bulk plants)
or as retailers was cons idered. After discu ss ion, it was moved by Commissioner Lowe, seconded by
Commissioner Erwin, that the City Attorney be instructed to include definitions in proposed amendments
to the Zoning; Ordinance whicl, will define "service or gas stations" and "bulk plants" as they are
defined in the model ordinance of the National Fire Protective Association the point being to distinguish
between a retail business which would be Fermi tted in a "Business District" and a wholesale business
which would be permittpd to operate only in an industrial district and the motion was carried by the
following Aye and No vote: those voting .Aye being Mayor Swanson, Commis s loner Erwin, Commissi oner Lowe;
those voting ~o, none.

Agreement -- Municipal Band D.nd City of Bozeman
Problems arising in operations of the Municipal Band under the present agreement between the Band
and the City of Bozeman were discussed. After consideration, it was moved by Commissioner Lowe,
seconded by Commissioner Erwin, that the Mayor appoint a committee of five memberR, two of whom shall
not be musicians or members of a band and the other three to be the band instructors at Bozeman
elementary schools, Gallatin High School and Montana State College, this committee to meet with the
City Manager to get information on present operation and administration of the Band, to investigate all
problems involved and to bring recommendations to the City Commission at the earliest practict".ble date

Proposed Schedule of Water Rates
A schedule, prepared by Morrison-Maierle, Inc., of proposed water rates, to be put into effect if'
and when the new water system project is put under construction, was discussed. The City Manager was
instructed to send a copy of the schedule to Stanton Aby of Kalman & Company, fiscal Agents of the City
in the water works project, for their study and recommendations.
Sewer Connections for Buildings at Montana State College
Problems arising from sewer connections made to the city's sewer system for buildings at Montana
State College were pointed out and discussed by the City Commission. After discussion, it was moved
by Commissioner Erwin, seconded by Commissioner Lowe, that the City ManaEer give wdtten notice to
Montana State College that, before any additional or new buildings on Montana State College campus ere
rermitted to be connected to the sewer system of the City of Bozeman, plans for such connection shell
be presented to and Approved by the City Engineer and written Fermi t for the connection shell h8ve been
granted by authority of the City Commission and the motion was carried ljy the followinl;'; Aye end liio vote:

Automobile Safety Check by "Jaycees"
Request has been received from the Junior Chamber of Commerce to hold en Automobile Se fety Check
using the south side of Main Street between Third and Fifth Avenues during the first Lhree Saturd<1Ys
in June. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the request be
gr!mted and that the City furnish check cards and stickers for use in the safety check 8.nd the mot::l on

Request to Vacate a Portion of South Fourth Avenue
Inquiry has been made by Don DeCosse and D. K. Scharff on the rossi.bH:ity of vacating the enst
ten feet of South Fourth Avenue in the three blocks from Garfield Street south so that thi s strir could
be added to the properties of owners along that street and thereby Inmate beautification and Rdequate
maintenance of this ground. The City Manager was instructed to inform these owners that vacflting this
section of street eree would not be looked upon wi th favor.

The estimated work requested of the City would be two to three days work for four dump trucks to
haul sand. It was moved by Commissior.er Lowe, seconded by Commissioner Erwin, that the City ManaEer
be authorized to assiGn Street Department personnel and equipment to do the requested work and the
motion vv"9s carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Erwin, Commissioner Lowej those votinG No, none.
Construction of Storm Sewer at Ninth and Main
As part of the contract for constructing D. S. Ei!;';hway No. 191, extending west from Fifth Avenue
on Main Street, a neW' storm sewer is to be buil t between Ninth and Tenth Avenues. Ing,olph Johnson,
0azeman Contractor, has the sub-contract for constructing this sewer. It is also necessary for the
City of Bozeman to install certain sections of storm sewer at the intersection of Ninth Avenue and
Main Street before other street construction can be started on this project. Th.e Ci ty has the required
materials on hand for its ]:'art of the I:roject. There will be three manholes and approximately 295 ft.
of sewer pipe of varying; sizes to be installed and it would be advantageous to have Mr. Johnson make
this installaLion when his men and equipment are installing the sewer between Ninth and Tenth Avenues.
Estimated cost of making this installation, exclusive of cost of materials, is not to exceed $1,858.00.
It was moved by Commissioner Lowe, seconded by Co:nmissioner Erwin, that the Ci ty Manager be and
is hereby authorized to hire labor and equipment on an hourly or day to day basis from Ingolph Johnson
for making the above described stann sewer installation and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowej those
voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lowe, seconded by Commissioner Erwin, that the meeting adjourn and the motion was
