M. being the time set for the regular meeting of the City Commission and Mayor Swanson being the only member present and therefore there not being a quorum present, Mayor Swanson recessed this meeting until 7:30 P. M. of this same date. The regular meeting on this date of the City Commission was resumed at 7:30 P. M.. those present being: Mayor Swansonl Commissioner Erwin, Commissioner Lowe, City Manager Henderson, City Attorney Lovelace, City Engineer Waldorf, Assistant Ci~ Engineer Liquin and the C~rk. At the request of the Municipal Plan Board, this was arranged as a joint meeting of that Board and the City Commission. Plan Board members present were: Chairman Frank Messmerl and C. V. Henderson, Paul Anderson, Stanley Lemon and Dr. M. L. Hultgren. Absent were: H. C. Cheever and Walter Secor. Mr. John DeHaas was present at the request of and to represent Mr. Cheever. Also present as interested citizens were Ivor Kilbride, Forrest Kilbride and G. M. Beatty. Minutes of the last regular session were readl and it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that these minutes be approved as read, and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No. none. Report from Municipal Plan Board Chairman Messmer informed the Commission that the Plan Board has progressed to a point in planning of the area between Huffine Lane (U. S. Highway #191) and Durston Road and extending approximately one-hal f mile west from the city limits where the Board is now ready to make recommendations on the development of this area. He requested Mr. John DeHaas to explain a map of the area above described which showed proposed street system, parks, school ai tes and similar features. This map was presented to the City Commission as the report and recorruoondation of the Plan Board as a master plan for the orderly development of this area. After detailed explanation of the plan by Mr. DeHaas and members of the Board, it was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the map be accepted as a tentative plan, that it be referred to the City Engineer and to the School Boards of District No.7 and Gallatin County High School for their recommendations and, upon receipt of those recomrnendationsl a meeting be arranged between the City Commission, the Municipal Plan Board and all owners of proper~ in the planned area at which time any necessary changes can be made and a final plan adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwinl Commissioner Lowe; those voting No. none. Plan Board Recommendations on Legislation Mr. C. V. Henderson, speaking for the Plan Board, presented the following recommendations on needed legislation and requested that these matters be taken up at the annual meeting of the Montana Municipal League and included in the legislative program of the League to be brought before the 1957 session of the Montana Legislature: 1. Amend Section 11-510, R. C. M. 1947, to make it applicable to all cities of the first class instead of to cities of population between 20.000 and 35,000. 2. Amend Section 11-403, R. C. M. 1947, to require protest of the owners of 50% of the property in an area proposed to be included within an extension of the limits of a city to stop proceedings for such extension of city limits. Present law requires the protest only of a majority of the resident free-holders in the area. 3. Seek support of all cities and towns, through the Montana Municipal League for neces- sary legislation or required constitutional amendment to provide "Home Rule" for Montana cities and towns. I I I Delegates to Municipal League Meeting lrr: .Jt) The annual meeting of the Montana Municipal League will be held in Billingsl Montana I June 21 to June 23, 1956. It was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the City Manager, the City Attorney, the Director of Finance, the Mayor and members of the City Commission be authorized to attend this meeting and their expenses be paid from the General FUnd and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner I Lowe; those voting No, none. Report of Band Committee A memorandum from the Band Committee, appointed by the Mayor to consider matters pertaining to the Municipal Band, was read. The committee recommended the continuation of the Municipal Band under its present organization until a new agreement and by-laws can be prepared; that the band be a concert band, and that a tax levy of one-hal f mill be levied by the city for the coming year for band purposes. It was moved by Commissioner Lowe~ seconded by Commissioner Erwinl that the recornmendations be accepted and the committee be given the thanks of the City Commission for the work they have done, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting NOI none. Addition to Dwelling, 508 West Main Street, Approved John Braaksma, owner of a residence at 508 West Main Street, has made informal application for a permit to make certain additions to this residence. The property is in Fire Zone No.1; the present building and the proposed additions are of wood frame construction. The Commission, sitting as a Board of Appeals, gave consideration to fire hazards involved and to the fact that this area will probably be continued as residential area for many years. In view of all circumstances presented, I it was moved by Commissioner Lowe, seconded by Commissioner Erwinl that upon presentation of a proper application by Mr. Braaksma in conformity with the information presented at this hearing, the Building Inspector be and is hereby authorized to issue a permit for the proposed additions to this residence and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swansonl Commissioner Erwin, Co~~issioner Lowe; those voting NOI none. Report The report of the Cashier for the month of May, 1956 was presented. It was moved by Commissioner Lowe I seconded by Commissioner Erwin, that the report be accepted and ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swansonl Commissioner Erwinl Commissioner Lowe; those voting No~ none. Delegate to Law Enforcement Conference A letter from the Attorney-General stating a law enforcement conference will be held in Hel ena, June 28 to 30, 1956 was read. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the Chief of Police and one member of the Police Department be authorized to attend this conference, and their expenses be paid from the General Fund, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting I No, none. PeU tion for Storm Sewer on Ninth & Tenth Avenues Petitions signed by property owners representing 14.9% of the property on South Ninth and South Tenth Avenues requesting the installation of a storm sewer were presented. Because of small percentage of the property represented, it was moved by Commissioner Erwin, seconded by Commissioner Lowe, that the petitions be tabled and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting No, none. 156 Petition ~r S. I. D. to Pave South Black from Story Street to College Street A petition of owners of property on South Black Avenue from Story Street to College Street was presented in which it was requested that a Special Improvement District be established to provide for installing a road-mix paving mat on the existing surface of this street. It was moved by Commissioner Lowe, seconded by Commissioner Erwin, that the City Engineer prepare district boundaries ba.sed on these data, and estimates of cost and, the City Attorney be instructed to prepare a resolution of intention to create the district and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Erwin, Commissioner Lowe; those voting NOI none.
