M. 1947) and Section 6 of Ordinance No. 524 for the organization of the City Commission in accorde.nce with the resul ts of the Regula r Municipal Election held November 8th, 1955, the City Commission met at 10:00 o'clock A. M., January 3rd, 1956, in the Commission Room, Ci~ Hall Building for organization purposes. Those present were I Mayor Lowe, Commissioner Erwin and Commissioner Swanson, City Manager Henderson, Aqrninistrative Assistant Sales, City Attorney Lovelace, City Engineer S. D. Waldorf, and H. Dean Moore, Acting Clerk, when the following proceedings were had: Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded by Commissioner Swanson, the. t the minutes be aJ.proved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin and Commissioner Swanson; those voting No, none. Unfinished Business For the reason that all applications for the sale of beer and liquor are required to be filed by December 31st, the following such applications were presented: For Beer and Liquor Sales at Retail: Arcade Bozeman Hotel Park Ber The Stockman Baxter Hotel Baltimore Hotel Top Hat Club Licenses for Sale of Beer and Liquor: B. P. O. E. (Elks) ~. O. E. (Eagles) Veterans of Foreign Wars American Legion I Retail Sale of Beer for off-premises consumption only: Safeway Stores J & E Market Parkway Grocery Sale of Beer at Wholesale: 7-Up Bottling Company It was moved by Commissioner Erwin, seconded by Commissioner Sw~nson, that subject to comfletion in detail of the applications, these applications be aI-proved and the licenses granted in accordance therewitil and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin and Commissioner Swanson.. those voting No, none. Mayor's Reduction of Police Court Fine - Pruitt Mayor Lowe broug,ht up the matter of a Police Court Case, Docket No. 14880, dated December 9, 1955, in which one Allan D. Frui tt was fined $20.00, the offense being 1 isted as "Failure to have car under control and involved in an accident". 'This defendent has appealed to the Mayor for a remission or reduction of the fine for the reason that Edward W. Anacker was involved in the same accident for which Pruitt was charged and Police Docket No. 14668 shows that Anacker was fined $10.00. Mayor Lowe informed the Commission that he has investigated these two cases, that he feels that proper justice has I not been given in the Pruitt case and that, in accordance with the powers conferred on him by Section 11-802, R. C. M., 1947, he has ordered $10.00 of the $20.00 fine assessed to be remitted end rei~nded to Allan D. Pruitt. Reorganization and Selection of Mayor This having concluded old business to be brought before the Commission, the City Manager presented a letter from \"1. W. Lessley, District Judge, stating that official bonds of Howard Erwin and W. Gilbert Lowe, duly elected City Commissioners for the City of Bozeman for terms commencing January 2, 1956 and ending January 4, 1960 have been approved by him as to form end content. Commissioner Erwin and 91 92 Commissioner Lowe have thus qualified for re-election as City Commissioners, Mayor Lowe then stated that the next order of business would be the appointment of a member of the Commission to serve as Mayor for the unexpired term of the late Commissioner J. Harry Healy. For the purpose of the record Mayor Lowe ex~leined thet at the regular municipal election held November 3, 1953, the late J. Harry Healy received the highest number of votes of any candidate for the office of City Commissioner and was elected for a four year term and, as provided in Section 11-3245, R. C. M., 1947, was accordingly entitled to serve as mayor for the last two years of his term; that the said J. Harry Healy died on September 7, 1954 and on September 22, 1954 the remaining City Commissioners, pursuant to the power vested in them by Section 11-3215, R. C. M., 1947, filled the vacancy in the Commission caused by Commissioner Healy's death by the appointment of Arnold Swanson. Mayor Lowe further explained that, as provided in Section 11-3245, R. C. M.,1947, in the event a vacancy exists in the office of Me.yor for any cause other than expiration of the Mayor's term of office, the remaining members of the Commission shall choose his successor for the unexpired term from their own number by lot, and that this meeting was the proper time for such vacancy to be filled. Whereupon, Commissioner Erwin moved that Commissioner Arnold Swanson be appointed Mayor to fill the unexpired term of the late Commissioner J. Harry Healy. This motion was duly seconded by Mayor Lowe and unanimously carried, the vote upon said motion being Mayor Lowe "aye", CorrunissioneT Erwin "aye" and Commissioner Swanson "aye". Retiring Mayor Lowe turned his chair over to incoming Mayor Swanson and Howard Erwin and W. Gilbert Lowe took their seats as City Commissioners. Verbal Reports - City Manager end City Engineer For the information of the re-organized Commission, the City Manager and City Engineer made verbal reports on the status of proposed waterworks, street and other improvements. Statement of Policy At the request of the City Manager for instruction and information, the Mayor end Commissioners stated that they proposed or recommended no change in policy, procedure or operations of the City at this time.
