The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, September 14, 1955 at 1;00 o'clock P. M. Present were Mayor Lowe,
Commissioner Erwin, City Manager Henderson, City Attorney Lovelace and the Clerk, (Swanson absent)
when the following proceedings were hed;
I Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded by
Mayor Lowe, that these minutes be approved as read, and the motion was carried by the following Aye
and No vote; those voting Aye being Mayor Lowe and Commissioner Erwin; those voting No, none.
Resolution No. 793 - Final Passage - Parking Maintenanoe
This was the time and plaoe set for hearing protests to levying the assessment for parking
maintenance for the year 1955. No protests have been filed and no one is present to protest. Resolution
No. 793 was presented. entitled;

It was moved by Mayor Lowe, seoonded by Commissioner Erwin, that the resolution be finally
passed and adopted and the motion was carried by the following Aye and No vote; those voting Aye
being Mayor Lowe and Commissioner Erwin; those Toting No, none.
Resolution No. 794 - Final Passage - Lighting Assessment
This was the time and place set for hearing protests to levying the assessment for street lighting
maintenance for the year 1955. No protests have been filed and no one is present to protest. Resolution
I No. 794 was presented, entitled:

Resolution No. 796 - Final Passage - Sprinkling Assessment
This was the time and place set for hearing protests to levying the assessment for street
sprinkling for the year 1955. No protests have been filed and no one is present to protest. Resolution
No. 795 was presented, entitled:
A RESOLUTION OF' THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL
ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF

Resolution No. 796 - Final Passage - Garbage Assessment
This was the time and place set for hearing protests to levying the assessment for garbage removal for
the year 1955. No protests have been filed and no one is present to Froteet. Resolution No. 796 was
presented, entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA. LEVYING AND ASSESSING A
SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF
GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED
DURnW THE YEAR 1955, TO DEFRAY THE COST AND EXPENSE OF' COLLECTING AND DISPOSING OF
GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN.
It was moved by Commissioner Erwin, seconded by Mayor Lowe, that the Resolution be finally

Water -- Need for Repairs on Mystic Lake Reservoir
The Manager reported on the need for repair and maintenance work on the dam and spillway at
Mystic Lake. He was instructed to arrange a meeting of the Board of Directors of the Bozeman Creek
Reservoir and the City Commission to discuss the matter.
Claim - Standard Construction Co. I
Claim No. 3367 of the Standard Construction Company. in the amount of $1,148.93, for partial
payment on the construction of Special Improvement District No. 380 was presented. It was moved by
Mayor Lowe, seconded by Commissioner Erwin. that the claim be approved and a warrant issued for its
payment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Lowe and Commissioner Erwin; those voting No, none.
City Manager Authorized to Travel - Bond Financing
A communication from Kalman & Company was read regarding bond financing for proposed improve-
ments on the water system. After discussion. it was moved by Commissioner Erwin, seconded by Mayor
Lowe. that the City Manager be authorized to go to Great Falls and other Montana cities to get
information from their experienoe regarding bond financing of their improvements.
Reports
The following reports for the month of August, 1955 were presented: .
Director of Finance Cemetery Board Fire Chief
It was moved by Mayor Lowe, seconded by Commissioner Erwin, that the reports be accepted and
ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe and Commissioner Erwin; those voting No. none. I
Plan Board Recommendations Re Zoning
Reoommendations of the Plan Board regarding the re-zoning of districts was reported. It was moved
by Commissioner Erwin, seconded by Mayor Lowe, that the matter be referred to the Board of Adjustment,
and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and
Commissioner Erwin; those voting No, none.
Right-of-Way of U. S. #10 on East Main Street
A communication from the State Highway Right-of-Way Engineer was read stating they will be in
Bozeman this week to discuss their right-of-way for U. S. Highway No. 10 on East Main Street.
Purcha.e of Folice Uniforms
Recommendation of the Chief of Police for the purchase of uniforms and unifOrm equipment for
Police personnel, to cost approximately $627.20, was reported. It was moved by Mayor Lowe, seoonded
by Commissioner Erwin, that the City Manager be authorized to make this purchase. and the motion was
carried by the following ~e and No vote: those voting Aye being Mayor Lowe and Commissioner Erwin;
those voting No, none.
Building - Chronicle Building - 32 South Rouse
Question has arisen regarding the use of aocoustioal tile for ceiling without further adequate I
fire protection of the roof structure in the new "Chronicle" building being erected at 32 South Rouse
Avenue. Wal ter Sales, Assistant Building Inspector, pointed out that this building is in Fire Zone
No. 1 and, under the building code of this city, the roof structure should be protected to not les8
than one hour fire resistiv.e rating. Ingolph Johnson, the contractor who is constructing the build-
ing, contends that construction such as is proposed here. has always been permitted in Bozeman and
that it would work undue and unnecessary hardship on him and the owner to now change the plans for
this building. He also points out that this is a one-story, relatively small build ing which will

present no special fire hazard. In view of these circumstances, and considering that the building
ordinance does require fire protected construction in this case, Mr. Johnson, 8S builder. and Mr.
Ifft, as owner of this building, have made verbal appeal that an exception be made and that this
building be permitted to be completed as per the original plans. The City Commission, sitting as
a Board of Appeals, gave full consideration to the circumstances and it was moved by Commissioner
Erwin, seconded by Mayor Lowe, that the appeal be granted and that immediate and full investigation
I be made of this section of the ordinance to detennine and clarifY what should be done on the point
in question as it may apply to any future construction in Fire Zone No. 1 of the City and the motion
was carried by the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner
Erwin; those voting No. none.
Adjournment
There being no fUrther business to come before the Commission at this time, it was moved by
Commissioner Erwin, seoonded by Mayor Lowe, that the meeting adjourn and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Lowe and Commissioner Erwin; those
voting No, none.
