HomeMy WebLinkAbout1955-09-28 Bozeman, Montana 3:3 September 28, 1955 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building. Wednesday afternoon. September 28, 1955 at 1:00 o'clock P. M. Present were Mayor Lowe, Commissioner Erwin, Commissioner Swanson, City Manager Henderson, City Attorney Lovelace and the Clerk, when the following proceedings were had: I Minutes of the last regular session were read, and it was moved by Corr~issioner Swanson, seconded by Commissioner Erwin. that these minutes be approved as read, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Repair Work at Mystic Lake Dam Don Nash and Harold Klumph. represent:1ng; the Bozeman Creek Reservoir Company. met with the Commission to present recommendations of their organization for maintenance and repair work to be done a t Mystic Lake Dam. The Company recorr~ends that the shareholders. other than the city, pay one-half of the cost of the repair to the weir and spillway, not to exceed $1,000.00, as their share. and that the road to the dam be built and the necessary material be moved in by the City. Mr. Nash and Mr. Klumph stated that, in the opinion of the farmer shareholders in the company. the action of the City in having Bozeman Creek watershed closed to public use stopped all maintenance of the original road up Bozeman Creek canyon to Mystic Lake and therefore that the road deteriOrated to where it became unusable and had to be abandoned. They feel that, for those reasons, the City should be responsible for rebuilding this road. H. D. Halpin, District F'orest Ranger, was present and stated that the condition of the spillway I at the dam is dangerous and of great concern to them. He suggested that a service road of minimum standards be constructed at the earliest possible date in order that materials Can be hauled to the dam and necessary repairs made. To give some additional time for consideration of the proposal presented. it was decided that another meeting of city and company representatives should be held at the next regular meeting of the Ci ty Commission at which it may be possible to reach a final decision. Resolution No. 797 -- Weed Assessment -- Final Passage This was the time and place set for hearing protests to the levying of an assessment for cutting weeds for the year 1955. The affidavit of publication of the Notice was presented. No one was present to protest and no protests were filed. Resolution No. 797 was presented, entitled: A RESOLUTION OF' THE COMHISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS- MENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF' BOZEMAN, COUNTY OF GALLATIN, STATE OF MON TANA. 'fO DEFRAY THE COST OF EXTERMINATION AND REMOVAL OF' NOXIOUS WEEDS FOR THE YEAR 1955 PURSUANT TO THE PROVISIONS OF' ORDINANCE NO. 428 ENTI'ILED~ "AN ORDINANCE DEFINING AND PROVID- ING FOR THE PUNISHMENT AND ABATEMENT OF' CERTAIN NUISANCES." It was moved by Commissioner Erwin. seconded by Commissioner Swanson, that the Resolution be finally passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. "I Parking of Cars at Men's Dormitory Problems resulting from parking cars on streets near the new Men's Dormitory at Montana State College together with a request from Montana State College for restricted parking on Eighth Avenue from Coll~ge to Harrison and on Garfield from Fifth to Sixth Avenue were discussed. It was announced that a meeting with College authorities would be held on Thursday, September 29th, to discuss these problems. Resolution No. 798 -- Intention to Abandon Maintenance District No. 68. The City Attorney as instructed has prepared a resolution of intention to abandon parking 5,1 maintenance District No. 68, from College Street to Cleveland Street on Willson Avenue. Resolution No. 798 was presented, entitled: A RESOLD TION OF' 'l'HE CITY COMMISSION OF TEE CITY OF' BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO ABANDON CITY OF BOZEMAN SFECIAL IMPROVEMENT DISTRICT NO. 68 AND TO ABANDON THE MAINTENANCE OF STREET PARKINGS THEREUNDER, AND DlRECTlliU THE CLERK OF 'l'HE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL PURSUANT 10 THE STATUTES IN SUCH CASES MADE AND PROVIDED. It was moved by Commissioner Swanson, seconded by Commissioner Erwin, that the resolution be I passed and adopted, and October 19th, 1955';;be"set as the date for the hearing of'protests, and the motion was carried by the following Aye end No vote: thoa e voting Aye being Mayor Lowe, Commis doner Erwin, Commissioner Swanson; thos e va ting No, none. Building Permit Approved -- 809 West College The application of Chris Evenson~ to construct an addition to the present building at 809 West College to the property line and to be constructed of concrete block was reported. The present build- ing does not comply with fire regulations in this district for a building constructed to the property line, but the addition does comply with fire restrictions. The City CommisSion, sitting as a Board of Appeals, considered the application, and it was moved by Commissioner Erwin, seconded by Commissioner Swanson, that the application be approved and a pennit issued, and the motion was carried by the follow- ing Aye and No vote: those voting Aye being; Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Report The report of the Water Collector for the month of September, 1955 was presented. It was moved by Commissioner Swanson, seconded by Commissioner Erwin, that the report be accepted and ordered filed and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Lowe, I Commissioner Erwin, Commissioner Swanson; those voting No, none. Bids for S. 1. D. No. 383 SpecificatiotLs for the construction of Special Improvement District No. 383 have been prepared by . the City Engineer. It waS moved by Commissioner Erwin, seconded by Commissioner Swanson, that the Clerk of the Commission be authorized to advertise for bids for this construction work, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Acceptance of Fire Truck A communication from John McCrosson, Fire Chief, was read, stating the new fire truck received from Peter Pirsch and Sons, meets all requirements and tests as set out in the specifications, and that all equipment ordered is on the truck. The results of the pumping tests made by the Board of Fire Underwriters have not been received. It was moved by Commissioner Swanson, seconded by Commissioner Erwin, that, subject to the report of the Board of 'Fire Underwriters Engineers as to the testing of the pump, that the truck be accepted and the motion was carried by the following Aye and No vote: thcs e voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Claim of Monarch Lumber Company I The claim of. the Monarch Lumber Company in the net emount.of $252.19 for sewer pipe was presented. The claim is subject to a 2% cash discount if paid by October 1st, 1956. It was moved by Commissioner Erwin, seconded by Commissioner Swanson. that the claim be approved and a warrant drawn for its payment, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Fire Chief to Civil Defense Conference A Civil Defense Conference for Fire Chiefs will be held in Helena on October 19-20, 1955. It was 55 moved by Commissioner Swanson, seconded by Commissioner Erwin, that the Fire Chief be authorized to attend this conference and his expenses be paid from the General Fund, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Report of Visit to Other Cities by City Manager I The City Manager reported to the Commission on a trip he had made during the preceding week to Billings, Roundup, Lewis town. Great Falls and Helena and on information he had gotten in those cities regarding financing and engineering of utility expansions and other city projects. Adjournment; There being no further business to come before the Commission at this time, it was moved by Commissioner Swanson. seconded by Commissioner Erwin. that the meeting; adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none.
