October 5. 1955 at 1:00 o'clock F. M. Present were Mayor Lowe, Commissioner Erwin, Commissioner Swanson, City Manager Henderson. City Attonley Lovelace and the Clerk, when the following proceedings were had; I Minutes of the last regular session and of the special session held September 29th were read, and it was moved by Commissioner Erwin, seconded by Commissioner Swanson, thet these minutes be approved as read, and the motion was cerried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Appl ica tion for Sta te Gas Tax Re fund An application to the State Board of Equalization for state gas tax refund in the amount of $1,130.57 was presented. It was moved by Commissioner Swanson, seconded by Corrunissioner Erwin, that the City Manager be authorized to file the claim, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Resolution No. 799 -- Assessment S. I. D. 380 The resolution levying the assessment for the construction of Special Improvement District No. 380, paving on North Tracy Avenue from Short to Peach Street. in the amount of $3.258.98 was presented, enti tled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSHlSSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE ProPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 380 IN THE CITY Ol" EO ZEMAN, COUN TY OF GALLATIN, STATE OF' MONTANA. TO DEf'RAY THE COS T Of CON- I STRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 380. It was moved by Commissioner Erwin, seconded by Commissioner Swanson. that the resolution be passed and adopted, and October 13th. 1955 be set as the date for the hearing of protests, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin. Commissioner Swanson; those voting No. none. MYstic Lake D~ -- U. S. Forest Service H. D. Halpin and Elmer Luer, representing the U. S. Forest Service, were present to further discuss conditions at Mystic Lake Dam. The inspection made at the darn on September 24th by these men, City officials and Bozeman Creek Reservoir Company shareholders showed need for repairs and improvements which, in the opinion of the Forest Service ref'resentatives, are urgent and of special importance. Mr. Luer advised the Commission that a reply to City Manager Henderson's letter of October 1st, relative to engineering on a road to Mystic Lake. should be in the mail within a day or two. He also stated that. as soon as review and investigation is comIleted on the responsibilities and authority of the U. S. Forest Service as applicable in this case, a letter will be sent to the officers of' the "Lake" company, with an information copy to the City, to definitely set forth the recommendation and requirements of the Forest Service in this matter. I Examination of Depository Bonds The Commission proceeded to check the Custodian's Receipts of Depository Bonds to cover the city's deposits in the various city banks, and finds the bonds sufficient to cover defosits; it was moved by Commissioner Swanson. seconded by Commissioner Erwin, that the bonds be aFproved, and set out in full in the minutes, and the mot! on was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Culp, 1235 North 7th Avenue, for an encroachment permit to remove two trees , and to fill and reseed the barrow pit at this address was presented. The permit was arproved by the State Hilhway Commission. Appointment of Committee for Celebration of United Nations Anniversary Mayor Lowe announced that he has all_ointed the following as a comJUi ttee to arrange for the celebra- tion of the United Nations Tenth Anniversary: John Braaksma. Chairman Roy Cattrell Max Worthington Paul Grieder Ladder Truck Tests Meet Board of Fire Underwriters' Approval A reJ.ort was presented from Dave Thomas, District Engineer, Board of :Fire Underwriters of the Pacific, on tests conducted ur,der hi s supervision on September 22, 1955 of the City's new "Pirsch" I aerial ladder fire truck. The relort showed that the equipment met all requirements of the City's srecifications and standards of the Nationel Board of Fire Underwriters. Request for Banner Across Main Street A request was presented from a Ii:. S. C. Committee for permission to hang banners across Main Street to advertise "Homecomint; Day". The committee chairman has stated that Montana State College will carry liability insurance to cover the installation. Resurfacing of Sidewalk -- 1404 South 5th It was reported that through an error or misunderstanding the sidewalk constructed at the property of Mary Loughead, 1040 South 5th Avenue, was constructed with the contour of the ground, and not according to sidewalk grades as set by the City Engineer. The contractor states he questioned the grade stakes as set when the walk was being constructed and was informed they were correct, and the walk was so set. The walk at the south end is considerable lower than the grade would be. In order to correct this condition, for which it seems the contractor is not at faul t, the Manager requested authority to have the walk resurfaced, to bring it to grade, and do some filling, grading and reseeding on the property of Mary Loughead at a cost of approximately $50.00 for the sidewalk resurfacing, and the other work to be done by the Fark Department. It was moved by Corrunissioner Erwin, seconded by Commissioner Swanson, that the City Manager be authorized to have this work done, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, I Commissioner Swanson; thos e vo ting No, none. Engineering Contract for Water Improvements Discussed John Morrison, President of Morrison-Maierle, Inc., Consulting Engineers of Helena, Montana was present to discuss a proposed contract to bring engineering: data on proposed improvements in the city's water system up-to-date. After detailed consideration of the proposed contract it was referred to the City Attorney for his study and recommendations as to its legality.
