The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Thursday afternoon, October 13, 1956, at 1;00 o'clock F. M., Wednesday, October l2t~having
been a legal holiday In the State of Montana. Present were Mayor Lowe, Cownissioner Erwin, Commissioner
Swanson, City Manager Henderson, City Attorney Lovelace and the Clerk, when the following; proceedings

Minutes of the last regular session were read, and it was moved by Commissioner Swanson, seccnded
by Commissioner Erwin, that these minutes be approved as read, and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Lowe, Com~issioner Erwin, Commissioner Swanson;
those voting No, none.
Claims
Claims Nos. 3599 to 3624A inclusive were presented on the various funds as follows;

TIle Manager stated the t he has audited these claims and finds them to be true and lawful claims
against the City of Bozeman and recommends that warrants be drawn for their payment. After examination
of the claims in detail by the Commission and checking against the Claim Register, it was moved by
I Commissioner Erwin, seconded by Commissioner Swanson, that the claims be approved and warrants issued
for their payment, and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none.
Confirmation of Harrison J. Reeder as a Member of' Fire Department
A letter from Fire Chief McCrosson, recommending confirma tion of Harrison J. Reeder as a regular
member of the Fire Department, 8.S of September 1, 1955, was presented and read. It was moved by
Corrmissioner Swanson, seconded by Commissioner Erwin, that Harrison Reeder be confirmed as a regular
member of the Fire Depa rtment as of September 1, 1955, subject to the c ondi tions recommended by
,- Chief McCrosson, and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No. none.
Final Adoption Resolution No. 799 -- Assessment for S. L D. 380
Ihis was the time and place set for the hearing of protests to the final passage of the resolution
. levying the assessment for Special Improvement District No. 380. No protests having been filed and no
one is present to protest. The aft idavit of publication of the Notice was presented, together with
Resolution No. 799, entitled;

Resolution No. 800 -- Assessing W & C 1955
The resolution levying the assessment for the construction of Miscellaneous W & C. 1955 in the
amount of i537.86 was presented. entitled,

Road to Mystic Lake Dam
A communication from the U. S. Forest Service was read stating they have no funds available for
furnishing an engineer to survey a road to Mystic Lake.
The City Manager was authorized to have Ancel Portnell, Watershed Patrolman, make temporary repairs
at Mystic Lake dem, such as caulking cracks in the srillwl.w. adding; braces to the weir wall, and such other
work as can be done without affecting or making change in basic conditions as they exist at the dam.
Appointment of Election Official for Social Security Election
Request has been received from the office of F. E. R. S. in Helena for an official of this City to
be designated as the person to have charge of and be resI'onsib1e for conducting the election to be held
on Janue,ry 4th, 1956, to determine if elig;ible emrloyees of thil:> City will come under Social Security.
It was moved by Commissioner Swenson, seconded by Commissioner Erwin, that 1,. G. ShadoBr:, Clerk of
the City Commission, be anointed as this election officid and the motion was carried by the followinc

Ri[.ht-of-Way Width on East Main Street
A letter was presented, signed for the Sta te Highway Engineer, by E. O. Farsons, R/W Engineer. I
relative to riGht-of-way width on Maill Street east from McAdow Avenue to the Ci ty 1imi ts. The letter
I"ro}osed a.n 80 ft. width between curbs to provide four 12' drivirlg lenes, two 8' parking lanes and
a lEi' dividinG or median strip. In discussion it was pointed out that a 16' median strip might not
be necessary on this particular street section and that further consideration should be e;iven to th:is
si tuation before a. final decision is reached. It was agreed that members of the City Canunission. the
City Manager and the City Encineer, or any of them who find it possible to do so, should go to Helena
jn the near future, and at their convenience, to discuss this ma tter further with offici als of the
Montana Highway Department
Purchase of Copper Pipe
It was moved by Commissioner Erwin, seconded by Commissioner Swanson, the t the City Manager be
authorized to purchase 2040 feet of 3/4" copper fiFe for the Water Department, and the motion was .,
carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner E~~n,
Commissioner Swansonj those voting No, none.
Whi te Cane Sale
It was moved by Commissioner Swanson, seconded by Comn,issioner Erwin, that Saturday, October 15th,
1956 be designated as White Cane Day in Bozeman, and the motion was carried by the following Aye and I
No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swansonj those voting
No, none.
Proposed Changes in Zoning - West Main St. & Thompson's Addition
As requested by the City Commission on Sert",mber 14, 1955, the Board of Adjustment has held a
public hearing on the questions of:
a Whether or not the area between Ninth and Eleventh Avenues, one-half block north and

sout!; from West Main Street should be rezoned to chang;e it from be.ing a part of Bus iness

District. Part 1 and to make it a fart of "B" residence district.
b Whether or not to zone "Thompson's Addition" to meke it a fert of' the "A" Residence

Di strict.
PiE, a result of the t hearing, the Board of Adjustment recommends tha t the Zoning Ordinance
be amended or re-wri tten to incorf,orate these two proposed changes.

instructed to prepare an amendment to the Zoning Ordinance complying with these recommendations,
and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Lowe,
Commissioner Erwin, Commissioner Swanson; those voting No, none.
Contract -- Morrison-Maierle, Inc.
John M~rrison and Harvey Taylor of Morrison-Maierle, Inc., Helena, Montana were fresent to
discuss further their proposed contract for services as consulting engineers for bringing 1949
preliminary studies on the city's water supply and distribution system up-to-date, for developing;
plans and specifications for construction of expanded and improved city water supply and distribu-
tion. and, as may be required by the City, to furnish engineering; supervision and inspection of con-
structing the proposed project. The City Attorney approved the contract as to form. It was moved
by Commissioner Erwin, seconded by Commissioner Swanson, tha t, subject to changes as recommended by
the City Attorney, the Mayor and the Clerk of the Commission be authorized to sign the contract for
the City of Bozeman. and the motion was carried by the following Aye and No vote; those voting Aye
being Mayor Lowe. Commissioner Erwin, Commissioner Swansonj those voting No, none.
Protest to Paroling of D. L. Henry
I A communica.tion from the County Attorney's office was read stating the t D. L. Henry's case will
be reviewed before the State Parole Board on October 17th, 1955, for consideration as to whether or
not the said D. L. Henry should be granted a parole.
After discussion, it was moved by Commissioner Swanson. seconded by Commissioner Erwin. that the
City of Bozeman file a protest against paroling of D. 1. Henry at this time, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin.
Commissioner Swansonj those voting No, none.
Adjournment
1here being no further business to come before the Commission at this time, it was moved by
Commissioner Swanson, seconded by Commissioner Erwin, that the meeting adjourn and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Erwin,
