The Commiseion of the City of Bozeman lllet in recular session in the Commission Room. C:ty Hall
Ettilc ing, Wednesdey afternoon. October 26, 1955, at 1:00 o'clo~k f. M. Present were Mayor Lowe,
Commissioner Erwin, Commissioner Swanson, City M€ma[;er Henderson, City Attorney Lovelace end the
Clerk, when the following proceedinbs were had:
Minutes of the last regular session were read. and it was moved by Commissioner Swanson, 1
seconded by Commissioner Erwin. that these minutes be a1Troved as reBel, and the motion was carried by
the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner
Swansonj those votinL No, none.
Construction of Road to Mystic Lake
Glen Hf:lrrine;ton, Bozeman Manager oi the Idaho Fole Company, was present and made a verbal rropose.l
for his company as follows:
a Baving been informed of the need for a road to be built over wh ich materials can be hauled

to M;ystic Lake and of the }-:ossibility of marketing mature timber on lands owned by the
City of Bozeman on the Bozeman Creek watershed, the Idaho Pole Company proposes that the;y
will cruise the timber on this city owned land and layout and do sufficient engineering
on the proposed road so that they can meke an estimate of the cost of the road and the
val ue of the marketable timber. The type of road to be laid out, the areas on which
timber may be cut, the tYfe of timber cutting to be done and all simil ar ma tters would
be to meet the recommendations and requirements of the u. S. Forest Service. This timber
cruising and road lay-out and engineering would be done at the ex~ense of the Idaho Pole
Compa.ny but, should this company purchase timber from these city owned lands, they would I
be re-imbursed for such expeIise by payment in timber.
b Besed on the timber cruising and the road lay-out and engineering cited above, the Idaho

Pole Company will furnish the City with an estimate of the cost of the proposed road and
the market value of timber which can or should be taken from these city-owned lands.
c Ii' the City then desires to have the Idaho Pole Company build the road and the estimates

show sufficient timber value to more than cover the cost of the road, the Idaho Pole
Company will construct t~e road an d take their pay for such construction in timber which
they will purchase from the city.
d The Idaho Pole Compar1Y will purchase any or all timber which the City may want to sell

on these lands but the City will not be under any' obligation to sell to them other than
to assure them of an opportunity to buy at current market prices.
After detailed discussion it was agreed that the Idaho Fole Company will send men into the
srea. at once to cruise the timber, layout the proposed road, and make up estimates of cost. This is
to be done entirely at their expense and subject to recommendation and an:::rovel of the U. S. Forest
Service. No further decisions or agreements in this matter will be made until those estimates have
been made up in accordance with this proposal and considered by the City. 1
Resolution No. 801 -- Abandoning Maintenance District No. 68
The City Attorney as instructed has prepared the resolution abandoning parking maintenance
District No. 68, Willson Avenue from College Street to Cleveland Street. Resolu tion No. 801 was
presented, entitled:

It wa.s moved by Commissioner Swanson. seconded by Mayor Lowe, that the resolution be passed
and adopted and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe and Commissioner Swansonj those voting No, Commissioner Erwin.
Bond & Contract -- S. 1. D. No. 383
The bond and contract of E. W. Nixon for the construction of Srecial Improvement District
1 No. 383. water mains on West Main Street, were presented. The bond and contract were arproved as to
form by the City Attorney. It was moved by Commissioner Erwin. seconded by Commissioner Swanson.

be authorized to sign the contract for the City of Bozeman. and the motion was carried by the

Reports
The report of the Director of Finance end the Cemetery Board for the month of September. 1955
and tile annual report of the Recreational Director were presented.
It was moved by Corrunissioner Erwin. seconded by Commissioner Swenson, that the reports be
accepted and ordered filed, and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Lowe, Corrunissioner Erwin. Corrunissioner Swansonj those voting No. none.
Claims
Claim No. 3625 of Donald H. Bentzen in the amount of $677.35 and Claim No. 3626 of the
Indianapolis Badge and Name PIa te Co.. Inc. in the amount of ~31.17 were presented. After examination
of the claims by the Commission, it was moved by Commissioner Swanson. seconded by Commissioner
I Erwin. the t the claims be approved and warren ts issued for their payment, and the motion was carried
by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Erwin, Com~issioner
Swanson; those voting No, none.
Claim for Gas Tax Refund
A claim to the State Board of Equalization for state gas tax refund in the amount of $23.73 wa.s
presented. It was moved by Commissi oner Erwin, seconded by Commissioner Swanson. tha t the City
Manager be authorized to file said claim for payment. and the motion was carried by the following Aye
and No vote: thos e voting Aye being Mayor Lowe, Commissioner Erwin. Commissi oner Swansonj those
voting No, none.
Lease for Construction of Fence
A lease agreement between the City of Bozeman and J. A. Fellerhoff for the west 75 ft. of the
south ten feet of Lot 10, Block 46, Park Addition (a ten foot strip along the south line of South
Side Park adjoining property owned by Mr. F'ellerhof'f) was presented. The lease was arproved as to
form by the City Attorney. It was moved by Commissioner Swanson, seconded by Commissioner Erwin,
that the Mayor and the Clerk of the Commission be authorized to sign the lease for the City of Bozeman,
and the motion was carried by the fbllowing Aye and No vote: those voting Aye being Mayor Lowe,

Vacating Alley in Block 3, Durston's Second Subdivision
A proposed letter to be sent to the Gallatin Co-operative Creamery wes read which, if accepted
by them in wri ti nc;. will constitute an agreement whereby they will grant the necessary right-of-way
easement and pay the additional cost for build ing a sewer around the building they propose to build
in Block 3 of Durston's 2nd Subdivision if the City will vacate the alley in this block, in
accordance with the tentative agreement reached in the minutes of the meeting of the City Commission
on September 7, 1955.
It was moved by Commissioner Erwin. seconded by Commissioner Swanson, tha t the City Manager be

Report
'The City Manager and the Chief of Police reported on the meeting; they attended in Missoula.
Amendments to Zoning; Ordinance 1
Walter Sales. Assistant Building Inspector. presented proposed changes in the Zoning Ordinance.
to regulate off-street parking. for study by the City Commission.
Election -- Printing of Ballots for General Municipal Election - 1955
1he City Attorney stated that, in his of'inion, the death of Beber 1'. Porter automatically
withdraw him as a candidate for City Commissioner in the General Municipal Election and that the
name of no other candida te should be Frinted on the ballot for the Election to be held November 8th.

'There being, no further business to come before the Commiss ion at this time. it was moved by
Commissioner Erwin. seconded by Corrunissioner Swanson. that the meeting adjourn and the motion was
