The Commission of the City of Bozeman met in re~ular session in the Commission Room, City Hall
Building, Wednesday afternoon. November 30. 1955 at 1;00 o'clock P. M. Present were Mayor Lowe,
Oommissioner Erwin, Commissioner Swanson, City Manager Henderson, City Attorney Lovelaoe and the
Clerk, when the following proceedings were had;
Minutes of the last regular session were read, and it was moved by Commissioner Erwin. seconded 1
by Commissioner Swanson, that these minutes be approved as read, and the motion wes carried by the
following Aye and No vote:' those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson;
those voting No. none.
Increase in Sewer Connection Charge
A review of flat rate charges made during the past two years for making connections to the city's
sewer system shows the t such charges have been insufficient to meet actual costs of making the connec-
tions. City Engineer Waldorf has recommended the following schedule of flat rate charges, to be
effective beginning December 1, 1955, for making sewer connections:
On wide streets (Main. North 7th. Mendenhall - - - $80.00
Other Streets - - - - - - - - - - - 65.00
Alley Connections - - - - - - - - - - 55.00
Favement cuts, $20.00 for 1st cut; _15.00 each additional cut.
It was moved by Commissioner Swanson, seconded by Commissioner Erwin. that the schedule be approved
and effective December 1st, 1955, and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Lowe. Commissioner Erwin, Commissioner Swanson; those voting No. none.
Timber Cutting on Water Shed
A memorandum from the U. S. Forest Service was read giving suggestions relative to building a
road to Mystic Lake dam and cutting timber on City owned land in the Bozeman Creek watershed. '!he I
Manager informed the Commission that, based on these suggestions. a proposal is being prepared for con-
sideration of the Commission as a basis on which to advertise for bids on this road building and timber
cutting. He also stated that the matter is being taken up with the State Board of Health to seoure
their written opinion on the proposal.
Approval of Chesnover Tracts
A plat of a small area situe.ted approximately two miles south from the city limits of Bozeman. which
is being platted into l!lcreage tracts to be known as the "Chesnover Traots". was presented and examined.
It was moved by Commissioner Erwin, seconded by Commissioner Swanson. that the Director of Public
Service be authorized to approve the plat and the motion was carried by the following Aye and No vote;
those voting Aye being Mayor Lowe, Commissioner E~in, Commissioner Swanson; those voting No, none.
Opening of Eleventh Avenue
A map to show Eleventh Avenue and properties abutting thereon between Curtiss and Beall Streets
was examined. The map showed the need for acquiring right-of-way for opening Eleventh Avenue between
Main and Babcock streets and also the excessive width of Eleventh Avenue between Main and Beall Streets.
The City Engineer and City Mane.ger reoommend that width of Eleventh Avenue, from Main to Beall Streets,
be set at 84 feet, that a detailed survey of this street section be made, and the excess of present 1
right-of-way width over the recommended 84 feet be vacated. It was direotedtbat this proposal be
brought to the atten tl. on of the City Plan Board and Gallatin County High School Board for their comment
and approval before any definite action is taken.
W. G. Hickey Ordered to Repair Basement Wall
Recent inspeotions made by the City Engineer shOW" that the basement wall of the building at 312
E. Main Street, owned byW. G. Hickey. which wall abutts Bozeman Creek, is in dangerous condition due
to erosion and its being undermined by the stream. Collapse of this wall could easily dam up Bozeman
Creek wi1h resultant flooding of surrounding area and it is a condition which is extremely dangerous 81
end could cause extenslve damage. The City Attorney was instructed to notify Mr. Hickey to have the
wall repaired within thirty days. weather permitting.
Reports
Reports of the Plumbing and Gas Inspector for the month of November, 1955 were presented. It
was moved by Commissioner Swanson, seconded by Commissioner Erwin. that the reports be accepted and
1 ordered filed, and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Lowe, Commissioner Erwin. Commissioner Swanson; those voting No, none.

It was moved by Commissioner Erwin, seconded by Commissioner Swanson, that the applications be
approved end the Director of Finance be authorized to make the adjustments on the tax records, and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner
Erwin, Commiss ioner Swanson; those voting No. none.
Resigna tion of Lowell Rathbun
The resignation of Lowell Rathbun as Assistant City Engineer effective December 19th. 1955 was read.
The Manager stated that the resignation 'WOuld be acoepted.
Ordinance No. 787 -- Amendments to Zoning Ordinance
Ordinance No. 787, amending the Zoning Ordinanoe to change the boundaries of certain districts,
end making other changes was presented, e nti tled:

There being no further business to come before the Commission at this time, it was moved by
