SUBJECT: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2017 Street Improvements to Knife River - Belgrade in the amount of
$669,528.75.

RECOMMENDATION: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2017 Street Improvements to Knife River - Belgrade in the amount of
$669,528.75.
BACKGROUND: Bids were opened March 28, 2017, for the 2017 Street Improvements
project. The project consists of cold milling and asphalt overlays of various streets as shown on
the attached map, and was bid out as a base bid and a bid alternate. Three bids were received for the project. The apparent low bidder was High Country Paving, however they neglected to sign
the required non-discrimination affirmation form, so their bid was considered non-responsive as
required by Commission Resolution 4250. The second low bidder, Knife River-Belgrade,
submitted a total base bid of $616,628.75 and a bid of $52,900.00 for the bid alternate. The bid
appear to be competitive with their bid being approximately 16% below the construction estimate for the base bid and bid alternate ($737,567.50 and $60,875.00). A copy of the
Certified Bid Tabulation is attached.
UNRESOLVED ISSUES: None
ALTERNATIVES: As suggested by the City Commission.
FISCAL EFFECTS: Funding for this work has been planned for in the FY18 Street
Maintenance fund. The contract documents specify that work may not begin until after July 1,
2017, contingent upon Street Maintenance fund budget approval for FY18.

CONTRACT FOR: Base Bid and Bid Alternate
You are notified that your Bid dated March 28, 2017, for the above Contract has been considered. You are
the apparent Successful Bidder and have been awarded a Contract for pavement cold milling, hot mix
overlays, and pavement markings.
The Contract Price of your Contract is: six hundred sixty nine thousand, five hundred twenty eight and
75/100 Dollars ($669,528.75).
Three copies of the proposed Contract Documents accompany this Notice of Award.
You must comply with the following conditions precedent within fifteen (15) days of the date of this
Notice of Award, that is, by .
1. You must deliver to the OWNER 3 fully executed counterparts of the Agreement including all the
Contract Documents and Drawings.
2. You must deliver with the executed Agreement the Contract Security (Bonds) as specified in the
Instruction to Bidders (page 7), General Conditions (paragraph 5.01) and Supplementary Conditions
(paragraph SC-5.02).
3. List other conditions precedent:
You must deliver with the executed Agreement the Certificates of Insurance as specified in
the General Conditions (paragraph 5.03) and Supplementary Conditions (paragraph SC-5.04).
Failure to comply with these conditions within the time specified will entitle OWNER to consider your
Bid abandoned, to annul this Notice of Award, and to declare your Bid Security forfeited.
Within ten (10) days after you comply with these conditions, OWNER will return to you one fully
signed counterpart of the Agreement with the Contract Documents attached.
