M. Present were Mayor Lowe, Commissioner Erwin, Commissioner Swanson, City Manager Henderson, City Attorney Lovelance and the Clerk, when the following proceedings were had: I Minutes of the last session were read, and it was moved by Commissioner Erwin. seconded by Commiss ioner Swanson, the t the minutes be approved as read, and the motion was carried by the follow- ing Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Examination of Depository Bonds The Commission examined receipts of the Federal Reserve Bank of Minneapolis covering securities held as bonds for the deposits of city funds in Bozeman banks. The securities being; found sufficient to cover the derosi ts, it was moved by Commissioner Erwin, seconded by Commissioner Swanson, the t the list be approved end accepted and incorporated in full in these minutes and the motion was carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Erwin. Zoning Requirements Business Dis trict No. 3 Mr. Paul Schofield, architect employed by Oswald Berg, and Mr. & Mrs. Culp, Qwners of property on North Seventh Avenue on which they have employed Berg to plan a motel, appeared before the Commission in the matter of requirements of the Zoning Ordinance for buildings constructed in 16 Business District, Part 3. They pointed out tha t a 11 teral interpretation of the ordinance would require higher standards as to fire protective rating in this district than is required in Business District, Part 1. They requested an interpretation of the ordinance under which requirements for fire resistive rating will be the same in Parts 1 and :3 of the Business District or that this matter be corrected by amending the present ordinance. They were informed by the Commission that this matter would be thoroughly investigated and that they would be given further information with the I least possible delay. Commendation Plaque for No Pedestrian Deaths for 1954 Dean Chaffin, Vice President of the Montana Section of the American Automobile Association presented a conunenda tion plaque to the Commission for the City of Bozeman in reoogni tion of the record of this city in having no "Pedestrian Traffic" fatalities in 1954. Fire Insurance Values on Motor Vehicles Approved The City Manager presented a list of proposed values on city-owned motor vehicles for the fire insurance purposes for the coming year. It was moved by Commissioner Swanson, seconded by Commissioner Erwin, that the list for insurance purposes as presented be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin. Commissioner Swanson; those voting No. none. Sidewalk to Curb Line in Marwyn Addition A communication from the Bridger Development Company requesting pe~ission to construct sidewalks in the Marwyn Addition to the curb line was read. After discussion it was recommended that the request be granted on the following conditions: That water service turn-offs and hydrants be installed inside the sidewalks, I That the lewn between the property line and the sidewalk be maintained by the property owner, That the distance between curbs conform with the city's requirements. and That the sidewalks will not be plowed with the city's snow plows. It was moved by Commissioner Erwin. seconded by Commissioner Swanson, that the request be granted subject to the above conditions, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Purchase of Copper Pipe & Fittings The Manager reported the need of 2000 feet of 3/4" copper pipe and fittings for the Water Department to cost approximately $800.00. It was moved by Commissioner Swanson. seconded by Conunissioner Erwin, tha t the Manager be authorized to make this purchase and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Widening Driveway - Conoco Station - Willson & Olive A request to widen the driveway at the Conoco Station located at Willson and Olive Street to per- mit further use of part of their IJroperty for parking space was reported. It was moved by Commissioner Swanson, seconded by Commissioner Erwin, 1hat the request be granted, and the motion was carried by I the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin. Commissioner Swanson; those voting No, none. Street Light on Mendenhall between 5th & 7th AVenues A request for a street light on Mendenhall Street between Fifth Avenue and Seventh Avenue was reported. It was moved by Commissioner Erwin. seconded by Commissioner Swanson, that the City Manager have the Montana Power Company install an intersection light at this location provided connection can be made, and the motion was carried by the following Aye and No vote: those voting Aye being ~ayor 17 Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Pool Closing - July 3rd & 4th It was announced thet the Swimming Pool would be closed July 3rd & 4th. License for Itinerant Vendors Norris Johnson of the Chamber of Commerce, Ed Leonard and William Hanshaw, local Merchants, I were present to inquire if something could be done by the City to prevent itinerant vendors from selling merchandise in roadside stands that are unsir;.htly and are a fire hazard. They were informed that, if a city license is obtained and other city ordinances are complied with, a vendor can carryon any ligitimate business and that legislation can not be adopted that will limit competition. Report of Director of Finance The report of the Director of :F'inance for the month of May. 1955 was presented. It was moved by Commissioner Erwin, seconded by Commissioner Swanson, that the report be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none. Purchase of Chips for Sealing Pavements For the past five or six years, the city has carried on a policy of sealing; approximately forty blocks of pevemen t per year. This has been done as a part of the regular street maintenance program. Montana State College has requested that, this year, when the city is doing the pavement sealing, it also seal approximately ten blocks of pavement on the campus for which M. S. C. will pay the cost. The Manager reported that chips for seal in!:; C8.n again be purchased from the Gallatin Sand I and Gravel Company at $3. 50 per yard, which is a particularly attractive price and he requested authority to purchase chips from time to time as needed from this company to complete the fifty blocks of pavement sealing. It was moved by Commissioner Erwin, seconded by Commissioner Swanson, that the City Manager be authorized to purchase the necessary chips for pavement sealing during the summer of 1955, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner Swanson; those voting No, none.
