The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday afternoon, August 17, 1956 at 1:00 o'clock P. M. Present were Mayor Lowe,
Commissioner Erwin. Commissioner Swanson, City Manager Henderson, City Attorney Lovelace and the
Clerk. when the following proceedings were had:
I Minutes of the last regular session were read, and it was moved by Commissioner Erwin, seconded
by Mayor Lowe. that these minutes be approved as read, and the motion was carried by the
following Aye and No vote: those voting Aye being Mayor Lowe, Commissioner Erwin, CommlsBioner
Swanson; those voting No, none.
Resolution of Intention to Vacate Alley in Block 7, Fairview Addition
The City Attorney as instructed has prepared the resolution of intention to vacate the east-west
alley in Block 7, Fairview Addition. Resolution No. 792 was presented, entitled:
A RESOLUTION OF THE COMMISSION OF' '!HE CITY OF BOZEMAN, MONTANA, DECLARING IT ro BE mE
INTENTION OF SAID COMMISSION TO VACATE AN ALLEY IN BLOCK SEVEN (7) OF' FAIRVIEW ADDITION
TO THE CI'lY OF BOZEMAN, MONTANA.
It was moved by Commissioner Swanson, seconded by Commissioner Erwin, that the Resolution be
passed and adopted and August 31st. 1955 be set as the date for hearing protests, and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Lowe. Commissioner Erwin,
Commissioner Swanson; those voting No, none.
Encroachment of Warwood Property Block 23, Northern Pacific Addition
Mr. George Horkan, Attorney, was present in the interest of his client, Mrs. Lillie Warwood. who
owns property in Block 23, Northern Pacific Addition. He stated. that at the time title was cleared on

I this property, a strip of ground 30 feet wide and the length ot,her property aou tting Babcock Street,
was included as part of this property and that she has owned and paid taxes on this strip of Babcock
Street fOr at least ten years. The Bridger Development Company has now started to improve streets for
the Marvvyn Addition. and he. ve cut into this strip of ground in Babcock Street, sloped the edge of the
street and made a fill, which is an encroachment on the property claimed by Mrs. Lillie Warwood. Mr.
Horkan stated that Mrs. Warwood is willing to relinquish her rights to this portion of Babcock Street
to the city if the city will, in exchange, vacate a portion of McAdow Avenue abutting her property
at "Colonel's Drive Inn". After consideration, it was decided to look into the matter fUrther to see
what can be worked out.
Motorcycle Patrolman for Police Department
The Manager reported that an arrangement has been made with Charles Masten to do motorcycle
patrolling for the Police Department, and that he is now on duty part time.
Extension of Water Main -- East Main Street for Clyde Cox
It was reported that Mr. Clyde Cox has now decided to have the water main extended on East Main
Street, as per the arrangement made and approved June 15th, 1965.
Budget Ordinance Adopted
'I It was reported that this was the time and place set for the final adoption of the Budget
Ordinance for the fiscal year ending June 30th, 1956. The affidavit of publication of the Ordinance
was presented. There was no one present to protest and no protests having been filed, Ordinance No.
782 was presented, entitled:
AN ORDINANCE APPROPRIATING MON lES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH
BUDGETORY REQUIREMENTS lOR MAINTENANCE Ere., OF THE MUNICIPAL GOVERNMENT OF mE CITY OF
BOZEMAN, MONTANA FOR 'IHE FISCAL YEAR ENDING JUNE 30, 1966.
It was moved by Commissioner Erwin, seoonded by Commissioner Swanson, that the Ordinance be
finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Lowe, Commissioner Erwin. Commissioner Swanson; those voting No, none.

Leave of Absence of Homer Fisher Terminated
.
Communications from Doctors J. D. Morrison and J. T. Schwidde of Billings, Montana andR. G.
Scherer of Bozeman were read stating that after examination. they find the condition of Homer Fisher
/Such that he can resume his duties as fireman. The Commission stated his leave of absenoe heretofore
granted should be terminated as of this date, and tlD.at he return to work as city fireman August 18th,
1955.
Application for Beer License -- Sawyerts Store I
The application of Sawyer's Store for an off-premises beer license was presented. It was moved
by Commissioner Swanson, seconded by Commissioner Erwin, that the application be approved and the
license issued, and the motion was carried by the following Aye and No vote; thes e voting Aye being
Mayor Lowe. Commissioner Erwin, Commissioner Swanson; those voting No, none.
Reports
The following reports fbr the month of July, 1955 were presented;
Direotor of Finance Cashier
and the annual audit of the Gallatin Field Board. It was moved by Commissioner Erwin, seconded by
Commissioner Swanson, that the reports be accepted and ordered filed. and the motion was carried by
the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Erwin, Commissioner
Swanson; those voting No, none.
Social Security
The City Manager was instructed to wri te to other cities in the state to get any information they
have or action they have taken regarding Social Security for their employees.
Adjournment
There being no further business to come before the Commission at this time, it was moved by I
Commissioner Erwin, seconded by Commissioner Swanson, that the meeting adjourn and the motion was
carried by the following Aye and No vote; those voting Aye being Mayor Lowe, Commissioner Erwin,
