July 26, 1961
The Commlssion of the City of Bozeman met in regular session in the Commis-
sion Room, City Hail Building, Wednesday, July 26th, 1961 at l:uu o'clock P.M.
Present Were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City
Manager Cutting, Ass't. City Manager Frys1ie, Acting City iutorney Charles I
Angell, Jr. and the Clerk.
The fOllowing proceedlngs were had:
Minutes of the last regular session were read and it was moved by
Commlssioner Steudaher, seconded by CommiSSioner Sedivy, that the minutes be
approved as read and the motion was carried by the following Aye and No vote:
those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner
Sedivy; those voting No, none.
Appoin tmen t -- City Attorney
Due to the death of Dan R. Lovelace, the City Manager announced his
appointment of Ben E. Berg, Jr., effeotive July 18, 1961, to the office of
Ci ty Attorney. Mr. Berg badl811Wd as Deputy City Attorney .lllOI November
25th, 1959, and the City Manager requested that the Commission approve the
appointment. It was moved by Commlssloner Staudaner, seconded by Commis-
sioner Sedivy, that the appointment be approved and the motion was carried by
the foilowing Aye and No vote: those voting Aye being Mayor ~anson, Commis- I
sioner Staudaher and Commissioner Sedivy; those voting No, none.
Purchase of Copper Pipe
The Ci ty Manager reported that the Water Department has need for an
additional supply of copper pipe as follows:
1500' of 3/4" l!"" - $507.00
200' of 2" - - 218.00
Total - - t725.UO
It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher,
that the City Manager be authorlzed to place an order for the amount specified
above and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher;
those voting No, none.
Report
The following reports for the month of June, 1961 were presented:
Cemetery Director of Pub1io Service
The Clty Manager reviewed the reports with the Commission and reoommended
that the reports be approved and filed. It was moved By Commissioner I
Staudaher, seconded by Commissioner Sedivy, that the reports be approved and
filed and the motion was carried by the following Aye and No vote: those
voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner
Sedivy; those voting No, none.

Petitlon -- SID to Provide Water and Sewer Facilities + North lOth
(Beall to Durston Road)
Action on the petition requestlng that the City Commission create a special
improvement district to provide funds for the construction of' water mains on
North lOth Avenue f'rom Beall Street to Durston Road, and all necessary sewer mains
,I down the alley between North 10th Avenue and North 11th Avenue from Beall Street
to Durston Road, haVing been deferred for further study at the July 19th, 1961
meeting of the Commlsslon, Junior W. Tschache appeared before the Commission to
discuss the matter. After a lengthy discusslon of the matter, the City Manager
recommended that, due to the individual merits of the area involved, that the
Commission proceed to oreate the district. It was moved by Commissioner SediVY,
seconded by Commissioner Staudaher, that the City Engineer prepare the necessary
data and, based on this information, the City Attorney be instructed to prepare
a;,reaolu1:1on:'iof intention to create the district and the motion was oarried by
the fOllowing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Sedivy and Commissioner Staudaher; those voting No, none.
Budget f'or 1961-1962 -- Ordinance No. 833
Based upon the proposed budget as tentatively approved, Ordinance No. 833
was presented, entitled:
ORDINANCE NO. ~
AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED
NECESSARY AND IN ACCORDANCE WITH BUDGETARY REQUIREMENTS FOR
I MAINTENANCE ETC., OF THE 15UNICIPAL GOVERNMENT OF THE CITY OF
BOZEMAN, MONTANA FOR THE FISCAL YEAR ENDING JUNE 30th, 1962.
It was moved by,Commlssioner Staudaher, seconded by Commissloner Sedivy,
that the ordinance be provlsiona1ly passed and August 2nd, 1961 be set as the
date for public hearing and the motion was carried by the following Aye and No
vo te : those voting Aye being Mayor Swanson, Commissioner Staudaher and Commis-
sloner Sedivy; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time,
it was moved by Commissioner Sedivy, seconded by Commissloner Staudaher, the t the
