The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall
Building, Wednesday, August 2nd, 1961 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner
Staudaher, Commissioner Sedivy, City Manager Cutting, Assistant City Manager Fryslie, Acting City
Attorney Charles F. Angel and the Clerk. I
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner Sedivy, seconded
by Commissioner Staudaher, that the minutes be approved as read and the motion wa.s carried by the
following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and
Commissioner Sedivy; those voting No, none.
Request -- W. S. Stutsman
w. S. Stutsman appeared before the Commission to discuss the matter of his securing permission
to build a dwelling on a 50' X 100' lot located at 911 W. Story Street. The City Manager stated that
since this property is in an "A" Residential District Zone as defined by the Bozeman Municipal Code,
it does not meet the minimum requirements for yard area or frontage, and for that reason Mr. Stutsman
should seek relief from the Board of Adjustment rather than the City Commission. The members of the
Commission concurred.
Resolution No. 1022 -- Intention to Create Special Improvement District No. 422
As instructed during the meeting of the Commission on July 26th, 1961, the City Attorney has
prepared a resolution of intention to create Special Improvement District No. 422. Commission Resolution
No. 1022 was presented, entitled: I

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE
THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN
AS SPECIAL IMPROVEMENT DISTRICT NO. 422 TO THE CITY OF BOZ>>fAN FOR THE PURPOSE OF CON-
STRUCTING AND INSTALLING A WATER MAIN ON NORTH TENTH AVENUE FROM WEST BEALL STREET TO
DURST ON ROAD AND FOR THE FURTHER PURPOSE OF CONSTRUCTING AND INSTALLING A SEWER MAIN IN
THE NORTH-SOUTH ALLEY BE'1'WEIm NORTH TENTH AVENUE AND NORTH ELEVENTH AVENUE EXTENDING FROM
WEST BEALL STREET TO DURSTON ROAD, INCLUDING THE NECESSARY PIPE LINES, MAN HOLES, DRAIN
INLETS, AND OTHER NECESSARY APPURTENANCES AND WORK INCIDENTAL THERETO.
The City Manager recommended that the Commission adopt the resolution, and it was moved by
Commissioner Staudaher, seconded by Commissioner Sedivy, that the resolution be passed and adopted and
August 23rd, 1961 be set as the date for public hearing and the motion was carried by the following
Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner
Sedivy; those voting No, none.
Public Hearing Annual Budget
This was the time and place set for public hearing on the Appropriation Ordinance No. 833 for
the fiscal year ending June 30, 1961.
Affidavit of publication of notice of hearing was presented. No one was present to be heard on
the proposed ordinance and accompanying annual budget and no one had made inquiry or protest regard- I
ing it. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the Clerk of
the Commission be authorized and directed to have the Ordinance published, August 4, 1961, as
required by law and the motion was carried by the following Aye and No vote: those voting Aye being
Mayor Swanson, Commissio~er Sedivy and Commissioner Staudaher; those voting No, none.
Bonds for City Officials
Renewal of annual bonds of the following persons in the amounts and for a one year tenn beginning
on the dates shown opposite their respective names were presented:

The bonds were approved as to form by the Acting City Attorney, and it was moved by Commissioner
Staudaher, seconded by Commissioner Sedivy, that the bonds be approved and accepted and filed and
the motion was carried by the following Aye and No vot'e: those voting Aye being Mayor Swanson,
Commissioner Staudaher and Commissioner Sedivy; those voting No, none.
I Appointment of Judges and Clerks for 1961 Elections
The Clerk of the City Commission presented for the consideration of the Commission a suggested
list of electors for appointment as Judges and Clerks for the Primary Election and the General
Municipal Obligation Bond Election on August 29th, 1961, and the General Election on November 7th,
1961, as follows:

The City Manager stated he had audited the claims and found them to be true and lawful claims
against the City of Bozeman and recommended that they be approved and warrants issued for their pay~
ment. After examination of the claims in detail and checking against the claim register, it was
moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that all claims be approved and the
motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner
Staudaher and Commissioner Sedivy; those voting No, none. I
Settling Basin Fence -- Completion of Contract
During the Commission meeting, May 10th, 1961, the City awarded to the Colorado Fuel & Iron Corp.,
Salt Lake City, Utah, a contract to furnish the material and labor for the construction of a fence of
the chain link type at the Settling Basin. The City Engineer reported that the contractor had satisfac-
torily completed the contract and recommended that it be finally accepted and approved. The City
Manager concurred in the City Engineer's recommendation and it was moved by Commissioner Staudaher,
seconded by Commissioner Sedivy, that the City accept the contract as completed and full and final
payment in the amount of $3,957.00, the bid of the contractor, be authorized. The motion was carried
by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and
Commissioner Sedivy; those voting No, none.
Commissioner Sedivy Excused -- 1:45 P. M.
Bond & Contract S. I. D. No's. 419 & 421
The contract documents for construction of Special Improvement District No's. 419 and 421,
awarded to the Kiely Construction Company, were presented. The contract and bond were approved as to
form by the Acting City Attorney and it was moved by Commissioner Staudaher, seconded by Mayor Swanson,
that the Mayor and the Clerk of the Commission be authorized to sign the contract for the City of I
Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Mayor
Swanson and Commissioner Staudaher; those voting No, none.
Reports
The following reports were presented:

The City Manager reviewed the reports with the Commission and recommended that the reports be
approved and filed. It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the
reports be approved and filed and the motion was carried by the following Aye and No vote: those voting
Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none.
Utility Service Connections -- Parochial High School
Tom Haggerty, Frank Messmer and Joe Gary appeared before the Commission to present the request
of the Holy Rosary Church that, in the event they proceed with the construction of a new high school
on the property west of Fifteenth Avenue, that permission be granted for connecting to the City's
water supply system to provide water for the school and to, also if possible, hook on to the City's I
sewage disposal system. The City Manager recommended that the Church, at ita expense, be allowed
to tap the City's water supply system, but that, until further study is made, he was not prepared

to make a recommendation as to the Church being permitted to tie onto the City's sewage disposal
system. It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the Church be per-
mitted to tap the City's water supply system as recommended by the City Manager and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner
Staudaher; those voting No, none.
