Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager I Cutting, City Attorney Berg and Ass't. City Manager Fryslle. Designatlon of Actlng Clerk of the Commission Due to the absence of the City Clerk, it was moved by Commissioner staudaher, seconded by Commissioner Sedivy, that Harold A. Fryslie be designated as Acting Clerk of the Commission for this date. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudsher and Commissioner Sedivy; those voting No, none. The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye be- ing Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Request -- AMC to Vacate Alleys A letter received from the AMC Corporation which requested that the City vacate I the alleys in Block 100, of the Northern Pacific Addition to the City of Bozeman was placed before the Commlsslon. After discusslon, it was moved by Commlssloner Sedi vy , seconded by Commissioner Staudaher, that this City Commisslon hereby assures w. J. Sullivan and the Allled Manufacturing Corporatlon that it will, upon satis- factory showing of the need for occupany of all alleys in Block 100, Northern Paci- fic Addition to the City of Bozeman for construction of an Industrial plant, commence proceedings for vacation of said alleys. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedlvy and Commissioner Staudaher; those voting No, none. Request for Alley Change -- Charles W. Lacey The City Manager presented a letter addressed to him written by Charles W. Lacey which requested that the City of Bozeman trade approximately eight feet of the north side of the alley adjacent to the south line of his prrrerty, LQt 3, Block 2, Royal Vis ta :.c:..dl tion, for an equal amount of land adjacent to the south line of the exlst- Ing alley. He based his request that such a trade would increase the size of lot e, preserve landscaping now encroaching on the ailey and correct an error made by the I former owner of the property. After discussion of Mr. Lacey's reques t, i t wa s moved by Commissioner Staudaher, seconded by Mayor Swanson, that It be denied and the City Manager instructed to notify him of Its declsion. The motion WQS carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commis- sioner Staudaher; Commissioner Sedivy voting No. (Continued followlng page.) .lfi2 Request of Director of Finance -- Investment of Funds During the previous meeting of the Commission, it approved the request of the - Director of Finance to Invest funds of the Sewer Revenue fund in the amount of $26,000 in u.s. Treasury Bills maturing on February 18th, 1962. The Director of Finance has now, in turn, requested that the above mentioned funds be placed in the First National Bank of Bozeman, Montana, on a six month's certificate of I deposit, rather than invested in the aforementloned securities. It was moved by Commlssioner Staudaher, seconded by Commissioner Sedivy, that the request be grant- ed and the motlon was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner SedivYj those voting No, none. Request of Director of Flnance -... Investment of Funds The Ci ty Manager reported tha t the Dlrector of Finance has requested per- mission to invest $172,000 of miscellaneous operational funds, not presently needed for current operations, in U.S. Treasury Bills maturlng In various amounts as follows: September 28, 1961 November 24, 1961 October 26, 1961 December 28, 1961 It was moved by Commissloner Sedlvy, seconded by Commissioner Staudaher, that the request be granted and the motlon was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaherj those voting No, none. I Public Hearing ...... Special Improvement District No. 422 (Water & Sewer Mains - North 10th Ave.) This was the time and place as set by Commission Resolution No. 1022 to hear protests to the creation of Special Improvement Dlstrict No. 422. Affidavit of publication of Notice, together wlth the Clerk's Mailing Certificate that all property owners had been notified as required by law, were presented. No written protests were on file and no one appeared to protest the creation or the extent of the district. The City Manager recommended that the district be created. The City Attorney, as instructed, had prepared a resolution creating Special Improve- ment District No. 422. Resolution No. l024 was presented, entitled: COMMISSION RESOL1~ION NO. 1024 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPRO\~MENT DISTRICT TO BE KNOWN AS SPECIAL, IMPROVEMENT DISTRICT NO. 422 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A WATER MAIN ON NORTH TENTH AVENUE FROM WEST BEALL STREET TO DURSTON ROAD AND FOR THE FURTHER PURPOSE OF CONSTRUCTING AND INSTALLING A SEWER MAIN IN THE NORTH "'SOUTH ALLEY BETWEEN NORTH TENTH A VENUE AND NORTH ELEVENTH AVENUE EXTENDING FROM WEST BEALL I STREET TO DURSTON ROAD. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the resolution be passed and adopted and the motlon was carrled by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaherj those voting No, none. Authority to Repair Commtnutor (Grinder) Sewage Disposal Plant The Clty Manager reported that the 25M Comminutor at the Sewage Disposal ,If'3 j~ Plan t, in continuous service for the past twelve years, had been shlpped by the City to the Chicago Pump Company for repairs, who estimated the cost of complete repair of the unit would be $1,920.00, followlng whlch the communi tor would be returned to the City with full warranty of a re-built machine. The City Engineer recommended that, in view of the warranty, the unit be repaired on the warranty I vasis at cost not to exceed $2,000.00 and the City Manager concurred in the recom- mendation. It was moved by Commissioner Staudaher, seconded by Commissioner Sedlvy, that the Gommlssion authorize the City Manager to have the Chlcago Pump Company repalr the unit as recommended and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissloner Staudaher and Commis- sloner Sedivy; those voting No, none. Authority to Attend Conference of Building Officials, Sea ttle, Wash., Bldg. Insp. The City Manager reported that a Conference of Building Officials is sched- uled to be held in Seattle, Washington, Septermber 25-29, 1961. He recommended the City Buildlng Inspector Barrick be authorlzed to attend the conference. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, tha t, i t being in the public interest, the Clty Building Inspector be authorized to attend the conference and hls expenses incurred be pald out of the General Fund. The motion was carried by the following Aye and No vote: those votlng Aye being Mayor Swanson, Commissioner Sedlvy and Commissioner Staudaher; those voting No, none. I Authority to Attend a Meeting of the Federal Water Pollution Control Advisory Board The City Manager reported that the Federal Water Pollution Control Advisory Board has extended an invltation to the City of Bozeman to be represented at its meeting to be held In western Montana on September 20, 2l and 22, and recommended that the City be represented at the meeting. It was moved by Commissioner Staudaher, seconded by Commissioner Sedl vy" tha t the Mayor, the City Manager and the City Engineer be authorized to attend the meeting, and tha t, it belng In the public Interest, their expenses incurred be paid out of the Water Fund. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commlssloner Staudaher and Commissioner Sedivy; those voting No, none. Report on Planning Officla1s -- Yellowstone Park Clty Engineer Liquin reported on his attendance at a meeting of Planning Officials at Yellowstone Park, Wyoming, August 18, 19 and 20. It was moved by ". Commissioner Sedivy, seconded by Commissioner Staudaher, tha t the report be accepted and approved and the Engineer commended for hls report. The motion was carried by I the following Aye and No vote: those voting Aye being Mayor Swanson, Commiss1oner Sedivy and Commiss1oner Staudaher; those voting No, none. Presentation of 1961-l962, Budget The City Manager presented completed copies of the 1961-1D62, budget to the Commlssion. This budget having been approved and accepted by the Commission durlng previous meetings, no further action was required or taken. .1fiil State Gasoline Tax Refund Claim A claim for refund of State Gasoline Tax for gasoline used by the Clty in the amount of $1,389.60 was presented. The City Manager requested that he be author- ized to sign the claim in behalf of the Clty. It was moved by Commissioner I Staudaher, seconded by Commissioner Sedivy, that the authorization be granted and the motion was carrled by the following Aye and No vote: those voting Aye be- ing Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; thos e vo ting No, none. Sidewalks -- Settling Basin The City Manager stated there is a need at the Settling Basin for a side- walk to be constructed along the north side and east end of the basin whlch could be constructed under the contract awarded to Andrew H. Anderson for Walk and Curb constructlon for the year 1961. It was estimated that under the contract the cost of the improvement would be in the approximate amount of $1,200.00 and authority to proceed with this construction was requested. It was moved by Commissloner Sedi vy, seconded by Commissloner Staudaher, that the improvement be authorized and the motion was carried by the followlng Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedlvy and Commlssioner Staudaher; those voting No, none.
