September 13. 1961 at 1:00 o'clock P.M. Pre- sent were Mayor Swanson, Commissioner Staudaher, Commissioner sedivy. City Manager Cutting. City Attorney Berg. Ass't. City Manager Fryslie and the Clerk. I The following prooeedings were had: Minutes of the last regular session were read and it was moved by Commissioner Sedivy. seconded by Commissioner Staudaher. that the minutes be approved as read and the motion was carried by the following Aye and No vote: those vo ting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Resolution No. 1025 -- Sprinkling Assessment Resolution No. 1025, levying the assessment in the total amount of $6,934.11 for street sprinkling for the year 1961 was presented; entitled: COMMISSION RESOLUTION NO. 1025 - A RESOUJTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, COUNTY OF GALLATIN. STATE OF MONTANA, TO DEFRAY SEVENTY-FIVE PERCENT OF THE COST OF SPRINKLING STREETS WITHIN SAID STREET SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN FOR THE YEAR 1961. The City Manager recommended that the resolution be provisionally adopted in I compliance with the provisions of Seotion 11-2263 to 11-2267 inclusive. R.C.M., 1947. and the Bozeman Municipal Code. It was moved by Commissioner Staudaher. seconded by Commissioner Sedivy. that the resolution be provisionally adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson. Commissioner ~taudaher and Commissioner Sedivy; those voting No. none. Reso 1u tion No. 1026 -- Noxious Weeds Resolution No. 1026, levying a special assessment in the total amount of $218.50 to defray the oost of exterminating and the removal of noxious weeds from various property within the City for the year 1961 was presented. entitled: COMMISSION RESOLUTION NO. 1026 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVY- ING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CER- TAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN" STATE OF MONTANA. TO DEFRAY THE COST OF EXTERMINATION AND REMOVAL OF NOXIOUS VffiEDS FOR THE YEAR 1961 PURSUANT TO THE PROVISIONS OF CHAPTER 6.50 OF THE BOZEMAN MINICIPAL CODE. Commissioner Sedivy and Commissioner Staudaher; those voting No, none. .17:3 Commissioner sedivy, at his request. was excused from the meeting. Mobile Soft Ice Cream Unit -- Patricia Anderson During the regular meeting of the Commission held August 30. 1961. the Commis- sion tabled action on the request of Miss Patrioia Anderson to operate a Mobile 30ft Ice Cream unit within the City Limits. The City Manager stated that a further study I of the matter did not disclose any basis for a denial of the request. It was moved by Commissioner Staudaher. seoonded by Mayor Swanson, that Miss Anderson's request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and commissioner staudaher; those voting No. none. Request -- Street Light at Intersection of Fifth Avenue and Hayes A petition requesting the City to plaoe a street light at the intersection of Fifth Avenue and Hayes Street was presented. The City Manager reported that a study of this area in regard to street lighting has been made and the situation at this intersection was not oonsidered to be serious enough to warrant or recommend installation of a new street light at this time. The Commission instructed the City Manager to cheok with the Montana Power Company regarding the possibility of increasing lumination of the existing lights located one block south and one block nortli of the interseotion. It was moved by Commissioner Staudaher. seconded by Mayor Swanson. that the petition be denied and the motion was carried by the follow- ing Aye and No Yote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. I Reports The following reports for the month of August. 1961 were presented: Police Judge Cashier Fluorida tion Wa ter Collec tor The City Manager commented on the reports and stated they appeared to be in order and recommended that the reports be approved and ordered filed. It was moved by Mayor Swanson. seconded by Commissioner Staudaher. that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No. none. Reque fl t -- Transfer of Invested Fund, (Direotor of Finance* The City Manager reported that the Direotor of Finance has requested author- ization to exchange $4.000 of Police Reserve Funds now invested in U.S. Treasury Bonds at 2~ for Treasury Bonds drawing an interest rate of 3~~ maturing during 1980 . The City Manager recommended that the exohange of securities be authorized. It was moved by Commissioner ~taudaher. seoonded by Mayor Swanson. that the exchange I of the securities be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner ~taudaher; those vo ting No, none. Payroll -- Bozeman City Band The City Manager placed before the Commission a claim in the amount of $1,773.50 filed by the Secretary of the Bozeman City Band Which represented payment to members '17L1 of the band for concerts played during the month of August. It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the claim be approved and the Director of l<'lnance directed to issue a warrant in payment. The motion was carried by the following aye and No vote: those voting Aye being Mayor Swanson and Commis- I sioner Staudaher; those voting No, none. Special Commission Meeting The City Manager pursuant to the provisions of Section 11-3249. R.C.M., 1947 and Section 2.08.060. Bozeman Municipal Code, announced that he had scheduled a meeting of the city Commission to be held Thursday, September, 14~. 1961 at 8:00 A.M., for the purpose of the reconsideration of the City "Building Facilities Program".
