SUBJECT: Authorize Mayor to sign Commission Resolution No. 4796, which allows the City of Bozeman to give its obsolete crack-sealing machine to the Gallatin County Road Department.

RECOMMENDATION: That the Commission authorize the Mayor to sign Commission Resolution No. 4796 which allows the City of Bozeman to give its crack sealing machine to the Gallatin County Road Department.
BACKGROUND: The Street Department recently replaced its obsolete crack-sealing machine
and needs to dispose of the old one. Gallatin County Road Department has asked for the old
machine rather than sending it to scrap.

ALTERNATIVES: None
FISCAL EFFECTS: Maximum scrap value is $60.00.

COMMISSION RESOLUTION NO. 4796
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN
TO GIVE OUR OBSOLETE SURPLUS CRACK SEALING MACHINE FROM THE
STREET DEPARTMENT TO A COUNTY OR OTHER POLITICAL SUBDIVISION
WITHIN THE STATE OF MONTANA.
WHEREAS, the City of Bozeman has acquired a new replacement crack-sealing
machine in FY17; and
WHEREAS, the City of Bozeman no longer has a need for the obsolete crack-sealing
machine; and
WHEREAS, Section 7-8-101(2), Montana Code Annotated, grants the City of Bozeman
the power to dispose of any property which is not necessary for the conduct of the City business
to any county or other political subdivision without an ordinance, public auction, bids or appraisal.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana:
Section 1
That it is hereby declared to be in the best interests of the City of Bozeman to dispose
of the obsolete crack-sealing machine to Gallatin County, a political subdivision of the State of
Montana.
Section 2

That, pursuant to Section 7-8-101, M.C.A., the City Clerk shall cause notice to be
published in the Bozeman Daily Chronicle at least once a week for three (3) successive weeks,
which notice shall be to the effect that such Resolution has been duly and legally passed and
further expressing the City’s intent to dispose of the item listed in Section 1, in the manner
described herein.
PASSED AND APPROVED by the City Commission of the City of Bozeman,
Montana, at a regular session thereof held on the 10th day of April, 2017.
