Removal of Board Members with Incomplete 2016 Ethics Training Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Robin Crough, City Clerk Anna Rosenberry, Assistant City Manager SUBJECT: Removal of Citizen Advisory Board Members with Incomplete 2016 Ethics Training MEETING DATE: April 10, 2017 AGENDA ITEM TYPE: Action RECOMMENDATION: Remove the two Citizen Advisory Board members that did not complete the annual 2016 City of Bozeman ethics training for all city officials, city boards and employees. RECOMMEND MOTION: I move to remove Daniel Doehring from the Northeast Urban Renewal Board with a term expiring July 31, 2017, and Sandra Hodge from the Bozeman Tourism Business Improvement District with a term expiring on July 31, 2017. BACKGROUND: The City Charter (Section 7.01(b)) requires the City Commission to appropriate sufficient funds annually to the City Manager so that all city officials, city boards, and employees complete an annual ethics training regarding state and city ethics codes. This year’s training was an in-person training conducted by the Montana State University Local Government Center. The City Clerk’s Office coordinated four trainings over the course of October and November 2016 with board-specific content. In order to provide an opportunity for all members to participate, a make-up session was also conducted in December 2016. Weekly emails were sent out to ensure all board members participated. The Deputy Clerk also called individuals to encourage attendance, and staff liaisons were contacted to communicate this requirement with their boards. As of March 2017, since there was still a handful of members yet to complete the training, the online ethics training from 2015 was made available and resent for members to complete by March 27th, 2017. In September of 2012, with the passage of Ordinance No. 1833, the Bozeman Municipal Code was amended to include a statement that the City Clerk shall forward to the Commission annually a list of appointed officials who fail to take the required training under Bozeman Municipal Code section 2.03.600.A.14(b) and the Charter. The Commission may remove an appointed official for failing to comply. 368 The City Clerk does not have record of the following two individuals completing the in-person training in the fall of 2016, and has also confirmed with MSU Extension that they did not create an account or complete the final online training: Name Board Term Expiring Daniel Doehring Northeast Urban Renewal Board July 31, 2017 Sandra Hodge Bozeman Tourism Business Improvement District July 31, 2017 UNRESOLVED ISSUES: None.
