September 27. 1961 at 1:00 o'clock P. M. Present were Mayor Swanson, Commissioner Staudaher. Commissioner Sedivy, City Manager Cutting, City Attorney Berg, Assistant City Manager Fryslie and the Clerk. I The following p~oceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedi V';)~ and Commissioner Stnudaher; those voting No. none. Resolution No. 1027 -- Garbage Assessment for the Year 1961 This was the time and place set for hearing on levying assessment for the collection and disposal of garbage for the year 1961 in the amount of $59.918.09. Affidavit of publication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. 1027. as presented and provisionally passed at the meeting of September 20th, 1961, was presented for final passage. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson. Commissioner Staudaher and Commissioner Sedivy; those voting No, None. Resolution No. 1028 -- Assessing W & C, 1961 Proposed Resolution No. 1028 assessing cost of repair. replacement or construction of sidewalk I for the year 1961 in the amount of $3,655.69 was presented. entitled: COMMISSION RESOLUTION NO. 102~ A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESS- MENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF . MONTANA. TO DEFRAY THE COST OF CONSTRUCTING AND INSTALLING AND/OR REPAIRING MISCELLANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1961- It was moved by Commissioner Sedivy. seconded by Commissioner Staudaher, that the resolution be provisionally passed and adopted and October 4th. 1961 be set as the date for hearing ahd themot.ion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No. none. Resolution No. 1029 -- Assessing S. I. D. No. 418 - Provisional Passage Resolution No. 1029 levying assessments for construction of Special Improvement District No. 418 in the amount of $241.462.10 was presented. entitled: COMMISSION RESOLUTION NO. 1029 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. h18 IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA. TO DEFRAY THE COST OF CON- STRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVE}~NT DISTRICT NO. 418. It was moved by Conunissioner Stal1daher. seconded by Commissioner Sediv~r, that the resolution be I provisionally passed and adopted and October 4th. 1961 be set as the date for pnblic hearing. The motion was carried by the following Aye and No vote: those voting Aye being MAyor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Resolution No. 1030 -- Lighting Assessment - 1961 Resolution No. 1030 levying the assessment in the amount of $3.870.73 for various lighting districts for the year 1961 was presented, entitled: COMMISSION RESOLUTION NO. 1030 .18'0 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN. MONTANA, LEVYING AND ASSESSING LIGHT- ING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS OF THE CITY OF BOZEMAN, PURSUANT TO THE PROVISIONS OF SECTIONS 11-2252. R.C.M., 1947. It was moved by Commissioner Sedivy. seconded by Commissioner Staudaher, that the resolution be pro- visionally passed and adopted and October 4. 1961 be set as the date for public hearing of protests and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No. none. I Montana Municipal League Meeting -- Havre, Montana (September 7-9, 1961) Commissioner Staudaher, Commissioner Sedivy and the City Manager reported on their attendance at the Montana Municipal League Meeting held at Havre, September 7th, ~h and 9th. The report included a description of the meeting. its attendance and the values to be derived by the City in having representatives at meetings dealing with municipal problems and their solution. Application for City License -- Used Car Lot -- Clinton A. Cain An application for a City License submitted by Clinton A. Cain to operate a used car lot at 819 E. Hain Street was placed before the Commission. The application was accompanied by a rough sketch of the location and layol~ of the proposed lot. The application had been approved by the City Building Inspector as to the business' general operations and location. After advising Mr. CA.in he would be expected to conform to all ordinance provisions for the maintenance of an orderly lot at this particu- lar location, the City Manager stated there appeared to be no objections to the issuance of the license and it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the application be approved and a. City License issued. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson. Comm:issioner Staudaher and Commissioner Sedivy; those voting No. none. Report of Attendance -- Federal Water Pollution Control Advisory Board I The City Manager and the City Engineer reported on their attendance at the Federal Water Pollution Control Advisory Board's meetings at Missoula and Butte, Montana, September 20th to 22nd, inclusive. The;y reported that the control of pollution in the waters of streams. rivers and lakes has become a major national problem and although the City of Bozeman is very well situated and :its facilities are modern and adequate at the present, Bozeman should, at all times, be aware of the seriousness of the problem and support the pollution control programs, both State and Federal, in order to safeglJard its sources of water supply and the other clean waters of this area. Disposal Plant -- Final Acceptance of Contract (Project WPC-Mont-50) Harold Hoskins and Associates. consultant engineers. and the City Engineer reported that all work under the City's contract with the Haggerty-Messmer Co. for improvements and repairs to the City Disposal Plant (Project WPC-Mont-50) has been completed in accordance with the plans and specifications and recommended that the City appr-ove and accept the work. The City Ml'mager concurred in the recommenda- tion. contingent on final audit of the contract by the Water Pollution Control Agency of the U. S. Public Health Service. and it was moved by Commissioner Sedivy. seconded by Commissioner Staudaher, that the centract be approved as completed as recommended by the City r.~anager. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson. Commissioner Sedivy and I Commissioner StalJdaher; those voting No, none. C. P. A. Examination & Report of Water Department - 1961 The 1961 report of the eX8Jllination of the records and operat:iom~ of the City 'dater Depart.ment prepared by H. H. Kirchtloff. C. P. A., was presented. AfLer a revJei^r of the report by the Direct.or cf Finance and following the recommendation of the City Manager and the Director of Finance, it was moved by Commissi()ne~' St,;11;daher. seconded b:'l Commissioner SedivJ', that the report be approved and filed. The motion was carried by the following Aye and No vote: those voting Aye being Mayor .181 Swanson. Commissioner St.audaher and Commissioner Sedivy; those voting No, none. Plans and Specifications for S. I. D. No. 422 -- Bid for S. I. D., No. 422 PIA,ns and specifications covering the proposed improvement. in Special Improvement District No. 422 prepared by Harold Hoskins and Associates. supervising engineers, were placed before the City Commission. The City Engineer stated the engineer's estimate of the total cost of the project I in the district is $21,000.00 and he recommended that the plans and specifications be approved and the City issue a "Call for Bids" for the work. The City Manager concurred in the City Engineer's recommendation and it was moved by Commissioner SediVJ'. seconded hy Commissioner Staudaher. thR,t the plans and specifications be approved and the Clerk of the Commission be directed to publish a "Call for I3ids" on the proposed improvements for District No. 422 for an opening date of October 11, 1961. The motion was carried by the following Aye and No vote: those voting Aye being Mayor S14"mson. . Commissioner Sedivy and Commissioner Staudaher; those voting No. none. Bonds for S. I. D., No. 422 Bonds of Special Improvement District No. 422 must be sold to provide .:unds for financing the proposed construction in the district. It W<lS moved by Commissioner StRudaher, seconded b;y Commissioner Sedivy. that the Clerk of the Commission be directed to advertise for bids for the sale of bonds of this district in the approximate amolmt of $21,000.00 on November 1. 1961, and the motion was carried by the following Aye and No vote: those voting A~re being Hp;yor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Reports The following reports were presented: I Director of Public Service (July & August) Director of Finance (August) The City Manager reviewed the reports with the Commission and recommended that the reports be approved and filed. City Building Facilities -- Progress Report A report was made by the City M<lnager of the progress being made on steps taken in preptl.ration of the revised building progr<lffi to be presented to the voters on November 7th, if sufficient signatures are obtained on petitions now being circul<lted. Comment was made on "Letters to the Editor" appearing in the local press and the continuing problem of finding an effective meR-ns of dissemination of information to the public.
