Montana Oct. 4th, 1961 The ComDdss1on of the City of Bozeman met in regular session 1n the Commis- sion Room, City Hall Building, Wednesday, October 4th, 1961 at 1:00 o'clock P.M. Present were Mayor Swanson, Commiss1oner Staudaner, Commissioner Sedivy, City Manager Cutting, City Attorney Berg, Ass't. City Manager Fryslie and the Clerk. I The fOilowlng proceedings were bad; Minutes of the iast regular session were read and it was moved by COmmi8- sioner Staudaher, seconded by Commissioner sedivy, that the minutes be approved as read and the motion was carried by the tollowing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No; none. Resolution No. 1028 -- Assessing W & C. 1961 This was the time and place set for public hearing on levying assessment for cost of repair, replacement or construct1on of sidewaikE for the year 1961. Atfidavit of pubiication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. lu28, as presented and provisionaliy passed at the meettng of September. 27th, 1961 was presented for final passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seoonded by Commissioner Staudaher, that the reso- lution be fina~ly passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and I Commissioner Staudaher; those voting No, none. Resolution No. 1029 -- Final Passage -- S.I.D., No. 418 This was the time and place set for hearing protests to levying assessment for Special Improvement District No. 418. Affidavit of publication of Notice was presented. No one was present to protest and no protests having been tiled, Resolution No. lu29, as provisionaliy passed and adopted at the regular meeting held September 27, 1961, was presented tor tinal passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Comndssloner Sedivy; those voting No, none. Resolution No. 1030 -- Lighting Assessment Tbis was the time and plaoe set tor public hearing on levying assessment tor the various lighting d1stricts tor the year. 1961. Affidavit of pubiication I of Notice was presented. No one was present to protest and no wr1tten protests having been filed, Resolution No. lU30, as presented and provisionally passed and adopted at the meeting ot September 27. 1961 was presented for final passage. Fire Prevention Week -- October 8-14, 1961 Fireman Jack Huber appeared before the Commission to request that Mayor Swanson issue a prociamation proclaiming the week of October 8-~4, 1961 ~o be known as fire prevention Week. Fireman Huber, in turn, outlined the program planned for the week. I Report of Attendanoe -- Building Officials Conferenoe -- Sea t tle City Building Inspector Donald H. Barrick reported on his attendance at tne Building OffioiaLs Conference a t Seattle, WaShington, during September 24-30. 1961. ~he report included a description of the meeting, its attendance and the major topics of interest such as additions, deletions and amendments to the Uniform Building Code. The City Manager stated that the attendance at such a meeting by a representative of the City is of paramount importance if Bozeman is to keep pace with new and modern construction trends. Request -- Red Heart Tag Sale A request from the Women of the Moose to stage its "Red Heart Tag Sale" on Saturday, October 2~, 1961, was presented. 'J:he City Manager recommended that the request be granted and it was moved by Commissioner Staudaher, seconded by Commis- sioner Sedivy, tha t the reques t be granted and approved and the motion 1I8.S carried by the fOllowing Are and No vote: those voting Aye being Mayor Swanson. Reports I The following reports tor September were presented: Fluoridation Disposal Plant Opera. tor BUildi~ Inspector Water Collector Librarian Police hiet Fire Chief Police .fudge Casnier The City Manager stated the reports appeared to be in order and recommended that they be approved and ordered tiled. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner 8taudaher; those voting No, none. Street Light -- Intersection ot Montana & Aspen The City Manager reported that residents in the immediate area of the inter- section ot Montana and Aspen have requested that the City install a street light at the intersection. The City Manager stated that a study of the matter has indicated tha t the reques t should be gran ted. He recommended tha t he be authorized to notify the Montana !'ower Company to install a light at that location. It was moved by Commis- sioner Staudaher, sedonded by Commissioner Sedivy, that the Montana Power Company be notified to install a mercury vapor light of the "dusk-todawn" type at the inter- I sac tion of Montana and Aspen and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Co~ssioner ~taudaher and Commissioner Sedivy; those voting No, none. S.I.D.. No. 419 -- Acceptance of Contract The certificate of the engineer on Special Improvement Distriot No. 419, Harold Hoskins & Associates, stating the construction of the paving nad been completed in accordance with the terms and specifications of the contract by the contractor, Keily ,tHit Construction Company, and recommending tnat ~e City accept and approve the project as oomp~eted was placedbef.ore the Commission. The City Manager concurred in the recommendation of the engineer and stated it had been determin-ed that all known valid claims against the contractor resulting from the construction have been paid. It was moved by Commissioner Sedivy. seconded by Commissioner Staudaher, that tne work under the contract with Kiely Construction Co. for Special ImprovementDlstrict I No. 419 be approved and aocepted as oompleted and the motion was carried by the .. following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No. none. S. I .D . No. 421 -- Acoeptance of Contract The certificate ot the engineer on Special Improvement District No. 421, Harold Hoskins & Associates, stating the construotion ot paving had been completed in acoord- ance with the terms and specifications of the oontract by the contractor, Kiely Construction Company, and recommending that the City accept and approve the project as completed was placed before the Commission. The City Manager concurred in the recommenda tion ot the engineer and sta tad it had been determined tha t ail known valid claims against the contractor resulting from the construction have been paid. Care 5U.UO Total $104,883.03 The City Manager stated he had audited the claims and found them to be true and lawful claims against the City of Bozeman and recommended that they be approved and warrants issued for their payment. After examination at the claims in detail and checking against the claim register. it was moved by Commissioner Staudaher, seconded . :1 by Commissioner Sedivy, that al~ claims be approved and the motion was carried by the foilowing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. . City Building Facilities -- Progress Report ~he City Manager reported that the petition now being circulated to place the .,,-, question of issuing genera~ obligation bonds to provide funds for the proposed constr- uction of new City Building Facilities is progressing satistactor11y, and 1t is estimated .183 tha t of some 4260 eligible voters there are now approxima tely 9UO valid signatures on the petition. It was also reported that progress was being made on the re4esign of the proposed City Hall. City Building Facilities -- Letter to Citizen's Committee A letter dated today and addressed to W. C. Hansnaw. Cnairman of the iocal I Citizen's Committee. 1n answer to sixteen questions in regard to the City Building Pacilites ~rogram submitted by the Comudttee. and dratted as direoted by the City Commission was presented. It was moved by Commissioner SedlV7-f: seconded by Commis- sioner Staudaher. that the letter be approved and mailed and the motion was carried by the following AJe and No vote: those voting Aye being Mayor Swanson, Commis- sioner Sedivy and Commissioner Staudaner; those voting No. none.
