The Commission of the City of Bozeman met in regular session in the Commission Room, City H."lll
Building, Wednesday, October l~th, 1961 at 1:00 o'clock P. M. Present were Mayor Sw;:mson, Commissioner
Staudaher. Commissioner Sedjvy, City Manager Cutting. City Attorney Berg, Assistant City Manager
Fryslie and the Clerk.
The following proceedings were had: I
Hinutes of the last regular session were read and it was moved by Commissioner Staudaher, seconded
by Commissioner Sedi ViI', that the minutes be approved as read and the motion was carried by the follow-
ing Aye and No vote: those voting A"J"e being Ma.yor Swanson, Commissioner Staudaher and Commissioner
Sedivy; those voting No, none.
C:i.ty Building Facilities Program -- Progress HeporL -- Floor Plans
A group of members of the local Citizens' Committee. W. C. Hanshaw. John \ill. Cromer. Guy Sperry,
Louis A. Spain, Harvey Griffin. H. G. Merkel and Marlyn IIalJseman, appeared before the Commission to
discuss the proposed City Building Facilities and to ascertain what progress had been made on the prepara-
tion of plans and estimates. The information would then be used by the grollp to assist in formulJ,ting
the future plans of the Committee to assist the City in its building program.
The architects presented preliminary floor plans of the proposed City Hall FacUities (Administra-
tive-Police-Fire) . Assistant City Manager Fryslie again presented the three Main Street elevation
drawings which had been previously presented at the meeting of the Commission during, its regular meet-
ing of October 11, 1961. It was stated that the drawings would be ret!1ined at the present City Hall
and would be available for inspection by any interested person. I
The City Manager again stated that the plans as originally proposed for the construction of the
shop facilities were to be retained; however, it would be necessary to delete such items as the land-
scaping. fencing, etc., as originally planned.
After a discussion of the floor plans, it was moved by Commissioner Sedivy, seconded by
Commissioner Staudaher, that the preliminary floor plans as prepared and presented by the architects
for construction of the City Hall Facilities be approved and filed, after a proper notation of the
Commission'S action had been placed on the plans. The motion was carried by the following Aye and No
vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those
voting No. none.
S. I. D., No. 422 -- Re-award of Contract
During the October 11th session of the Commission, the contract for the construction of the improve-
ments in Special Improvement District No. 422 was awarded to the Gardner Construction Co.
Attorney Joseph B. G'3.ry acUng as legal counsel for the Budd P111mbing and Heating Company. Inc.
QPpeared before the Commission to register an objection to the foregoing action, based upon the con-
tention that the contract had been awarded on the ba3is of a corrected contract total of $16,237.52,
although the Cashier's Check in the amount of $1.613.00 accompanying the Gardner Construction Company I
bid was not in the proper amount pursuant to the "Call for Bids", that is. ten percent of the bid totCll.
Accordingly, Mr. Gary contended that the bid of the Gardner Construction Company ShOllld be disquali-
f:1.ed and rejected tmd the contract awarded to the next lowest qualified bidder, Bl1dd Plumbing and
Heating Co., Inc.
Attorney Donald A. Nash. legi'd catmsel for the Gardner Construction Company, then stated that his

-- client, would a.ccept. A,ward of the contract at its original bid of $16,129.52. and would forward a letter

On recommendation of the City Attorney, concurred in by the City Manager, i.t was moved by
Commissioner Staudaher, seconded by Commissioner Sedivy, that the action of the Commission meeting
held October 11th. 1961 awarding the contract for the construction of the improvements in S. 1. D.
No. 422 be rescinded and the contract for the aforementioned improvements be awarded to Gardner
Construction Company as the lowest responsible bidder on the basis of its total bid in the origin<Jl
I amount of t'16,129.52, that being the proper amount for considern.tion, and contingent upon the sale of
the honds of the district. The motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, nO:1e.

The request of Montana State- College to stage its annual Homecoming Day Parade on Main Street,
Saturday, October 21st, at 10:30 A. M. was presented. It was moved by Commissioner Sedivy, seconded
by Commissioner Staudaher. that the request be granted and the motion was carried by the following
Aye and No vote: those voting Aye being Hayor Swanson, Commissioner Sedivy and Commissioner SLaudaher;
those voting No. none.
Jaycees Flag Posting -- Brackets on Parking Heter Posts
A letter of request received from the J. C.'s regarding a proposed plan for the displaying of
I: American Flags secured by brRckets attached to the parking meter posts was presented. After a disclls-
sion of the request. it was moved by Commissioner St.mldaher, seconded by Commissioner Sedi V~'. tht1t the
request must necessarily be denied beCAuse of the inAdvisability of brncketing any item t() p,grking

The Director of Fjnance has ample funds in the bond redemption fund and reqllested a1Jthority to
complete the transo.ction at a saving to the City of 3.3% in interest charges. The City Manager
reconunended t.hat the Director of Finance be given authority to complete the purchase of the bonds
and it was moved by Commissioner Sedivy, seconded by Conunissioner Staudaher. that the Director of
Finance purchase the bonds as specified above and the motion was carried by the following Aye Rnd No I

Purchase -- Motor Drive (Sewage Disposal Plant)
It was reported that the motor drive on one of the sludge pmnp units at the sewage disposal plant
