October 25th, 1961 at 1:00 o'clock P.M. Present were Mayor Swanson, Commissioner Staudaner, Commissioner Sedivy, City Manager cutting, City Attorney Berg, Ass't. City Manager Fryslie and the Clerk. I The fOLlowing proceedings were had: Minutes of the last regular session were read and it was moved by Commis- sioner Sedivy, seconded by CoDmdssioner staudaher. tha t the m1nu tes be approved as read and the motion w as carried by tbe following Aye and No vote: those voting Aye being M~70r Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No. none. Waiver of Building Permits for Home Fallout Shelters -- Don B. Skerritt Sheriff Donald B. Skerritt, Civil Defense Director for Gallatin County, appeared before the Commission to request that the City waive its regular build- ing permit fee when a permit is issued to build a home fallout shelter. Mr. Skerritt emphasized that it was his desire that, as a means of maintaining control over the type of structures to be used for fallout shelters, the Ci ty continue its pOlicy of requiring that a building permit be obtained before construction is started. He. al.so, asked that in planning the City's proposed new bu1.1ding program. the Commission consider using the City Hall siren only as a unit of the civil defense warning system and not 8S a fire alarm signaL. I Mr. Skerritt's requests were placed under advisement until the next regular session of the Commission. Phillips "66" -- Service Sta tion -- Zoning Requirements H. A. Nelson, representative of the Phillips ~etroleum Co.. appeared before the Commission to discuss the provisions of Chapter 17.08 of the Bozeman Municipal Code as it applies to service stations in motor business districts in the City. If the provisions of the section of the code were applied, it would be necessary to provide a twenty-five (25) foot set back and the landscaping of 75% of the front area which would place an undue hardship on the general operations of a service s ta tion. Mr. Nelson was informed that. while there appeared to be some merit to his contentions, appeal. would have to be made to the City's Board of Adjustment for any exoeption to the requirements of the Zoning Ordinance. Resolution No. 1033 -- Final Passage -- S. I.D.. No. 419 This was the time and place set for hearing protests to levying assessment for special Improvement District No. 419. Aff1davit of publication ot Notice was presented. No one was present to protest and no protests having been filed, I Resolution No. lU33, as provisiona~ly passed and adopted at the regular meeting he~d October 18, 1961 was presented for final passage. Request -- Parking Lot Exit on Bozeman Avenue -- Security Bank The Commission oonsidered the request of tne Seourity Bank and Trust Company for permission to oonstruot an exit (curb cut) from its parking lot to provide a driveway to enter Bozeman Street between Main and Babcock Streets. The City Manager reported that aD investigation of the matter revealed tnat the exit would present no traffic problem on Bozeman Street and would tend to elimi- nate congestion of traffic on Babcock Street. It was moved by Commissioner Staudaher. seconded by Commissioner Sedivy. I that the bank be authorized to construct the exit without expense to the City and the motion was oarried by the following Aye and No vote: those vo ting Aye being Mayor Swanson. CommiSSioner Staudaher and Commissioner Sedivy; those voting No. none. City Building Facilities Program -- Progress Report Three exhibits, prepared by the arohitects at the request of the City, ot proposed plans for the City Hall developed from tne three main street elevation drawings submitted to the Commission during its meeting of October ll, 1961 were presented. The exhibits were aocompanied by a letter setting forth cost esti- mates of the projeots incorporated in the building program. (Commissioner Sedivy excused from the meeting at 2:33 P.M.) It was moved by Commissioner Staudaher. seconded by Mayor Swanson. tha t the exhibits and oost intormation as submitted be released to the pub1io and the Citizen's Committee. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commiss1oner Staudaher; those voting I No. none. Special Commission Meeting The City Manager pursuant to the prOViSions of Section 1l-324~. R.C.M.. 1~47 and Section 2.0~.U60.
