HomeMy WebLinkAbout1961-04-12 :~98 Bozeman, Montana April 12, 1961 The Commission of the City of Bozeman met in regular session in the Commis- sion Room, City Hall Building, Wednesday, April l2, 1961 at l:OO o'clock p.m. Present were Mayor Swanson, Commissioner staudaher, Commissioner Sedivy, City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Lovelace and the Clerk. I The following proceedings were had: Minutes of the last regular session were read and it was moved by Commissioner Sedivy, seconded by Commissioner staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye be- ing Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Resolution No. 1013 -- Intention to Create Special Improvement District No. 421 (North 6th Ave. & Short Street) The Clty Attorney, as instructed, had prepared a resolution of intention to create Special Improvement District No. 421. Commission Resolution No. 1013 was presented, entitled: /~ COMMISSION RESOLUTION NO. 1013 A RESOLUTION OF TIlE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE T.HE INTENTION OF TIIE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE~ffiNT DISTRICT NO. 421 I OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING ANTI INSTALLING A PAVEMENT PROJECT ON WEST SHORT STREET FROM NORTH SIXTH A VENUE TO NORTH SEVENTH A VENUE AND ON NORTH SIXTH A VENUE FROM WEST VILLARD STREET TO DURSTON ROAD, SAID PAVEMENT PROJECT TO INCLUDE COMBINATION CONCRETE CURBS AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, AND BITUMINOUS SURFACE COURSE, AIID OTHER WORK INCIDENTAL ~IERETO. The City Manager reported that a letter bearing signatures of 36.0% of the property owners within the area advising they would protest the creation of such a district at this time is on file; however, a study has indicated the proposed projec t, if completed, would materially benefit the school crossing across North Seventh Avenue at Short Street now used by grade school students attending Whittier School, as well as, provide for unloading school busses at that location on North Sixth Avenue, and based on the merits of the study he deemed it proper to recommend that the proposed district be approved. It was then moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that Resolution No. lu13 indicating the intention of the Commission to create special Improvement District No. 421 be passed and adopted and May 3rd, 1961 be set as the date for public hea ring. The motion was carried by the following Aye and No vote: those voting I Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. /" Authority to Advertise for Bids -- Chain Link Fence, Settling Basin The Montana State Board of Health has recommended that the City fence its settling basin at the mouth of Bozeman Creek Canyon to further guard against the tHlg ~ ), '" contamination of the City's water supply by intruding anima~s and people. Plans and specifications for such a fence of the chain ~ink type to provide this addi- tional safe-guard as prepared by the City Engineer were presented. I t was reco- mmended by the City Manager that the Commission approve the p~ans and specifications and that the Clerk of the City Commission be instructed to issue a call for bids I on this fencing project. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the p~ans be approved and the Clerk of the CommiSSion be dlrected to publish a call for bids for an openlng date of May lOth, 1961. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting . No, none. Sub-Contract -- S. I .D. No. 418 An agreement between Kiely Construction Company of Butte, Montana, and A. H. Anderson and Son Construction Company of Great Falls, Montana was presented. This agreement provides that A. H. Anderson and Son Construction Company will do specified concrete work as a sub-contractor on the contract awarded Kiely Construction Co. for construction in Special Improvement Dlstrict No. 418 at an approximate cost of $35,104.50. It was moved by Commissioner Sedivy, seconded by Commi s s i oner Stauda her, that the City approve the agreement and the City Manager be directed to notify the contracting parties of its action. The motion was I carrled by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner ~taudaher; those voting No, none. Clean-up Week -- April 29th - May 6th The City Commission and the City Manager discussed a request received from the Chamber of Gommerce which requested the Mayor issue a proclamation designating the week of April 29th - May 6th as the Cit1's annual "Clean-up Week", the per- mission to stage a parade on Main street on April 29th to officially open the program, and that City equlpment of an appropriate type participate in the parade. The City Manager recommended that the request for the parade be granted, but added that it appeared the participation of City equipment would not only restrain the use of the much needed equipment at an un-opporblne time, but would, also, constitute an unwarranted expense. It was moved by Commissloner Staudaher, seconded by Commissioner Sedivy, that Mayor Swanson issue the proc~amation, and permission be granted to stage the parade as requested, and that participation of City equipment in the parade be necessari~y denied. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commis- I sioner Staudaher and Commissioner Sedivy; those voting No, none. Request -- Temporary Building at SE Corner of 10th & Main Street .../ J. H. Abbott and Harold Hogg appeared before the Commission to place a request to construct a temporary building on property adjacent to the sou theas t corner of the intersection of Tenth Avenue and Main Street. Members of the Commission requested that Mr. Abbott and Mr. Hogg present their request in a more formal manner and action was delayed until the next regular meeting of the Commission. ;100 Electrician's Bond ..- Harrington's Home Appliances The electrician's bond of Harrington's Home Appliances was presented. The bond was approved as to form by the City Attorney, and it was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the bond be approved and accepted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting I No, none. AWVJA Convention at Helena ..- 6..8 April The City Manager commented on the conference of the America Water Works Association held at Helena, April 6-8, attended by various City officlals, and reported that Bozeman has been selected as the site for the 1962 conference tentatively scheduled to be held April 5th to 7th, 1962, inclus 1 ve. Reports The following reports for the month of March, 1961 were presented: Cemetery Water COllector Cashier Sani tary The City Manager reviewed the reports with the Commission and recommended that the reports be approved and filed. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the reports be approved and filed and the motion was carried by the following Aye and No vote: those voting Aye be..' ing Mayor Swanson, Commissioner Sedivy and Commissioner ~taudaher; those voting No, none.
