HomeMy WebLinkAbout1961-04-19 .101 Bozeman, Montana April 19, 1961 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall building, Wednesday, April 19, 1961 at l:OU o'clock p.m. Present I were Mayor Swanson, Commissioner Staudah~r, Commissioner Sedivy, City Manager Cutting, Ass't. City Manager Fryslie, City Attorney Lovelace and the Clerk. The following proceedings were had: Minutes of the last regt1lar session were read and it was moved by Commissioner Sto,udaher, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner ~taudaher and Commissioner Sedivy; those voting No, none. Public Hearing -- Special Improvement District No. 420 (Street Lighting - Marwyn) This was the time and place as set by Commission Resolution No. lul2 to hear protests to the creation of Special Improvement Lighting District No. 420. Affi- davit of publication of Notice, together with the Clerk's Mailing Certificate that all nroperty owners had been notified as req~J1red by law, were presented. No writ- ten protests were on file and no one appeared to protest the creation or the extent of the dis tric t. The City Manager recommended that the district be created, and it was moved by Commissioner Sedivy, seconded by Commissioner staudaher, tha t the district be created and the City Attorney be instructed to prepare a resolution I creating the district. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Resolution No. 1014 -- Creating Special Improvement Lighting District No. 420 The City Attorney, as instructed, had prepared a resolution creating Special Improvement Lighting District No. 420. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. :102 Request -- Temporary Building at SE Corner of 10th & Main Street During the previous meeting of the Commission, Mr. Abbott and Mr. Hogg appeared to request permission to construct a temporary building on property adjacent to the southeast corner of the intersection of' Tenth Avenue and Main Street. The City Manager stated that the building is to be used in connection with a used car lot, and, as the a rea is in the motor business district, as presently zoned, the pro- I posed business is allowable; howeve r, permission to build a structnre of a tempo r- ,. ary na ture in the a rea would no t be in conformity with Section l7.U8 of the Bozeman Municipal Code, and, i11 this ins tance , as it miD'ht possjbly be construed as to se t a precedent dictating action on like re ues ts in the fu ture, he deemed it necessary to recommend to the Commission that the request be denied. It was moved by Commis- sioner Staudaher, seconded by Commissioner Sedivy, that the request be necessarily denied and that the City Manager be directed to notify the applicants of its action. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner StalJdaher and Commissioner Sedivy; those voting No, none. Mr. Harold Hogg, associated with Mr. Abbott, later appeared and was advised of this action and was ass1Jred, howeve r, it was not the intention of the Commlsslon to deny the applicant any business opportunity at this location. Agre emen t -- Hoskins & Associates -- Engineering Services An open contract agreement between the City of Bozeman and Harold Hoskins and Associates to provide englneering services for storm drainage systems and/or pav- I ing projects not within those areas of improvement outlined in the "~reliminary Report on froposed Drainage and Street I~provements" prepared for the City of Bozeman by the Engineers in March, 1958, was presented. The agreement was approved as to form by tbe City Attorney, and it was recommended by the City Manager that the agreement be approved and the Mayor and the Clerk of the Commission be authorized to sign the agreement for the City. It was moved by Commissioner SediVY, seconded by Commissioner Staudaher, that the agreement be executed as recommended and the motion was carried by the fOllowing Aye and No vote: those voting Aye bein; Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those vo tlng No, none. Agreement -- Housing & Home Finance Agency -- City Hall & Shops An agreement between the Housing and Home Finance Agency and the City of Bozeman for an ad vance of ~plO, 4UO for preliminary planning for the proposed con- struction of a new city hall and shop bu'lding (HHP'A pro,j ec t No. P-Mon t. 3150, "', Contract No. H-602-ll40, was presented. The agreement was approved as to form by tbe Ci ty Attorney, and the City Manager recommended that the City enter into I the agreement. It was moved by Commissioner Staudaber, seconded by Commissioner Sedivy, that the agreement be approved and accepted and the Mayor and the Clerk of the Commission be authorized to s 1",:n the 8.greement for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Ma yor Swanson, Commissioner Staudaher and '''';ommissioner Sediv:r; those voting No, none. .10:3 Authority to Travel -- Montana State Library Convention The written request of Margaret Hileman, City Librarian, tha t au tboriza tion be ~ranted her to attend the Montana State Library convention scheduled to be held in Glendive, Montana, May 5-7, H!6l, was placed before the Commission. The Ci ty lI'lanager recommended that Miss Hileman's request be granted, and, it being in the public I in te re s t, her necessary expenses incurred to attend the convention DC pai6 from the - .., Library fund. Contrac tors InSllrance -- Hap;?erty-Messmer (Sewaae Disposal Plant) The Clty Manager placed before the Coml"llssion a certificate issued by the Sta te of Montana Industrial Accident Board certifyin~ that Hag;erty-Messrner, contractor on the Sewage Plant Improvement, is insured under!) lan No. three of the Mon tam'! Viorkmenfs Compensation Act., and, also, a certificate from the St. Paul Pire and Marine Insurance Corrpany which stated that the firm is covered by proper lia:Jility insurance on the project. The City Manager stated that since this showing satisfied requirements of the contract specifications for this coverage, he rocornT:1onded that the City Commis- sion approve and accept the certificates. Report -- Director of Public Service . 1'he MarCh, 1961, report of the Director of Public Service was presented. The I City Manager discussed the report with the Commission and recommended that it be approved and filed. Commissioner Staudaber moved that it be approved as recommended. The motion was seconded by Commissioner Sedivy and carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner :Jtaudaher and Commissioner Sedivy; those voting No, none. lOLl Garbage The City Manager informed the ComY'1ission tha t accompanied by the Superin tenden t of the Garbage lJepartment, he had just completed a City-wide inspection of alleys. He reported that while there has been a material improvement in the overall condition and appearance of alleys within the past several years, th ere is a pronounced defi- ciency in adherence to the provisions of Vhapter 5.20 of the Bozeman Municipal I I' the manner in which garbage Is being placod for collection and Code v'in regard to in particular 'in regard to the lack of reGuired containers. The Mana~er then advi- sed the Commission that he hnd, therefore, taken immediate steps to ascertain the specific location of violations of the Code and was calling upon all citizens to cooperate in an effort to correct this doficiency at the earliest possible date in order to safeguard the health of the community.
