HomeMy WebLinkAbout1961-04-26 .105 Bozeman, Montana April 26, 1961 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, April 26, 1961 at 1:00 o'clock p.m. Presen t were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City Manager Cutting, I Assft. City ManaGer Fryslie and the Clerk. Miscellaneous Walles & Curbs 1961 -- Order to Repair and/or Constn1ct The City Engineer, under provisions and authority of Sections 11-967 and 11-2226 R.C.M. 1947, and Chapter 9.36 of the Bozeman Municipal Code, relating to cons truc tion of Wa lks and Curbs wi th01J t forma tion of a Spec ial Improvemen t Dis tr'ic t submitted his final recommendations in detail with reference to needed repairs and new ins ta 11a tion of wa ll{s and curbs in the City. Tho C1 ty r\Tanager eta ted tha t, from time to time during the period above specified, additional walks and curbs which require repair or new installation may be discovered and be added to the afore- mentioned recommenu.ations, and recommended that the report be adopted, and tha t the ClerJ,e of the Commission be au thorized to advertise for bids for the work. ..1 It was moved by commiasloner Staudaher, seconded by Commissioner Sedivy, that the final report of the Ci ty Engineel' as to the repair and installation of Miscel- laneous Walk and Curb for 1961 including those walks and curbs now or hereafter determined to require repair or new installation be and the same is hereby accepted, ap,roved, adopted, ordered filed and that the Clerk of the Commission be authorized to advertise for bids for this work for an opening date of ~ay 24th, 1961. Said adopted report of the City Engineer is hereby referred to and made a part of this minu te en try by su ch adoption and refe rence for the purpose of designating and iden tifying the streets and avenues on Which such new installations or repairs are to be made and such now installa tion or repairs are hereby ordered to be made under and pursuant to the provisions of Section 11-967 and ll-2226 R.C.M. 1947, and Chapter 9.36 of the Bozeman Municipal Code and the City Manager is hereby instructed to give or cause to be given, to each owner or agent of such owner, or either, of the property along which such new installation or repair is to be made, written or printed notice of such order, as required by the provisions of said Section 11-2226 .1 R . C . r\1 . 1S'47 and Chapter 9.36 of the Bozeman Municipal Code and such new installations or repairs are hereby ordered to be made wi thin thirty da ys from the da te of such notlce, and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. Purchase of Water Meters The City Manager reported that the house survey now being conducted in the City ;106 is resulting in additional demands for water meter installations and requested authority to purchase thirty (30), 3/4" meters at an approximate total cos t of ~~7P,0.OO. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, the t the C1 ty !I-Tenager be authorized to purchase the meters and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. I Examination of Depository Bonds The Commission proceeded to exardne the Custodian's Receipts for Depository Bonds held by the Director of Finance as securi t;.r for Ci ty funds deposi tad in Bozeman banks. It was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the securi ties be approved and a list thereof be set forth in full in the minutes of this meeting and the motion was carried by the following Aye and No vo t e : those voting Aye being Mayor Swanson, Commissioner Staudaher, and Commis- sioner Sedivy; those voting No, none. Sedivy Dated April 26th, 1961 - - - - - - - - - - - ,;' 107 Graf's First Subdivision -- Final Pla t The proposed plat of Graf's First Subdivision was placed before the Commission for approval. The City Manager stated that the City-County Planning Board had by letter, dated April 24, 1961, informed the City that the Board had approved the plat. The City Manager, in concurrence with the City Engineer, recommended that the plat be I approved and the City Manager be authorized to sign the plat as Director of Public Service for the City. It was moved by Commissioner Sedivy, seconded by Commissioner Staudaher, tha t the Ci ty approve the pIa t and the Ci ty I,lanager as Direc tor of Public Service be authorized to sign for the City and the motion was carried for the follow- ing Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. It was moved by Commissioner Staudaher, seconded by Commissioner SediVY, that the report be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those voting No, none. nesolu tion No. lO15 -- BringingO.76 Acres South of City Limits into the City The City having received a written request petitioning the City Commission to extend the boundaries of the City to include 0.76 acres south of the City Limits, I the City Attorney had prepared proposed COmTIission Resolution No. 1015. Resolu tion No. 1015 was presented, entitled: COMJlUSSION TIESOLUTION NO. 1015 A RESOLUTION OF THE COMlrTISSION OF THE CI1"I or BOZ:::~}"AN DECLARING IT TO BE THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF' AND OF THE INI'lABI- TANTS OF A TRACT OF LAND CONTImJOUS TO 1~E SAID CITY OF BOZEMAN AND HEREIN r,WRE PARTICULARLYDESCRIDED TO EXTEND THE BOUNDARIES OF THE SAID CITY 0:,' BOZE?JAN SO AS TO INCLUDE THE SAID CONTIGUOUS TnACT VJITHIN THE CORPO~ATE LI~ITS THEREOF. The City Manager reconnnended that the Commissjon proceed to complete the action incorpora ted in the resolu tion. It was moved by Cow~issioner SediVY, seconded by Commissioner Staudaher, that the resolution be regularly passed and adopted and May 24th, 1961 be set as the date for public hearing on the issue and the motion was carried by the following Aye and No vote: those voting Aye being Hayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Authority to Travel -- Chief of Plice Saunders to Helena, Montana I A request from Chief of Police Saunders for authority to attend the Attorney General's Law Enforcement Conference and the Montana Chiefs' of Police Association :r-,-reeting scheduled to be held in Helena, Montana, May 4-6, 1961, was presented. The Ci ty Manager recommended tha t Chief Saunder's request be gr_?nted, and, it being in the pu,b1ic interest, the necessary travel expenses to attend the conferences be paid from the General Police Fund. It was moved by Commissioner Sedi vy,seconded by /108 Commissioner Staudaher, that the request be granted as recommended by the City Man- ager and the motion was carried by the following Aye and No vote: thos e vo ting Aye being Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No, none. Resolu tion No. lOI6 -- Quit Claim Deed to A. G. & Frances M. Busch During the Commission meeting held December 21, 1960, the City agreed to I approve a proposed plat of land to be known as the Apollo Subdivision, subject to the condition tbe subdividers, A. G. and Frances M. Busch, deed to the City that r;ortion of the arGa indica ted as a cul-de-sac and not dedica ted for street purposes. Said deed was duly recorded January P, 1961 in Book l36 of Deeds at Page 271, records in the office of the Coun ty Clerk and Recorder of Galla tin Coun ty, Montana. It now appears that to assist the subdividers, the City should quit claim the aforementioned lands to the original parties of the second part, who agree to comple te the filing of the proposed plat and will in turn again convey the indicated cul-de~ sac to the Ci ty. BUSCH The Ci ty Manager advised the Commission tha t the deed and reSOlu tion appeared to be in order and recommended tha t the ae tion be comple ted as se t forth in the resolu tion. It was then moved by Commissioner Sedivy, seconded by Commissioner Staudaher, tha t the resolu tion be passed and adopted and the Mayor and the Clerk of the City Commission be authorized to sign the Quit Claim Deed for the City, and the motion was carried by the following Aye and No vote: those voting Aye belng Mayor Swanson, Comrr.issioner Sedivy and Commissioner staudaher; those voting No, none. National Loyalty Day -- May lst A request from the Veterans of Foreign Wars to have Mayor Swanson issue a proclamation designating May 1st as National Loyalty Day and the City to display the American Flags on Main street throughou t the day was placed before the Conunis- sian. It was moved by commiss loner Staudaher, seconded by Commissioner Sedivy, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson, Comrrissioner Staudaher and Commis- I s loner Sedivy; those voting No, none.
