The Commission of the City of Bozeman met in regular session in the Commis-
sion Room, City Hall Building, Wednesday, June 28th, 1961 at l:UU o'clock p.m.
Present were Mayor Swanson, Commissioner Staudaher, Commissioner Sedivy, City I.
Manager Cutting, Ass't. City Manager Fryslie, Deputy City Attorney Berg and the
Clerk.
The following proceedings were had:
Minutes of the last regular session were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Staudaher, that the minutes be approved as read
and the motion was carried by the tol10wing Aye and No vote: those voting Aye
belng Mayor Swanson, Commissioner Sedivy, and Commissioner Staudaher; those voting
No, none.
Acceptance of Fire Truck & Payment -- Howe Fire Appa ra tus Company, $19,988.60
During the Commission meeting held October 26th, 1960, the Commission awarded
the contract for the purchase of a "Fire Engine Pumper" from the Howe Fire
Apparatus Co. of Anderson, Indiana, at a base bid of $18,663.$1 p~us additional
equipment in the amount of $1,325.29, or the total amount of $19,988.6U. The
new uni t has been received and Fire Chief Pentti1a ~__ta ted that the unit has been
completely tested and recommended that the unit be accepted. The City Manager
concurred tha t the unit be accepted and further recommended a warrant in the I
amount of $19,988.60 be issued to the Howe Fire Apparatus Company for pa~ent.
It was moved by Commissioner sedivy, seconded by Commissioner Staudaher, that the

unit be accepted by the City and the warrant issued in payment as recommended.
The motion was carried by the tollowing Aye and No vote: those voting Aye being
Mayor Swanson, Commissioner Sedivy and Commissioner Staudaher; those voting No,
none.
Request -- Exchange Club (Fourth of July Fireworks Program)
Jim Messmer appeared to represent the Bozeman Exchange Club in its request
that control of traffic be granted 1n the immediate area of the former Bozeman .
Country Club were the Exchange Club plans to stage its annual 4th of July fire-
works display. Mr. Messmer stated that the Sheriff's Posse would assist in the
direction of traffic and requested that the City Police Department would, aa it
has in the past, assist the posse, and that permission be granted to place
barricades at some of the City streets or entrances to the site of the display.
The C1 ty Manager and the Chief of Police discussed the ma tter and recouunended
that permission, as requested, be granted, except that pe~ission be granted for 1
horsemen to direct the traffic on Hlghland Boulevard, rather than barricade that
arterial entrance to the City. It was moved by Commissioner staudaher, seconded
by Commissioner Sedivy, that pe~ission, as reoommended, be granted to the club
and the motion was carried by the following Aye and No vote: those voting Aye
being Mayor Swanson, Commissioner Staudaher and Commissioner Sedivy; those
voting No, none.

Application for Building Permit -- Rudy Hager and Donald R. Edens, Contractor
Rudy Hager and Donald R. Edens, contractor, appeared before the Commission
in connection with Mr. Hager's application for a permit to construct a 44'x1UO'
building at 908 W. Main, Lots 10 & 11 Block G. Story's Addition, to house an
.1 automotibe body repair shop. The Clty Manager informed the members of the
Commission that the issuance of the permit, prOVided that all other prOVisions of
Chapter 1708, Bozeman Municipal Code, the "Building Codl be complied wlth, was
dependent on an interpreta tion by the Cormnission as whether or not &n""automotive
body repair shop" could, under the provisions of the present zoning ordinance,
be classified as "auto sales and service". Tbe Commission and the City Manager
discussed the matter at length with Mr. Hager and Mr. Edens. It was moved by
Commissioner Staudaher, seconded by Commissioner Sedlvy, that the Commission
interpret the provisions of the ordinance to permit this enterprise in the Motor
Business District Zone as "auto sales and service", and that the issuance of a
butldlng permit be approved, subject to the other provisions of Chapter 1708 of
the Bozeman Municipal Code. The motion was carried by the following Aye and No
vo te : those voting Aye being Mayor Swanson, Commissioner Staudaher and Commis-
sioner Sedivy; those voting No, none.
Request -- Sidewa1d Bazaar, Friday, July 21st
Guy Sperry, manager, of the Bozeman Chamber of Commerce appeared to request
I permission for the Chamber to stage a sidewalk bazaar, July 21st, on Main Street.
The City Manager recommended that the request be granted, subject to the provisions
tha t no vehicles be placed on the sidwalk area, the disp~ays be confined to the
Inside half of the sidewalk, and that all displays and decorations in connection
with the event be removed within 24 hau.. after the close of business on that
day. It was moved by Commissioner Staudaher, seconded by Commissioner SediVY,
that the request be granted as recommended and the motion was carried by the
following Aye and No vote: those voting Aye belng Mayor Swanson, Commissioner
Staudaher and Commissioner Sedivy; those votlng No, none.

The following reports were presented:
Director of Public Service (Aprl1 & May)
The City Manager commented that the man-hours for the month of May for the
Garbage and Water departments show an increase; however, the increases were due
to the annual clean-up week during the momth, and tha t a pprox1ma tely 20 new
instaliations of water meters had been made as a result of the house survey belng
1 made, which had resulted in unusual requests for meters. He recommended that the
reports be approved and it was moved by Commissioner SediVY, seconded by Commis-
sioner Staudaher, that the reports be approved and filed and the motion was
carried by the following Aye and No vote: those voting Aye being Mayor Swanson,
Commissioner Sedivy, and Commissioner Staudaher; those voting No, none.
Bozeman City-County Planning Board -- Sta tus
The City Manager stated that, due to recent Court decisions regarding the
status of the legality of City-County Plannlng Boards, he requested the City

Attorney's office to render a written opinion as the the legality of any further
levy of taxes for the operation of the Bozeman City-County Planning.
State Board of Health Reports
The Stream Classification report of the State Board of Health was presented.
This report placed all sources of water of the City at its intake in Class "An.
The Water Pollution report indicated that the Board might possibly require the I.
adding of chlorine to the affluent flowing from the City Sewage Disposal Plant.
Pet1 tiOD -- Bond Election for City Bul1ding Program
Resolution No. 1020 -- Election for Issuance of Bonds
The Clerk presented to the Commission a petition, consisting of 58 identical
counterparts, for an election on the questions of issuing City Hall and Shop
Building Bonds. Attached to said petition were the affidavits of the circulators
of the various conterparts thereof and tpe Certificate of the C~erk of the
Commission finding the petitlon to have been signed by a sufficient number of
qualified Signers. The Commission thereupon examined the petition.
Commissioner Staudaher introduced the following resolution and moved its
adoption:

RESOLUTION DETERMINING SUFFICIENCY OF PETITION
FOR CITY HALL AND SHOP BUILDING BONDS, FIXING
THE EXACT AMOUNT OF BONDS TO BE ISSUED AND CALLING
AN ELECTION FOR THE PURPOSE OF VOTING ON THE
ISSUANCE OF SUCH BONDS
The motion for the ad&ptlon of the foregoing resolution was duly seconded I
by Commissioner SediVY, and the motion was carried by the following Aye and No
vote: those voting Aye being Mayor Swanson, Commissioner Staudaher and Commis-
sioner Sedivy; those voting No, none.

There being no further business to come before the Commission at this time,
it was moved by Commissioner Staudaher, seconded by Commissioner Sedivy, that the
meeting adjourn and the motion was carried by the following Aye and No vote:
