HomeMy WebLinkAbout1961-07-05 4-)7 ,It) Bozeman, Montana July 5, 1961 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, July 5th, 1961 at 1:00 o'clock P. M. Present Were Mayor Swanson, Commissioner Sedivy, City Manager Cutting, Assistant City Manager Fryslie, Deputy City Attorney Berg and the Clerk. The following proceedings were had: I Minutes of the last regular session were read and it was moved by Commissioner Sedivy, seconded ~ " by Mayor Swanson, that the minutes be approved as read and the motion ,was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Sedivy; those voting No, none. Bond & Contract - Andrew H. Anderson & Son, Inc. (W & C - 1961) Performance bond and contract documents for the contract of Andrew H. Anderson & Son, Inc. awarded on May 24th, 1961 for the construction of miscellaneous walks and curbs within the City of Bozeman were presented. The bond and contract were approved as to fonn by the Deputy City 'Attorney, and the City Manager reported that the City has evidence the contractor is adequately insured and recommended that the Mayor and the Clerk be authorized to sign the contract for the City and, follow- ing complete execution of the documents, the bid security submitted with the bid be returned to the Contractor. It was moved by Mayor Swanson, seconded by Commissioner Sedivy, that the bond and con- tract be approved, the Mayor and the Clerk be authorized to sign the contract for the City, and on completion of the documents as recommended by the City Manager, the bid security Cashier's check in the amount of $200.00 submitted with the bid of the contractor be returned. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Sedivy; I those voting No, none. Sale of Lots - Spring Dell Addition - Robert Simkins During the regular Commission meeting of August 16th, 1959, the City Commission approved the plat of the Spring Dell Addition to the City of Bozeman, and the Platters agreed to deed Lots 1, 2 and 3 of Block 2 of the said addition to the City in lieu of dedicating an area within the addition for park and playground purposes. It was, also, agreed that the City would enter into an option agreement under which R. J. Rickabaugh would be pennitted to repurchase these lots within a two year period at a price of $782.60 per lot plus any additional cost which the City might have incurred against these lots between the date of acquisition and the date of resale. At the regular meeting of the Commission held September 30th, 1959 the City accepted the deed and entered into the option agreement. The City Manager reported that the option agreement has now been assigned to Robert Simkins and he has stated his desire to purchase the aforementioned lots in accordance with the terms of the agreement. The City Manager further stated that to his knowledge the City has incurred no expense in connection with the property and recommended that, contingent upon it being ascertained that the assignment of the option agreement is in order, that the City proceed to sell the lots to Mr. Simkins I as stipulated in the agreement. It was moved by Commissioner Sedivy, seconded by Mayor Swanson, that the City complete the transaction as recommended by the City Manager and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Sedivy; those voting No, none. Reports The following reports were presented: Director of Finance (May) Fire Chief Building Inspector Librarian Chief of Police ~ - ~~~. 438 The City Manager reported that the Librarian's report indicated a definite increase in patronage at the library and. the other reports appeared to be in order and recommended that all reports be approved and filed. It was moved by Mayor Swanson, seconded by Commissioner Sedivy, that the reports be approved and filed and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Sedivy; those voting No, none. Request -- American Legion Parades The City Manager presented a letter received from the Post Commander of American Legion Post #14 of Bozeman, which requested pennission to stage two parades, the 40 & 8 fun parade on July 13th, at 9:00 P. M., and the regular parade of all units on the 15th at 4:00 P. M. The City Manager recommended that the request be granted and it was moved by Commissioner Sedivy, seconded by Mayor Swanson, that the request be granted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Sedivy; those voting No, none. Claims for the Month of June Claims No's. 1195l to 12000 and 1 to 225 inclusive were presented on the various funds as follows: Band - - 20.00 Cemetery - - 3,409.35 Garbage - - 4,540.94 General - - 37,522.18 Library - - 1,965.65 Park - - 7,368.83 Parking Meter - - 1,362.22 P. E. R. S. - - 918.66 Planning Board - - 15.00 Police Reserve - - 3,076.73 SDS Rev. - - 2,790.20 S. I. D. - - 52.54 Street - - 7,825.93 Water - - 8,990.97 Tot a 1 "" "" "" "" $79,859.20 The City Manager stated he had audited the claims and found them to be true and lawful claims I c, against the City of Bozeman and recommended that they be approved and warrants issued for their pay- ment. After examination of the claims in detail and checking against the claim register, it was moved by Mayor Swanson, seconded by Commissioner Sedivy, that the claims presented be approved. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Sedivy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Sedivy, seconded by Mayor Swanson, that the meeting adjourn and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Sedivy; those voting No, none. ,,-::/4~c ~<----/ -- . ...
