Bozeman, Mon tana July 12, 1961 The Commission of the City of Bozeman met in regular session in the Commission Room, City Hall Building, Wednesday, July 12th, 1961 at 1:00 o'olook P.M., Present were Mayor Swanson, Commissioner Staudaher, City Manager Cutting, Ass't. City I Manager Frys1ie and Deputy City Attorney Berg. The following proceedings were had: Minutes of the last regular session were read and it was moved by !layor Swanson, seconded by Commissioner Staudaher, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those vo ting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Designation of Acting Clerk of the Commission Clerk of the City Commlssion, C. K. Wilson, being absent on vacation leave the City Manager reoommended that Harold A. Fry-slie be designated acting Clerk of the City Commission for this date. It was moved by Commissioner Staudaher, seconded by Mayor Swanson that the deslgnation be made in accordanoe with the City Manager's recommenda- tion. The motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Bids for S.I.D. No. 419 - Pavement and Drainage - Royal Vista Addition This was the time and place set for receiving bids for construction of Street Pavement and Drainage Improvements in Special Improvement District No. 419. Affidavit I of publication of "Notice to Bidders" was presented. Two sealed bids on this projeot were on file. Upon the recommendation of the City Jlanager, it was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the bids be opened and the motion wes carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. The following bids were then opened and read: Name Base Bid - Kiely Construction Co., Butte, Montana $33,735.54 Albert Lalonde Co., Sidney, Montana 41,041.uO As recommended by the City Manager, it was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the bids be referred to T. H. Thomas, the engineer representing Harold Hoskins & Associates, the engineering consultant fi~ retained by the City for this district, to check the bids in detail, prepare a final tabul- ation and ascertain the lowest and best bid for the construction of the improve- men t. The motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. I Btd. tor 8.I.D. Request -- Reinvestment of Portion of Water Department Funds Director of Finance Shadoan having reported that $75,UOU.UO of Water Bunda are available for reinvestment in U.S. Government securities, authority was requested for such a reinvestment. It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the Director of Finance be authorized to invest the amount as afore- mentioned and the motion was carried by the following Aye and No vote: those vo ting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Authority to Attend Annual Firemen State Association Convention - Kalispe1l, 29-22, July The City Manager presented a letter from Fire Chief William rentti1a requesting I that Firemen Dewey Johnson and Henry Wruck, Jr. be authorized to attend the Annual Firemen State Association Convention in Kalispell, July 29-82, 1961, and that, it being in the publiC interest, to attend the convention the necessary expenses of Fireman Henry Wruck, Jr. incurred by such a ttendance be paid out of the General Fund. The letter further stated the expenses of Fireman Dewey Johnson incurred by such attendance shall be paid from the local Firemen's Association Funds. Upon recommendation by the City Manager, it was moved by Commissioner Staudaher, seconded by Mayor Swanson, that, it being in the public interest, the request be approved as submitted and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Water Meters - Purchase The City Manager reported that the Water Department has need for an additional supply of water meters and requested authority to place an order tor thirty "3/4" inCh meters at a total approximate cost of $780.UO. It was moved by Mayor Swanson, seconded by Commissioner Staudaher, that the City Manager be authorized to purchase the meters and the motion was carried by the following Aye and No vote: those I voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Request to Fire Sky Bombs -- Joe's Foods, 20-22, July The City Manager stated that Joe Hansford, owner and manager of Joe's Foods, has requested permission to fire a number of "Sky Boms" as a potion of sales pro- motion during the Chamber of Commerce sponsored "Sidewalk Bazaar" July 20-22, 1961 and that in view of Mr. Hansford's considerable experience in use of fireworks the request be granted with the stipulation that the "Sky Bombs" may only be fired from .1,11 an open and not built-up area and that Joe's Foods assume full responsibility and liability for all developments arising therefrom. It was moved by Commissioner Staudaher, seconded by Mayor Swanson, that the request be granted as recommended by the City Manager and the motion was carried by the following Aye and No vote! those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, I none. Claims for the Month of June, 1961 (Late) Additional Claim No's. 226 to 256 inclusive were presented on the various funds as follows: Fund Am't. Care 4U.UO I Total $50.913.34 The Manager stated he had audi ted the claims and found them to be true and lawful c1alms against the City of Bozeman and recommended that they be approved and warrants be issued for their payment. After examination of the claims in detal1 and checking against the claim register, it was moved by Commissioner Staudaher, seconded by Mayor Swanson, that all claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. S.I.D. No. 419 -- Award of Contract As direoted, Mr. Thomas ohecked the extension of all bids submitted, prepared the tina1 tabulation and recommended that Kiely Construction Co., Butte, Montana, be awarded the contract for the construction of the improvements in Special Improve- ment District No. 419, the firm's bid in the amount of $33,735.54, belng the low- est qualified bid received. The City Manager concurred in the reoommendation and it was moved by Mayor Swanson, seconded by Commissioner Staudaher, that subject to I the sale of the bonds of the distriot, the bid of Kiely Construction Co. in the amount of $33,735.54, it being the lowest and best bid submitted, be awarded the contract and the motion was oarried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. S.I.D. No. 421 -.. Award of Contract As directed, Mr. Thomas checked the extension of all bids submitted, prepared the final tabulation and recommended that Kiely Construction Co., Butte, Montana, ,1-12 be awarded the contract for the construction of the improvements in Special Improvement District No. 421, the firm's bid in the amount of $25,287.20, being the lowest qualified bid reoeived. The City Manager concurred in the recommendation and it was moved by Commissioner Staudaher, seconded by Mayor Swanson, that subject to the sale of the bonds of the district. the bid ot Kiely Construction Co. in the I amount of $25,287.20, it being the lowest and best bid submitted, be awarded the contract and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson and Commissioner Staudaher; those voting No, none. Bargain & Sale Deed - Ci ty Property on South Blaok A'wnue"to Robert G. Simkins Mr. Robert G. Simkins appeared before the Commission and presented an assign- ment from Mr. R. J. Rickabough ot an option from the City to Mr. Rickabough to purohase certain City property on South Black Avenue. J/l.r. Simkins has now exercised this option and a Bargain & Saie deed from the City to Robert G. Slmklns was placed before the Commission for proper signature and transfer of the follow- ing property: "All of lots 1, 2 and 3, Block 2, Spring Dell Addition to the City of Bozeman." .., It was moved by Mayor Swanson, seconded by Commissioner staudaher, that the Mayor and the Clerk be authorized to sign the deed for the City and that all receipts from the sale be placed in the Park Trust Fund and the motion was carried by the following Aye and No vote: those voting Aye being Mayor Swanson I and Commissioner Staudaher; those voting No, none.
